The study, comb<strong>in</strong><strong>in</strong>g qualitative <strong>and</strong> quantitative researchmethods, sheds light on <strong>the</strong> compet<strong>in</strong>g claims about <strong>the</strong> extent to which <strong>the</strong> <strong>youth</strong> <strong>justice</strong><strong>system</strong> delivers unfair <strong>treatment</strong> on <strong>the</strong> grounds of ethnicity.WHAT IS ALREADY KNOWN ON THIS TOPIC:•n Ethnic groups are unequally represented <strong>in</strong> <strong>the</strong> crim<strong>in</strong>al <strong>justice</strong> <strong>system</strong>, an<strong>in</strong>equality which is replicated <strong>in</strong> <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong>.•n Disproportionality is largely (but not entirely) preserved as young offenders passthrough <strong>the</strong> <strong>system</strong>. Many of <strong>the</strong> differences between those from ethnic m<strong>in</strong>orities<strong>and</strong> those from <strong>the</strong> white majority could not be accounted for by features of <strong>the</strong>offence or crim<strong>in</strong>al history of <strong>the</strong> defendant, <strong>in</strong>dicat<strong>in</strong>g possible discrim<strong>in</strong>ation.WHAT THIS REPORT ADDS:•n The study confirms that ethnic m<strong>in</strong>ority youngsters are disproportionally present<strong>in</strong> all stages of <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong> <strong>and</strong> that elements of discrim<strong>in</strong>ation arestill evident.•n A greater proportion of young people are drawn <strong>in</strong>to <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong>through reactive polic<strong>in</strong>g than through proactive polic<strong>in</strong>g tactics such as stop <strong>and</strong>search. However arrests through proactive polic<strong>in</strong>g still account for a significantm<strong>in</strong>ority of <strong>the</strong> total, leav<strong>in</strong>g ample scope for differential polic<strong>in</strong>g to shape <strong>in</strong>flows<strong>in</strong>to <strong>the</strong> <strong>system</strong>.Styles of polic<strong>in</strong>g vary markedly across area <strong>and</strong> between polic<strong>in</strong>g units, <strong>and</strong> <strong>the</strong>se•nstyles can affect <strong>the</strong> profile of young people enter<strong>in</strong>g <strong>the</strong> <strong>system</strong>.© <strong>Equality</strong> <strong>and</strong> Human Rights CommissionPublished March 2010
