DIFFERENTIAL TREATMENT IN THE YOUTH JUSTICE SYSTEM<strong>the</strong>m that he has <strong>the</strong> permission of <strong>the</strong> Super<strong>in</strong>tendent to take photographs of allthose who are stopped <strong>and</strong> searched. They are told that <strong>the</strong>ir photos may be usedfor <strong>the</strong> purposes of <strong>in</strong>telligence <strong>and</strong> will be deleted with<strong>in</strong> seven days if <strong>the</strong>y are notrequired. The young men are angered by this, <strong>in</strong> part because <strong>the</strong>y are asked toremove <strong>the</strong>ir headgear. The checks reveal that both 17 year olds are known to <strong>the</strong>police but <strong>the</strong>y are not currently wanted. The outcome for each of <strong>the</strong> young males isno fur<strong>the</strong>r action. The most vocal of <strong>the</strong> three asks for a copy of <strong>the</strong> stop <strong>and</strong> searchform, which at <strong>the</strong> time has not been started. The officer remarks that <strong>the</strong> completionof <strong>the</strong> form could take anywhere between 15 to 20 m<strong>in</strong>utes as his ‘writ<strong>in</strong>g h<strong>and</strong> hurts<strong>and</strong> so it’s a little slow today’. The teenager confirms that he is happy to wait <strong>and</strong>dem<strong>and</strong>s that a form be completed. His two friends are laugh<strong>in</strong>g <strong>and</strong> tell him toforget about <strong>the</strong> form so that <strong>the</strong>y can be on <strong>the</strong>ir way. He is adamant, however,that he wants a copy.While wait<strong>in</strong>g, <strong>the</strong> young man tells his friends that he is <strong>in</strong> court <strong>the</strong> follow<strong>in</strong>g day <strong>and</strong>will produce this <strong>and</strong> <strong>the</strong> o<strong>the</strong>r forms to show <strong>the</strong> judge that he is frequently stopped<strong>and</strong> searched by <strong>the</strong> police. The officers ask why he is attend<strong>in</strong>g court, <strong>and</strong> he tells<strong>the</strong>m to m<strong>in</strong>d <strong>the</strong>ir own bus<strong>in</strong>ess. He does, however, <strong>in</strong>form <strong>the</strong>m that he will beappear<strong>in</strong>g before <strong>the</strong> <strong>youth</strong> court. The officers laugh <strong>and</strong> tell him that ‘<strong>the</strong> <strong>youth</strong> courtis for kids’ <strong>and</strong> how he isn’t a real man yet because if he was he would be at <strong>the</strong>Crown Court. The young male retaliates by swear<strong>in</strong>g at <strong>the</strong> officers. His friends, whoare both laugh<strong>in</strong>g, tell him to shut up <strong>and</strong> impress upon him that <strong>the</strong> officers arew<strong>in</strong>d<strong>in</strong>g him up for <strong>the</strong> fun of it <strong>and</strong> he should keep quiet. After some time, <strong>the</strong> officerprovides <strong>the</strong> young man with a stop <strong>and</strong> search form <strong>and</strong> <strong>the</strong>y depart <strong>the</strong> scene.Police-<strong>in</strong>itiated stop <strong>and</strong> search17.45 The officers I am observ<strong>in</strong>g are driv<strong>in</strong>g through a well-known open drug marketwhen <strong>the</strong>y spot a black teenager down an alleyway with a bike appear<strong>in</strong>g to fiddlewith his sock while talk<strong>in</strong>g to a white girl. The two officers believe that <strong>the</strong> boy may besell<strong>in</strong>g drugs. One of <strong>the</strong> officers jumps out of <strong>the</strong> car to see what is go<strong>in</strong>g on. Heapproaches <strong>the</strong> two <strong>and</strong> startles <strong>the</strong>m. He asks what <strong>the</strong>y are do<strong>in</strong>g, <strong>the</strong> boy replies:‘I’m chatt<strong>in</strong>g to my friend.’ The officer asks how old he is <strong>and</strong> if he has anyth<strong>in</strong>g onhim he shouldn’t. He replies that he is 16 <strong>and</strong> he doesn’t have anyth<strong>in</strong>g on him. Thegirl doesn’t reply. The officer tells <strong>the</strong> boy that he is <strong>in</strong> an area known for drug sell<strong>in</strong>g47
