BP 2007 Products

25.1.25 “LPG” means “Butane” and/or “Propane” and for the purposes hereof:
(A) “Butane” means:
(i) liquified butane gas which reaches a liquid state at or near a temperature of
minus 4° Celsius when at a pressure of one atmosphere absolute in a
saturated state, or
(ii) the Product defined as Butane by the operator of the Loading Terminal at
the time and place of delivery; and
(B) “Propane” means:
(i) liquified propane gas which reaches a liquid state at or near a temperature
of minus 44° Celsius when at a pressure of one atmosphere absolute in a
saturated state, or
(ii) the Product defined as Propane by the operator of the Loading Terminal at
the time and place of delivery;
25.1.26 “MPMS” means the API Manual of Petroleum Measurement Standards as
amended from time to time;
25.1.27 “MSDS” or “Material Safety Data Sheet” means the Safety Data Sheet
containing the information set out in Article 3 and the Annex to Commission
Directive 2001/58/EC of the European Community concerning the system of
specific information relating to dangerous preparations and substances;
25.1.28 “MARPOL” means the International Convention for the Prevention of Pollution
from Ships, as amended from time to time;
25.1.29“month” means a month of the Gregorian calendar;
25.1.30“NOR” means the valid notice of readiness to load or discharge, as the case may
be, as given by the master of the Vessel (or his/her representative) to the Seller
(or its representative) at the Loading Terminal or to the Buyer (or its
representative) at the Discharge Port respectively;
25.1.31 “OCIMF” means the Oil Companies International Marine Forum;
25.1.32 “Persistent Oil” means all persistent hydrocarbon mineral oils other than those
falling within the definition of “non-persistent oil”. For the purposes hereof, “nonpersistent
oil” means oil which consists of hydrocarbon fractions:
(a) at least 50% of which, by volume, distils at a temperature of 340° C, and
(b) at least 95% of which distils at a temperature of 370° C when tested by
the ASTM method D86/78 or any subsequent revision thereof;
25.1.33 “Product” means wholly or partially refined petroleum product of the grade
specified in the Special Provisions (including, where applicable, LPG);
25.1.34 “safely afloat” means that the Vessel shall at all times be water-borne in
compliance with BP Port Clearance requirements (including but not limited to
underkeel clearance) and shall be able to remain at the Berth without risk of loss
or damage from wind, weather or other craft which are being properly navigated;
25.1.35 “Special Provisions” means the contract telex or other form of agreement in
which, by reference, these General Terms and Conditions are incorporated to
form the Agreement;
25.1.36 “ton” means a metric ton or tonne;
25.1.37 “typical” means a quality or characteristic often attributable to Product from a
particular source, given without guarantee and not amounting to a representation
