B. Restrictions<br />

It shall be unlawful for any person within the City of Marinette to own, harbor, or<br />

keep any dog or cat which:<br />

1. Habitually pursues any vehicle upon any public street, alley, or highway in<br />

the City.<br />

2. Assaults or attacks any person.<br />

3. Is at large within the limits of the City.<br />

4. Habitually barks or howls to the annoyance of any person or persons.<br />

5. Kills, wounds, or worries any domestic animal.<br />

6. Is known by such person to be infected with rabies or to have been bitten<br />

by an animal known to have been infected with rabies.<br />

7. Is an untagged dog.<br />

9.0307 IMPOUNDMENT OF ANIMALS<br />

A. Dog <strong>and</strong> Cat Poundmaster<br />

The Chief of Police shall appoint a suitable person to act as Poundmaster of the<br />

City. The Poundmaster shall catch, take up, <strong>and</strong> impound in a suitable place to be<br />

provided by the Poundmaster or the City, <strong>and</strong> all dogs or cats found running at<br />

large contrary to the provisions of this Chapter. The Poundmaster shall receive a<br />

fee of Three Dollars ($3.00) for every dog or cat taken up <strong>and</strong> impounded by him<br />

under the provisions of this Chapter, the fee to be paid to him out of the general<br />

fund of the City. The same powers <strong>and</strong> duties as are granted <strong>and</strong> imposed on the<br />

Poundmaster are also granted <strong>and</strong> imposed on all police officers of the City,<br />

except that police officers shall not be entitled to receive any fee for such<br />

services. In addition, the City Sanitarian shall be allowed to seize <strong>and</strong> destroy all<br />

unlicensed animals <strong>and</strong> their litter, adjudged by him to be wild or feral <strong>and</strong><br />

breeding in a public place in an uncontrolled manner.<br />

B. Redemption of Dogs or Cats From Pound<br />

In order to redeem any dog or cat which may have been impounded under this<br />

Chapter, the person desiring to redeem the same shall pay to the Poundmaster or<br />

the Chief of Police the sum of Two Dollars ($2.00), <strong>and</strong> upon the receipt of such<br />

sum <strong>and</strong> boarding charges the dog or cat shall be released. If the dog or cat is<br />

without a proper dog or cat license, the person redeeming the dog or cat shall first<br />

procure a dog or cat license tag. The Poundmaster or Chief of Police shall keep a<br />

register of all dogs <strong>and</strong> cats impounded, showing the date <strong>and</strong> time of impounding<br />

the same, a description of the dog or cat, the name of the person claiming<br />

ownership if such dog or cat is redeemed, or the date of killing or other disposal if<br />

such dog or cat is not redeemed. The boarding charges shall be the actual cost per<br />

day for the animal's upkeep.<br />
