Broker must also disclose to the other contracting party all substantial matters relating to<br />

the subject matter of the agreem<strong>en</strong>t, which are deemed necessary to avoid uncertainty.<br />

Article (18)<br />

A Real Estate Broker may not facilitate any transaction that violates the laws or regulations<br />

in force in the Emirate.<br />

Article (19)<br />

Despite the fact that a Real Estate Broker repres<strong>en</strong>ts only one of the parties to the<br />

transaction, he must faithfully disclose the transaction details and conditions he is<br />

aware of. The Real Estate Broker will be held responsible for any fraud or mistake he<br />

may commit.<br />

Article (20)<br />

A Real Estate Broker may not hold himself out as second party in the contract he facilitates<br />

unless he is so authorised by one of the contracting parties, in which case the Real Estate<br />

Broker will not be <strong>en</strong>titled to any remuneration.<br />

Article (21)<br />

A Real Estate Broker will be deemed the trustee of any amounts, securities, bonds, or any<br />

other items delivered to him by any of the parties for safekeeping or for delivery to the<br />

other party. The Real Estate Broker must deliver such items as agreed and will be bound<br />

by the relevant trusteeship rules.<br />

Article (22)<br />

A Real Estate Broker will be held liable for any loss or damage suffered by the contracting<br />

parties as a result of his fraudul<strong>en</strong>t act or deceit or as a result of failure to observe any<br />

relevant rules stipulated in this Bylaw or the code of professional ethics.<br />
