25.1.25 “LPG” means “Butane” and/or “Propane” and for the purposes hereof:<br />
(A) “Butane” means:<br />
(i) liquified butane gas which reaches a liquid state at or near a temperature of<br />
minus 4° Celsius when at a pressure of one atmosphere absolute in a<br />
saturated state, or<br />
(ii) the Product defined as Butane by the operator of the Loading Terminal at<br />
the time and place of delivery; and<br />
(B) “Propane” means:<br />
(i) liquified propane gas which reaches a liquid state at or near a temperature<br />
of minus 44° Celsius when at a pressure of one atmosphere absolute in a<br />
saturated state, or<br />
(ii) the Product defined as Propane by the operator of the Loading Terminal at<br />
the time and place of delivery;<br />
25.1.26 “MPMS” means the API Manual of Petroleum Measurement Standards as<br />
amended from time to time;<br />
25.1.27 “MSDS” or “Material Safety Data Sheet” means the Safety Data Sheet<br />
containing the information set out in Article 3 and the Annex to Commission<br />
Directive 2001/58/EC of the European Community concerning the system of<br />
specific information relating to dangerous preparations and substances;<br />
25.1.28 “MARPOL” means the International Convention for the Prevention of Pollution<br />
from Ships, as amended from time to time;<br />
25.1.29“month” means a month of the Gregorian calendar;<br />
25.1.30“NOR” means the valid notice of readiness to load or discharge, as the case may<br />
be, as given by the master of the Vessel (or his/her representative) to the Seller<br />
(or its representative) at the Loading Terminal or to the Buyer (or its<br />
representative) at the Discharge Port respectively;<br />
25.1.31 “OCIMF” means the Oil Companies International Marine Forum;<br />
25.1.32 “Persistent Oil” means all persistent hydrocarbon mineral oils other than those<br />
falling within the definition of “non-persistent oil”. For the purposes hereof, “nonpersistent<br />
oil” means oil which consists of hydrocarbon fractions:<br />
(a) at least 50% of which, by volume, distils at a temperature of 340° C, and<br />
(b) at least 95% of which distils at a temperature of 370° C when tested by<br />
the ASTM method D86/78 or any subsequent revision thereof;<br />
25.1.33 “Product” means wholly or partially refined petroleum product of the grade<br />
specified in the Special Provisions (including, where applicable, LPG);<br />
25.1.34 “safely afloat” means that the Vessel shall at all times be water-borne in<br />
compliance with <strong>BP</strong> Port Clearance requirements (including but not limited to<br />
underkeel clearance) and shall be able to remain at the Berth without risk of loss<br />
or damage from wind, weather or other craft which are being properly navigated;<br />
25.1.35 “Special Provisions” means the contract telex or other form of agreement in<br />
which, by reference, these General Terms and Conditions are incorporated to<br />
form the Agreement;<br />
25.1.36 “ton” means a metric ton or tonne;<br />
25.1.37 “typical” means a quality or characteristic often attributable to Product from a<br />
particular source, given without guarantee and not amounting to a representation<br />
