La División de Derechos Humanos del Estado de Nueva
York defiende sus derechos en asuntos de vivienda
La discriminación en
asuntos de vivienda perjudica
seriamente a sus
víctimas, causándoles daño
emocional y financiero. En el
estado de Nueva York, la Ley
de Derechos Humanos prohíbe
la discriminación en asuntos
de viviendas y de concesión
de préstamos, así como muchas
otras áreas. La División
de Derechos recibe e investiga
las querellas relacionadas con
discriminación en asuntos de
viviendas y concesión de préstamos
y, si encuentra evidencia
de discriminación, puede llevar
a cabo audiencias públicas
y emitir órdenes de acatamiento.
Si usted considera que sus
derechos han sido infringidos,
puede presentar una querella
en la División. No necesita un
abogado para presentar una
querella.
¿Quiénes están protegidos?
La Ley de Derechos Humanos
del Estado de Nueva York prohíbe
la discriminación en asuntos
de vivienda en virtud de
varias categorías protegidas.
Es ilegal que alguien discrimine
contra usted por una de
estas características que están
protegidas por la ley. Las categorías
protegidas son: raza,
religión, color, origen nacional,
sexo, edad, discapacidad,
estado civil, orientación sexual
y estado familiar. Si alguien le
niega acceso a una vivienda, y
el motivo es una de las categorías
mencionadas, cualquiera
que sea, es ilegal. Si un casero
le ordena a un agente inmobiliario
que no alquile los apartamentos
de su edifico a “minorías”
o personas solteras está
violando la ley.
¿Qué está prohibido?
La Ley de Derechos Humanos
prohíbe la discriminación en la
venta, alquiler, o arrendamiento
de una vivienda basado en
alguna de las categorías protegidas.
Específicamente, la ley
prohíbe rehusarse a vender, alquilar
o arrendar una vivienda.
Discriminar en cuanto a la disponibilidad
de recursos o servicios
en relación con la venta,
alquiler, o arrendamiento de
una vivienda. Imprimir o hacer
circular una declaración, anuncio
o publicación estipulando
una limitación, especificación
o discriminación con respecto
a la venta, alquiler o arrendamiento
de una vivienda.
Discriminar contra una persona
con limitaciones visuales o
auditivas debido a que usa un
perro guía, un perro de ayuda
para personas con dificultades
auditivas, o un perro de servicio.
Además de las restricciones
mencionadas previamente,
la Ley de Derechos Humanos
impone obligaciones adicionales
sobre los corredores inmobiliarios,
agentes de venta
inmobiliarios y sus empleados.
Específicamente, es ilegal para
ellos rehusarse a negociar una
venta, alquiler o arrendamiento
de una vivienda.
