It also deals with cases involving breaches of c<strong>on</strong>tracts of employment orapprenticeship. Claims lodged by both employees and employers are heard at <strong>the</strong>Labour Tribunal. A comm<strong>on</strong> item of claim lodged by employers, for example, is <strong>the</strong>wages in lieu of notice <strong>on</strong> <strong>the</strong> employees’ resignati<strong>on</strong> or terminati<strong>on</strong> of c<strong>on</strong>tract ofemployment.8.6 N<strong>on</strong>e<strong>the</strong>less, <strong>the</strong> Labour Tribunal <strong>on</strong>ly hears cases where <strong>the</strong> amount ofclaim exceeds $8,000 for at least <strong>on</strong>e of <strong>the</strong> claimants in a claim or where <strong>the</strong> numberof claimants in <strong>the</strong> claim exceeds ten. Claims lodged by not more than ten claimantsfor a sum of m<strong>on</strong>ey not exceeding $8,000 per claimant are dealt with by <strong>the</strong> MinorEmployment Claims Adjudicati<strong>on</strong> Board.The Ombudsman8.7 Likewise, a complaint about <strong>the</strong> SWD does not necessarily have to be dealtwith as a welfare issue. For instance, if <strong>the</strong> SWD fails to resp<strong>on</strong>d to an enquiryabout its service within a reas<strong>on</strong>able period of time, <strong>the</strong> aggrieved member of <strong>the</strong>public can request an explanati<strong>on</strong> from <strong>the</strong> department itself or lodge a complaint with<strong>the</strong> Ombudsman. The Ombudsman has a missi<strong>on</strong> to redress grievances and addressissues arising from maladministrati<strong>on</strong> in <strong>the</strong> public sector and bring aboutimprovement in <strong>the</strong> quality and standard of, and promote fairness in, publicadministrati<strong>on</strong>. Am<strong>on</strong>g o<strong>the</strong>r functi<strong>on</strong>s, it investigates complaints against almost all<strong>gov</strong>ernment departments and major public organisati<strong>on</strong>s for alleged maladministrati<strong>on</strong>such as inefficiency, unreas<strong>on</strong>able or improper acti<strong>on</strong>s or procedures, abuse of power,negligence and disparity of treatment, etc. If <strong>the</strong> Ombudsman detects administrativefaults after investigating <strong>the</strong> complaint, she may make recommendati<strong>on</strong>s to correct it.For instance, she may recommend <strong>the</strong> relevant authority to review a decisi<strong>on</strong>, changea procedure or suggest some o<strong>the</strong>r remedies. While ensuring that wr<strong>on</strong>gs are righted,she also points out facts when public officers are unjustly accused.8.8 As in any complaints handing mechanism, <strong>the</strong>re are also limits to <strong>the</strong>Ombudsman’s power of investigati<strong>on</strong>. According to <strong>the</strong> Ombudsman Ordinance(Cap.397), <strong>the</strong> Ombudsman will not investigate complaints about policy, pers<strong>on</strong>nelmatters or c<strong>on</strong>tractual/ commercial transacti<strong>on</strong>s, or complaints not made by <strong>the</strong>aggrieved himself or an office bearer acting <strong>on</strong> behalf of a body corporate. TheOmbudsman will not take acti<strong>on</strong> <strong>on</strong> cases for which <strong>the</strong> complainant has a statutory- 97 -
