9.0200 FERMENTED MALT BEVERAGES AND INTOXICATING<br />

Article A<br />

Fermented Malt Beverages <strong>and</strong> Intoxicating Liquor<br />

9.0201 STATE STATUTES ADOPTED<br />

Except as otherwise specifically provided in this Chapter, the statutory provisions<br />

in Chapters 66 <strong>and</strong> 125, Sections 48.344 <strong>and</strong> 778.25 of the Wisconsin Statutes,<br />

<strong>and</strong> any future amendments thereto or successor statutes, describing <strong>and</strong> defining<br />

<strong>regulation</strong>s pertaining to alcoholic beverages, exclusive of any provisions therein<br />

which by their nature would be appropriate only for State or County<br />

administration <strong>and</strong> enforcement, <strong>and</strong> exclusive of any provisions therein relating<br />

to penalties to be imposed <strong>and</strong> exclusive of any <strong>regulation</strong>s for which the statutory<br />

penalty is a fine or term of imprisonment, are hereby adopted <strong>and</strong> by reference<br />

made a part of this Chapter as if fully set forth herein, <strong>and</strong> the terms used in this<br />

<strong>chapter</strong> shall have the meanings ascribed to them in said provision. Any act<br />

required to be performed or prohibited by any statute incorporated herein by<br />

reference is required to be performed or prohibited by this Chapter.<br />

9.0202 ELECTION TO ADOPT WISCONSIN STATUTES SECTION 125.51(3)(b)<br />

FOR “CLASS B" INTOXICATING LIQUOR LICENSE<br />

The City of Marinette hereby <strong>elec</strong>ts to come under Wisconsin Statutes Section<br />

125.51(3)(b) <strong>and</strong> any future amendments thereto or successor statutes. The<br />

following language contained therein is subject to any such future amendments or<br />

successor statutes: "...a retail "Class B" license authorizes the sale of intoxicating<br />

liquor to be consumed by the glass only on the premises where sold <strong>and</strong> also<br />

authorizes the sale of intoxicating liquor in the original package or container, in<br />

multiples not to exceed four (4) liters at anyone time, <strong>and</strong> to be consumed off the<br />

premise where sold. Wine, however, may be sold for consumption off premise in<br />

the original package or otherwise in any quantity."<br />

9.0203 LICENSE FEES<br />

Repealed (See MMC Section 9.1302 Schedule A)<br />

9.0204 WRITTEN INTEREST IN PREMISES REQUIRED<br />

No applicant will be considered unless he has the right to possession of the<br />

premises described in the application for the license period, by deed, lease, l<strong>and</strong><br />

contract, or other written instrument.<br />

9.0205 INVESTIGATION<br />

The City Clerk shall notify the Chief of Police, Health Officer, Code Enforcement<br />

Officer, Chief of the Fire Department, <strong>and</strong> Building Inspector of each new<br />

application, <strong>and</strong> these officials shall inspect or cause to be inspected each<br />

application <strong>and</strong> the premises, together with such other investigation as shall be<br />

necessary to determine whether the applicant <strong>and</strong> the premises sought to be<br />
