WHEREAS, it is not the purpose of this ordinance or the Common Council to suppress any<br />

speech activities protected by the First Amendment, but instead to enact a content-neutral<br />

ordinance which addresses the secondary effects of adult establishments;<br />

WHEREAS, the Common Council recognizes that it lacks authority to regulate obscenity<br />

pursuant to Wis. Stat. § 66.0107(3) <strong>and</strong> does not intend by adopting this ordinance to regulate<br />

obscenity, but instead only intends <strong>and</strong> declares its intent to enact an ordinance addressing the<br />

secondary effects of adult establishments;<br />

WHEREAS, it is also not the intent of the Common Council to condone or legitimize the<br />

distribution of obscene material since the Common Council recognizes that state <strong>and</strong> federal law<br />

prohibits the distribution of obscene materials <strong>and</strong> expects <strong>and</strong> encourages state law enforcement<br />

officials to enforce state obscenity statutes against any such illegal activities in the City of<br />

Marinette;<br />

WHEREAS, the Common Council has authority under its general police powers as provided<br />

under Wis. Stat. § 62.11(5) to act for the good order of the City <strong>and</strong> for the health, safety <strong>and</strong><br />

general welfare of the public <strong>and</strong> may carry out its powers by <strong>regulation</strong> <strong>and</strong> suppression;<br />

WHEREAS, the Common Council has the authority to prescribe additional <strong>regulation</strong>s for<br />

the sale of alcohol beverages under Wis. Stat. § 125.10(1) that are not in conflict with Chapter<br />

125 of the Wisconsin Statutes;<br />

WHEREAS, the Common Council finds that locational criteria alone do not adequately<br />

protect the health, safety <strong>and</strong> general welfare of the people of the City;<br />

NOW, THEREFORE, the Common Council of the City of Marinette, do ordain as follows:<br />

Section 1. Marinette Municipal Code Section 9-2-35 is created as follows:<br />

(a) PURPOSE. It is the purpose <strong>and</strong> intent of this ordinance to protect the health, safety, <strong>and</strong><br />

general welfare of the citizens of the City of Marinette, preserve the quality of life <strong>and</strong><br />

neighborhood characteristics, prevent adverse <strong>and</strong> deleterious effects that contribute to<br />

blight <strong>and</strong> downgrading of neighborhoods, prevent criminal activity <strong>and</strong> disruption of the<br />

public peace <strong>and</strong> maintain property values. It is not the purpose or intent of this<br />

ordinance to restrict or deny access by adults to materials protected by the First<br />

Amendment, nor to deny access by the distributors <strong>and</strong> exhibitors of adult entertainment<br />

to their intended market. It is neither the purpose nor intent to impose limitations or<br />

restrictions on the content of any communicative materials or messages. By enactment of<br />

this ordinance, the Common Council does not intend to give any explicit, implicit or tacit<br />

approval or condone any activity relating to adult establishments. Further, it is not the<br />

intent of this ordinance to permit any use or act, which is otherwise prohibited or made<br />

punishable by law.<br />
