DIFFERENTIAL TREATMENT IN THE YOUTH JUSTICE SYSTEMBe<strong>in</strong>g rem<strong>and</strong>ed <strong>in</strong> custodyControll<strong>in</strong>g for case characteristics <strong>and</strong> YOT area:• The odds of an Asian young person be<strong>in</strong>g rem<strong>and</strong>ed <strong>in</strong>to custody was 1.8times higher than <strong>the</strong> odds of a white young person.• The odds of a black young person be<strong>in</strong>g rem<strong>and</strong>ed <strong>in</strong>to custody was 1.9times higher than <strong>the</strong> odds of a white young person.To exam<strong>in</strong>e whe<strong>the</strong>r additional characteristics of young people can expla<strong>in</strong> <strong>the</strong>differences between ethnic groups, data was collected from Asset. 54 Asset is anassessment tool used by YOTs to identify <strong>the</strong> ma<strong>in</strong> factors which <strong>in</strong>fluence a youngoffender’s risk of reoffend<strong>in</strong>g <strong>and</strong> to act as an <strong>in</strong>dicator of <strong>the</strong>ir needs. Practitionersscore offenders on 12 different factors associated with risk of reoffend<strong>in</strong>g, withscores of zero if <strong>the</strong>re is no likelihood of fur<strong>the</strong>r offend<strong>in</strong>g, through to four where<strong>the</strong>re is a strong likelihood of fur<strong>the</strong>r offend<strong>in</strong>g. High scores on <strong>the</strong> factors meanthat a young offender is of high need, <strong>and</strong> is at high risk of reoffend<strong>in</strong>g, with scoresof two or more <strong>in</strong>dicat<strong>in</strong>g that an <strong>in</strong>tervention should take place (Nacro, 2007).The 12 core elements are:• liv<strong>in</strong>g arrangements• education, tra<strong>in</strong><strong>in</strong>g <strong>and</strong> employment• lifestyle• physical health• Perception of self <strong>and</strong> o<strong>the</strong>rs• attitudes to offend<strong>in</strong>g• family <strong>and</strong> personal relationships• neighbourhood• substance use• emotional <strong>and</strong> mental health• th<strong>in</strong>k<strong>in</strong>g <strong>and</strong> behaviour• motivation to change54The Asset sample has only been used for <strong>the</strong> rem<strong>and</strong> model as no data was available for pre-courtdisposals, <strong>and</strong> levels of miss<strong>in</strong>g data were high for cases result<strong>in</strong>g <strong>in</strong> first-tier court disposals.83
