9.0300 REGULATION OF ANIMALS<br />

9.0301 DOG LICENSES REQUIRED<br />

A. License Required<br />

It shall be unlawful for any person in the City of Marinette to own, harbor,<br />

or keep any dog more than five (5) months of age without complying with<br />

the provisions of this Chapter relating to the listing, licensing, <strong>and</strong> tagging<br />

of the same.<br />

B. Definitions<br />

In this Chapter, unless the context or subject matter otherwise require:<br />

1. "Animal Control Authority": Marinette Police Department, including its<br />

Public Service Officer <strong>and</strong> other designated civilian employees.<br />

2. "At large" means an animal shall be deemed to be running at large when it is<br />

permitted to run off of the premises of the owner or keeper when it is not<br />

accompanied by a person having said animal control on a leash. Said animal<br />

shall be physically tethered with a leash no longer than six (6) feet.<br />

3. “Collar" means a b<strong>and</strong>, strip, or chain placed around the neck of the dog.<br />

4. “Dangerous Dog" shall be defined as any one of the following:<br />

(a) Any dog which, according to the records of the Animal Control<br />

Authority, has inflicted severe injury or death on a human being without<br />

sufficient provocation on public or private property.<br />

(b) Any dog which, according to the records of the Animal Control<br />

Authority, has killed a domestic animal without sufficient provocation<br />

while off the owner's property.<br />

(c) Any dog owned or harbored primarily or in part for the purpose of dog<br />

fighting or any dog trained for dog fighting.<br />

(d) Any dog which, when unprovoked, chases or approaches a person<br />

upon the streets, sidewalks, or any public or private property in a<br />

menacing fashion or apparent attitude of attack.<br />

(e) Any dog which, when unprovoked, has inflicted nonfatal, nonsevere<br />

injury on a human.<br />

(f) Any dog with a known propensity, tendency, or disposition to attack<br />

unprovoked, to cause injury, or to otherwise threaten the safety of human<br />

beings or domestic animals.<br />

5. “Owner" includes any person who owns, harbors, or keeps a dog.<br />

6. “Restrain" includes notifying the dog’s owner or an officer <strong>and</strong> requesting<br />

either the owner or officer to capture <strong>and</strong> restrain the dog;<br />
