(b) PROHIBITED. No licensee under Chapter 125, Wis. Stat., or agent thereof shall<br />

knowingly permit or allow any person on the licensed premises to expose to view any<br />

portion of the person’s specified anatomical areas.<br />

(c) EXCEPTION. The prohibition in subpar. (b) shall not apply to:<br />

(1) Normal use of public restrooms;<br />

(2) Normal use of privately rented hotel rooms;<br />

(3) Any female exposing a breast to breastfeed an infant under two (2) years of age;<br />

(4) Medical emergencies; or<br />

(5) Theaters, performing arts centers, civic centers <strong>and</strong> dinner theaters where live dance,<br />

ballet, music <strong>and</strong> dramatic performances of serious artistic merit are offered on a regular<br />

basis; <strong>and</strong> in which the predominant business or attraction is not the offering of<br />

entertainment which is the sexual stimulation, gratification, or titillation to customers;<br />

<strong>and</strong> where the establishment is not distinguished by an emphasis on, or the advertising or<br />

promotion of nude or semi-nude performances.<br />

(d) DEFINITIONS. The definitions found in § 13-1-95(b) shall also apply to this subsection,<br />

unless the context requires otherwise, or the application is obviously unintended.<br />

(e) PENALTY. Any licensee who violates subpar. (b) shall be subject to a forfeiture for<br />

each offense as defined in § 1-1-7 of this Code.<br />

(f) LICENSE STATUS. Any licensee who violates this subpar. (b) shall be subject to<br />

revocation, suspension, or refusal to renew the license as set forth in Wis. Stat. § 125.12<br />

<strong>and</strong> the procedures in such section shall govern.<br />

9.0231 ALCOHOLIC BEVERAGES DURING INDEPENDENCE DAY<br />

CELEBRATION ON STEPHENSON ISLAND<br />

This ordinance shall be in effect annually during the Independence Day<br />

Celebration on the 4 th of July holiday weekend. The exact dates <strong>and</strong> times shall<br />

be determined annually by the City of Marinette Personnel <strong>and</strong> License<br />

Committee. Event Grounds means Stephenson Isl<strong>and</strong>, the Stephenson Public<br />

Library parking lot <strong>and</strong> the adjacent City owned parking lot during the annual<br />

City of Marinette Independence Day Celebration.<br />

No person may possess on or carry into event grounds any alcoholic beverage<br />

regulated by Chapter 125 of the Wisconsin Statutes, as amended, including, but<br />

not limited to fermented malt beverages, wine or wine products, <strong>and</strong> intoxicating<br />

liquor, except that alcoholic beverages purchased at authorized vendors may be<br />

possessed or consumed on event grounds. The penalty for violating this ordinance<br />

shall be governed by the general penalty provisions of Marinette Municipal Code<br />

Section 1.0101.<br />
