Appendixes ASADA ANNUAL REPORT 2012:13Appendix E: ASADA AND CEO FUNCTIONS, POWERSAND DELEGATIONSThis appendix lists the functions, powers and delegations of ASADA and its CEO under the <strong>Australian</strong> <strong>Sports</strong><strong>Anti</strong>-<strong>Doping</strong> <strong>Authority</strong> Act 2006 (the ASADA Act).For an explanation of abbreviations used in this section, see the ‘List of abbreviations’ at the end of this report.CEO’s functionsUnder section 21 of the ASADA Act, the CEO has the following functions:a. such functions as are conferred on the CEO by Part 2 of the ASADA Actb. such functions as are conferred on the CEO by the NAD schemec. to advise the ASC about sports doping and safety matters that should be included in any agreement underwhich the ASC gives money to a sporting organisationd. to support, encourage, develop and implement initiatives that increase the skills and knowledge of peopleinvolved in sporting activities about sports doping and safety matterse. to support and encourage the sporting community to develop and implement comprehensive programs,and education initiatives, about sports doping and safety mattersf. to support, encourage and conduct research about sports doping and safety mattersg. to collect, analyse, interpret and disseminate information about sports doping and safety mattersh. to encourage the development of ways for the states and territories, and sporting organisations, to carry outinitiatives about sports doping and safety mattersi. to cooperate with the states and territories, and with sporting organisations, to carry out initiatives aboutsports doping and safety mattersj. to cooperate with an organisation of a foreign country in the Oceania region that has functions that are thesame as, or similar to, those of the CEOk. to provide the following services under contract on behalf of the Commonwealth:i. anti-doping testing servicesii. safety checking servicesiii. other services (including educational services) relating to sports doping and safety matterska. to make resources and facilities (including secretariat services and clerical assistance) available to theAdvisory Group for the purposes of enabling the Advisory Group to perform its functionkb. to make resources and facilities (including secretariat services and clerical assistance) available to the<strong>Anti</strong>-<strong>Doping</strong> Rule Violation Panel (ADRVP) for the purposes of enabling the ADRVP to perform its functionsl. to make resources and facilities (including secretariat services and clerical assistance) available to theASDMAC for the purposes of enabling the ASDMAC to perform its functionsm. such other functions as are conferred on the CEO by this Act or any other law of the Commonwealthn. to advise the Minister about matters relating to any of the above functionso. to do anything incidental to or conducive to the performance of any of the above functions.CEO’s powersUnder section 22 of the ASADA Act, the CEO has the power to do all things necessary or convenient to be done foror in connection with the performance of his or her functions. In exercising her power, the CEO must comply withsection 44 of the FMA Act.153
