An 8(e) charge may be filed againsteither an employer, a union or both entities.All parties to the agreement alleged to be violative of Section 8(e) should beserved with a copy of the charge, regardless of whether a party has been named as acharged party. Sec. 10040.7. If complaint issues, each noncharged party should benamed in the caption of the complaint as “party to the contract.” In appropriatecircumstances, recourse to injunctive relief is provided for in Section 10(l) of the Act.Secs. 10238–10248.10224 Settlements in 8(e) Cases10224.1 NoticesAlthough Section 8(e) prohibits parties from “enter(ing) into” a prohibitedcontract or agreement, the language in the proposed notice for settlements involvingSection 8(e) provides, in addition, that the charged employer and/or union will not“maintain, give effect to or enforce” the 8(e) contract or agreement. Such remediallanguage is necessary to give meaning and effect to Congressional intent to interdict “hotcargo” agreements.The following language is suggested to assist in drafting proposed notices inSection 8(e) [Hot Cargo] cases:WE WILL NOT maintain, give effect to, or enforce ouragreement [identify the clause at issue, e.g., by section, title, date, or otherrecognizable identifier] with [name of union or employer], or any otheragreement, which requires [us or name of employer] to stop doingbusiness with any other person.Revised 01/11
