Article (13)<br />
1. As of the effective date of this Resolution, the net area of the Real Property Unit<br />
will be adopted for the purposes of registration in the Property Register and will be<br />
calculated as determined by the Departm<strong>en</strong>t.<br />
2. Any area in excess of the net area of the sold Real Property Unit may not be tak<strong>en</strong><br />
into consideration. Unless otherwise agreed, the developer may not claim the value<br />
of such extra area.<br />
3. The developer must indemnify the purchaser if the area of the Real Property Unit is<br />
less than the agreed area by more than five perc<strong>en</strong>t (5%) of the net area of such unit.<br />
4. The indemnity payable to the purchaser where the perc<strong>en</strong>tage of shortage of the<br />
net area exceeds the perc<strong>en</strong>tage prescribed in paragraph (3) of this Article will be<br />
calculated based on the price of the Real Property Unit as agreed in the relevant<br />
contract betwe<strong>en</strong> the developer and the purchaser.<br />
5. For the purposes of application of this Article, the net area of a Real Property Unit<br />
set out in the sale agreem<strong>en</strong>t and the plan of such unit will be tak<strong>en</strong> as the basis for<br />
calculation of any extra area or shortage in the area of the Real Property Unit.<br />
Article (14)<br />
If any dispute arises betwe<strong>en</strong> the developer and the purchaser, the Departm<strong>en</strong>t<br />
may attempt conciliation to preserve their contractual relationship and may propose<br />
solutions for such purpose as it may deem fit. If the Departm<strong>en</strong>t concludes an amicable<br />
settlem<strong>en</strong>t, such settlem<strong>en</strong>t must be confirmed in writing by an agreem<strong>en</strong>t executed by<br />
the developer and the purchaser or their respective repres<strong>en</strong>tatives. Upon confirmation<br />
of such agreem<strong>en</strong>t by the Departm<strong>en</strong>t, it will become binding upon both parties.<br />
Article (15)<br />
In any case where the purchaser breaches any of his obligations under the Real Property<br />
Unit sale agreem<strong>en</strong>t concluded betwe<strong>en</strong> the purchaser and the developer:<br />
a. The developer must serve a notice on the purchaser to fulfil his contractual obligations,<br />
either by appearing in person before the Departm<strong>en</strong>t or in writing by registered mail or<br />
