1. The placement of grain, fruit, or vegetable material in an aggregate<br />

quantity of greater than one-half gallon at a height of less than six feet off<br />

the ground.<br />

2. The placement of grain, fruit, or vegetable material in an aggregate<br />

quantity of greater than one-half gallon in a drop feeder, automatic feeder<br />

or similar device regardless of the height of the grain, fruit, or vegetable<br />

material.<br />

C. Exceptions<br />

This ordinance shall not apply to the following situations:<br />

1. Hunting. The placement of bait for the purpose of hunting whitetail<br />

deer subject to all other laws, ordinances, rules <strong>and</strong> <strong>regulation</strong>s<br />

governing hunting <strong>and</strong> the discharge of hunting weapons.<br />

2. Naturally Growing Materials. Naturally growing grain, fruit or<br />

vegetable material.<br />

3. Bird Feeders. Unmodified commercially purchased bird feeders or<br />

their equivalent.<br />

9.0327 PENALTIES<br />

Any person who shall violate any provisions of Chapter 9, Section 9.0300<br />

pertaining to "Dangerous Dogs", shall be governed by the general penalty<br />

provisions of Marinette Municipal Code Section 1.0107, except that the minimum<br />

forfeiture for a first offense shall be One Hundred Dollars ($100.00) <strong>and</strong> the<br />

minimum forfeiture for a second offense shall be Five Hundred Dollars ($500.00).<br />
