Article (2)<br />
Where a Master Developer or Sub-developer requests, within the period stipulated in<br />
paragraph (2) of Article (3) of the Law, the registration of the legal disposition of a Real<br />
Property Unit with the Departm<strong>en</strong>t, it will be deemed that he has complied with the time<br />
period required by the Law, ev<strong>en</strong> if the Departm<strong>en</strong>t fails to complete the registration<br />
procedure within such period.<br />
Article (3)<br />
If the Master Developer or Sub-developer submits a request to register the legal<br />
disposition of the Real Property Unit after expiry of the time period stipulated in paragraph<br />
(2) of Article (3) of the Law, the Departm<strong>en</strong>t must:<br />
1. register the legal disposition in the Interim Property Register; and<br />
2. impose a fine of t<strong>en</strong> thousand Dirhams (AED 10,000.00) on the developer.<br />
Article (4)<br />
The Master Developer or Sub-developer may not comm<strong>en</strong>ce implem<strong>en</strong>tation of the<br />
project or dispose of its Real Property Units by way of Off-plan Sale unless:<br />
1. he has tak<strong>en</strong> possession of the land plot and has received the demarcation certificate;<br />
2. he has actual control over the land plot where the project is proposed to be<br />
constructed; and<br />
3. he has obtained the required approvals from the Compet<strong>en</strong>t Entities to comm<strong>en</strong>ce<br />
implem<strong>en</strong>tation of the project.<br />
Article (5)<br />
1. The Departm<strong>en</strong>t must, whether on its own initiative or upon request by the concerned<br />
parties, indicate in the record of the land plot where a developm<strong>en</strong>t project is to be<br />
constructed that the project is designated as “a developm<strong>en</strong>t project governed by<br />
the provisions of the Law”.<br />
2. The Departm<strong>en</strong>t will remove the designation referred to in the preceding<br />
paragraph upon completion of the developm<strong>en</strong>t project and registration of its<br />
