and whose costs shall be paid for by the applicant.
13.4 Time allowed and damages for delay under CFR and CIF Indicative Discharge Date
Contracts
13.4.1 Should the Vessel arrive at the Discharge Port such that running hours pursuant
to Section 13.2.1 above would commence at a time within the Indicative
Discharge Date given by the Seller then the time allowed and damages for delay
shall be computed in all respects in accordance with Section 13,
13.4.2 Should the Vessel arrive at the Discharge Port such that running hours pursuant
to Section 13.2.1 above would commence at a time prior to the Indicative
Discharge Date given by the Seller, then notwithstanding Section 13.3 time shall
not count against the Buyer whether as laytime or demurrage until 00.01 on the
earliest Indicative Discharge Date.
13.4.3 Should the Vessel arrive at the Discharge Port such that running hours pursuant
to Section 13.2.1 above would commence at a time after the Indicative Discharge
Date given by the Seller, then Section 13.2.1 shall be modified to the extent that
running hours shall commence Berth or no Berth 36 (thirty six) hours after NOR
is given or on commencement of discharge, whichever is the earlier. Save as
aforesaid, Section 13 shall apply in full.
