Since these promising policies have
only emerged during the last 3 years,
it is still not possible to verify the
developers' compliance. In 2017,
a project in Nha Trang, whose
guaranteed yield was promised at 15%
per year, could not afford to pay the
buyers after it went into operation.
The developer then asked to reduce
the commitment rate to 8% per year,
and the case is in an on-going dispute.
This reminds the buyer to consider the
project's operational capability after
the sale - often if the project is under
the same reputable management as
the hotel in the same project, buyers
can be more reassured.
Vietnam tourism is
hopeful in 2018
In recent years, Vietnam's visa
application procedures have improved
considerably. At the end of 2015,
Vietnam granted visa waivers for
citizens of five European countries.
2017 marks the first year Vietmam is
granting electronic visas for citizens
from 40 countries (6 more have
just been added under a Resolution
issued December, 2017). In terms
of infrastructure, more international
flights come directly to major tourist
destinations (such as Bangkok Airways
with the Bangkok - Phu Quoc route
or Thomson Airways with the London
- Phu Quoc route).
Van Don International Airport is
expected to be put into operation in
Quarter 1, 2018, which will increase
the number of tourists to Quang Ninh.
These will lay a firm foundation for
Vietnam's tourism industry in 2018.
Cam Ranh and the coastal area
extending from South Da Nang to
Hoi An are expected to be bright spots
in terms of new supply, thanks to
the availability of development sites.
In addition, if the Special Economic
Administrative Law is passed
(expected to pass mid-2018), Van Don,
northern Van Phong, and Phu Quoc
are expected to attract many investors
and developers.
Legal issues for
foreign investors
Foreign investors rarely buy vacation
properties because of a number of
legal issues. As condotels are both
residential and commercial land, a clear
legal framework is not around for this
type of project. According to the law,
pink books are not to be provided for
foreigners in areas of national security
and defense, while local authorities
in those areas are not given clear and
proper guidance. Many developers are
not interested in marketing this type of
property to foreign buyers.
