Draft first regional report on the implementation of the Montevideo Consensus on Population and Development

This draft report seeks to give an account of progress in the implementation of the priority measures of the Montevideo Consensus on Population and Development in the region, as well as the differences between countries in terms of the degree of implementation. By highlighting relevant national experiences, it also seeks to facilitate the exchange of good practices among countries so that they can benefit from each other in their efforts to advance the implementation of the actions of the Montevideo Consensus.

• 69. Promote <strong>the</strong> signing <strong>of</strong> bilateral <strong>and</strong> multilateral social security c<strong>on</strong>venti<strong>on</strong>s to enable migrant<br />

workers to accumulate years <strong>of</strong> service.<br />

The Ibero-American Multilateral Agreement <strong>on</strong> Social Security, ratified by 13 countries in <strong>the</strong> regi<strong>on</strong><br />

(Argentina, <strong>the</strong> Bolivarian Republic <strong>of</strong> Venezuela, Brazil, Chile, Colombia, Costa Rica, <strong>the</strong> Dominican Republic,<br />

Ecuador, El Salvador, Paraguay, Peru, <strong>the</strong> Plurinati<strong>on</strong>al State <strong>of</strong> Bolivia <strong>and</strong> Uruguay 113 ) is <strong>the</strong> most important<br />

example <strong>of</strong> <strong>the</strong> progress made with respect to this measure. Although an analysis has yet to be made <strong>of</strong><br />

progress <strong>and</strong> <strong>the</strong> difficulties encountered in <strong>the</strong> countries that have taken acti<strong>on</strong> to implement <strong>the</strong> C<strong>on</strong>venti<strong>on</strong><br />

(that is, those menti<strong>on</strong>ed above, except for four which have yet to do so 114 ), <strong>the</strong> important thing is that this<br />

measure has been included in <strong>the</strong> zero draft <strong>of</strong> <strong>the</strong> global compact for safe, orderly <strong>and</strong> regular migrati<strong>on</strong>.<br />

Several countries have <str<strong>on</strong>g>report</str<strong>on</strong>g>ed entering into bilateral agreements, based <strong>on</strong> reciprocity, while o<strong>the</strong>rs did<br />

not refer to such arrangements. O<strong>the</strong>r agreements are l<strong>on</strong>g-established, such as <strong>the</strong> CARICOM Agreement <strong>on</strong><br />

Social Security —covering all <strong>the</strong> countries <strong>of</strong> <strong>the</strong> Caribbean Community apart from Haiti <strong>and</strong> Suriname—which<br />

has been in force since 1996 <strong>and</strong> protects <strong>the</strong> entitlements <strong>of</strong> migrant workers in <strong>the</strong> subregi<strong>on</strong> by totalling<br />

all <strong>the</strong> c<strong>on</strong>tributi<strong>on</strong>s paid to <strong>the</strong> respective social security organizati<strong>on</strong>s in <strong>the</strong> member States (Mejía, 2018).<br />

Most countries have yet to <str<strong>on</strong>g>report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> number <strong>of</strong> beneficiaries covered by <strong>the</strong> Ibero-American Multilateral<br />

Agreement or by bilateral agreements. This means that work is still pending for indicator F.5, referring to <strong>the</strong><br />

percentage <strong>and</strong> number <strong>of</strong> direct beneficiaries covered by <strong>the</strong> Ibero-American Multilateral Social Security<br />

C<strong>on</strong>venti<strong>on</strong> in each country <strong>of</strong> immigrati<strong>on</strong> in relati<strong>on</strong> to <strong>the</strong> total number <strong>of</strong> immigrant workers in <strong>the</strong> labour force.<br />

• 73. Give priority, in each country, to streng<strong>the</strong>ning coordinati<strong>on</strong> channels between sectors <strong>and</strong><br />

between countries, to reinforcing intergovernmental cooperati<strong>on</strong> mechanisms in order to guarantee<br />

<strong>the</strong> exercise <strong>of</strong> <strong>the</strong> human rights <strong>of</strong> all migrants, regardless <strong>of</strong> <strong>the</strong>ir migrati<strong>on</strong> status, from a genderbased<br />

perspective;<br />

• 74. Streng<strong>the</strong>n cooperati<strong>on</strong> between countries <strong>of</strong> origin, transit <strong>and</strong> destinati<strong>on</strong> to address <strong>the</strong> causes <strong>and</strong><br />

challenges <strong>of</strong> irregular migrati<strong>on</strong>, so as to generate safe, orderly, humane migrati<strong>on</strong> c<strong>on</strong>diti<strong>on</strong>s through<br />

bilateral arrangements for labour force mobility <strong>and</strong> ensure protecti<strong>on</strong> <strong>of</strong> <strong>the</strong> human rights <strong>of</strong> migrants.<br />

As menti<strong>on</strong>ed in <strong>the</strong> analysis <strong>of</strong> o<strong>the</strong>r measures above, both priority measures are being implemented,<br />

<strong>and</strong> <strong>the</strong>re is also evidence <strong>of</strong> numerous coordinati<strong>on</strong> <strong>and</strong> cooperati<strong>on</strong> efforts as regards <strong>the</strong> agreements <strong>and</strong><br />

initiatives <strong>of</strong> <strong>the</strong> Regi<strong>on</strong>al C<strong>on</strong>ference <strong>on</strong> Migrati<strong>on</strong> <strong>and</strong> <strong>the</strong> South American C<strong>on</strong>ference <strong>on</strong> Migrati<strong>on</strong>, as well<br />

as in sub<str<strong>on</strong>g>regi<strong>on</strong>al</str<strong>on</strong>g> integrati<strong>on</strong> forums. Of particular interest is <strong>the</strong> fact that <strong>the</strong>se organizati<strong>on</strong>s have provided<br />

an example for work at <strong>the</strong> hemispheric level <strong>and</strong> within <strong>the</strong> Latin American <strong>and</strong> Caribbean community.<br />

This evidence refers to both joint declarati<strong>on</strong>s that include guiding principles, establish pensi<strong>on</strong> portability<br />

agreements <strong>and</strong> recognize competencies <strong>and</strong> qualificati<strong>on</strong>s, <strong>and</strong> protocols <strong>on</strong> assisting vulnerable pers<strong>on</strong>s<br />

—especially women, victims <strong>of</strong> human trafficking <strong>and</strong> unaccompanied minors— am<strong>on</strong>g o<strong>the</strong>rs. In its <str<strong>on</strong>g>report</str<strong>on</strong>g>,<br />

Jamaica indicated that <strong>the</strong> Ministry <strong>of</strong> Labour <strong>and</strong> Social Security had undertaken <strong>the</strong> follow-up <strong>of</strong> safe <strong>and</strong> orderly<br />

migrati<strong>on</strong> by establishing programmes for circular migrants in countries such as <strong>the</strong> United States <strong>and</strong> Canada.<br />

Ano<strong>the</strong>r clear example <strong>of</strong> progress is <strong>the</strong> intended establishment <strong>of</strong> <strong>the</strong> Caribbean Migrati<strong>on</strong> C<strong>on</strong>sultati<strong>on</strong>s<br />

(CMC), as reflected in recent initiatives in which several countries acknowledge <strong>the</strong> need to compile data,<br />

exchange informati<strong>on</strong> <strong>and</strong> analyse matters related to migrati<strong>on</strong>; <strong>the</strong> need for systematic c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong><br />

migrati<strong>on</strong> policies; <strong>and</strong> <strong>the</strong> need to share good practices <strong>on</strong> refugees <strong>and</strong> migrants in vulnerable situati<strong>on</strong>s.<br />

If it succeeds in setting up a forum for permanent intergovernmental c<strong>on</strong>sultati<strong>on</strong>, <strong>the</strong> Caribbean would be<br />

taking a significant step forward in <strong>the</strong> sub<str<strong>on</strong>g>regi<strong>on</strong>al</str<strong>on</strong>g> governance <strong>of</strong> migrati<strong>on</strong>. In its <str<strong>on</strong>g>report</str<strong>on</strong>g>, Guyana stated such<br />

a willingness, as reflected in its participati<strong>on</strong> in numerous bilateral <strong>and</strong> multilateral cooperati<strong>on</strong> agreements<br />

covering several migratory matters in <strong>the</strong> c<strong>on</strong>text <strong>of</strong> its str<strong>on</strong>g commitment to sub<str<strong>on</strong>g>regi<strong>on</strong>al</str<strong>on</strong>g> integrati<strong>on</strong>.<br />
