DIFFERENTIAL TREATMENT IN THE YOUTH JUSTICE SYSTEMThe overall aim of this study is to derive a better underst<strong>and</strong><strong>in</strong>g of <strong>the</strong> ways <strong>in</strong> whichdifferent ethnic groups are treated with<strong>in</strong> <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong>. To do this, it isessential to underst<strong>and</strong> how <strong>the</strong> <strong>in</strong>flows <strong>in</strong>to <strong>the</strong> <strong>system</strong> are created through polic<strong>in</strong>g,<strong>and</strong> how <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong> itself responds to <strong>the</strong>se <strong>in</strong>flows.The objectives of <strong>the</strong> study were to:• exam<strong>in</strong>e how young suspects are drawn <strong>in</strong>to <strong>the</strong> crim<strong>in</strong>al <strong>justice</strong> <strong>system</strong>• assess whe<strong>the</strong>r <strong>the</strong> ma<strong>in</strong> ethnic groups are under-represented or overrepresented,relative to <strong>the</strong> local population, <strong>in</strong> <strong>the</strong>se <strong>in</strong>flows• exam<strong>in</strong>e comprehensive data from YOTs on young people <strong>in</strong>volved <strong>in</strong> <strong>the</strong> crim<strong>in</strong>al<strong>justice</strong> <strong>system</strong>, <strong>and</strong> make statistical comparisons between decisions made <strong>in</strong>cases <strong>in</strong>volv<strong>in</strong>g young people of different ethnic backgrounds• exam<strong>in</strong>e whe<strong>the</strong>r decision-mak<strong>in</strong>g processes amplify, reduce or leave unchangedobserved differences between ethnic groups• <strong>in</strong>vestigate through <strong>in</strong>terviews <strong>and</strong> observations <strong>the</strong> reasons why different groupsare under- or over-represented <strong>in</strong> <strong>the</strong> <strong>system</strong>, <strong>and</strong>• assess whe<strong>the</strong>r over-representation of some ethnic m<strong>in</strong>ority groups is likely to bea function of direct or <strong>in</strong>direct discrim<strong>in</strong>ation.1.5 The shape of this reportFollow<strong>in</strong>g this <strong>in</strong>troductory chapter, Chapter 2 describes our research methods.Chapter 3 presents results from <strong>the</strong> analysis of police stop <strong>and</strong> search figures,custody record statistics <strong>and</strong> observational data. The aim is to exam<strong>in</strong>e <strong>the</strong> extent towhich <strong>the</strong> police control <strong>the</strong> <strong>in</strong>flows of young offenders <strong>in</strong>to <strong>the</strong> <strong>youth</strong> <strong>justice</strong> <strong>system</strong>.Chapter 4 takes a broader look at <strong>the</strong> relationship between <strong>the</strong> police <strong>and</strong> youngpeople, <strong>and</strong> <strong>the</strong> styles employed to police young people. It uses <strong>in</strong>terview data with<strong>the</strong> police <strong>and</strong> young people, <strong>and</strong> observations of <strong>the</strong> police. Chapter 5 analyses datafrom 12 Youth Offend<strong>in</strong>g Teams (YOTs), <strong>and</strong> broadly replicates <strong>the</strong> study of Feilzer<strong>and</strong> Hood (2004). The f<strong>in</strong>al chapter draws toge<strong>the</strong>r f<strong>in</strong>d<strong>in</strong>gs <strong>and</strong> offers ourconclusions <strong>and</strong> recommendations.11
