Seven-Year Major Structural Defect Coverage<br />
The Tarion Warranty Corporation off ers a seven-year warranty for major<br />
structural problems. In <strong>the</strong> unlikely event of such a problem, contact <strong>the</strong> Tarion<br />
offi ce directly at 1.877.982.7466. Your home’s seven-year Major Structural<br />
Defect (MSD) coverage begins on <strong>the</strong> date of possession and remains in<br />
eff ect even if your home is sold before <strong>the</strong> coverage expires. A Major Structural<br />
Defect is defi ned in <strong>the</strong> Tarion Warranty Corporation Act as: Any defect<br />
in materials or work that results in <strong>the</strong> failure of a load-bearing part of <strong>the</strong><br />
home’s structure or materially and adversely aff ects its load-bearing function;<br />
or any defect in materials or work that signifi cantly and adversely aff ects <strong>the</strong><br />
use of <strong>the</strong> building as a home.<br />
During <strong>the</strong> fi rst two years of possession,<br />
you should report any major structural<br />
defect items to both <strong>Minto</strong> and Tarion<br />
on <strong>the</strong> 30-Day, Year-End or Second-Year<br />
Form, as applicable. At any time after<br />
your second year of possession, but no<br />
later than <strong>the</strong> expiry of <strong>the</strong> seventh year<br />
of your warranty, you should report any<br />
major structural defect items directly<br />
to Tarion using a Major Structural Defect Form. After <strong>the</strong> conclusion of your<br />
second year of possession, Tarion (not <strong>Minto</strong>) is responsible for any new major<br />
structural defect warranty service requests.<br />
During years three through seven, Tarion will schedule and conduct an inspection,<br />
and issue a decision to you within 10 days of <strong>the</strong> date Tarion received<br />
your Major Structural Defect Form. If <strong>the</strong> item is found to be covered by <strong>the</strong><br />
warranty, Tarion will settle <strong>the</strong> claim directly with you.<br />
If you wish to report an MSD in <strong>the</strong> common elements, you should notify your<br />
condominium corporation’s Board of Directors so that <strong>the</strong> Board can decide<br />
what action to take under <strong>the</strong> common elements warranty.<br />
Seasonal Warranty Items<br />
Seasonal warranty items involve service requests regarding <strong>the</strong> exterior of<br />
your home that cannot be repaired eff ectively within <strong>the</strong> timelines set out in<br />
<strong>the</strong> Warranty Service Rules due to regular seasonal conditions and/or severe<br />
sustained wea<strong>the</strong>r. The period from May 1st to November 15th is generally<br />
considered to have suitable wea<strong>the</strong>r conditions for making such repairs. In<br />
high rise or low rise condominiums, <strong>the</strong>se items are more likely to aff ect <strong>the</strong><br />
common elements warranty and if so, would be handled by <strong>the</strong> condominium<br />
corporation’s Board of Directors. These items include:<br />
• Exterior painting<br />
• Exterior cement/concrete work (including parging application<br />
and repair)
