CREATING OUR OWN HEADLINES
...INNOVATIVE
MEMBERS OF
THE INDUSTRY
WILL REAP THE
BENEFIT OF
CREATING THEIR
OWN HEADLINES.
Last week I had the pleasure of hosting the 2023 Hotel Symposium with over 100
members to discuss the year ahead and tackle the issues that will no doubt be shared by
many of the members across Queensland.
The key messages I received from members was that, while most had enjoyed solid
trading through the summer period, they were beginning to fear that the constant
negativity surrounding economic forecasts were slowly impacting the confidence of
patrons. In most cases, year on year figures were still good, and even improving in some
cases. This led me to suggest that now was the time for us as an industry to step forward
and showcase all the very best we have to offer.
The innovative solutions that many members have implemented to reduce food costs,
find adequate workforces and source new guests is always impressive. These are the
headlines that we need to be promoting.
While we are sure 2023 will not be a ‘bed of roses’, it certainly has a sense of returning to
normal and be the year where the innovative members of the industry will reap the benefit
of creating their own headlines. We at the QHA will continue to connect members with
each other and new suppliers or partners to keep growing your businesses. Stay tuned
this year, as QHA rolls out some solutions on energy and other costs that can hopefully
alleviate the pressures on member businesses.
Finally, I have seen the enormous number of member nominations for this year’s QHA
Awards for Excellence and they look fantastic. Keep an eye out for tickets going on sale in
May and mark your calendar for the Gala Awards night on June 19, 2023. I look forward to
seeing you there!
A SPACE TO CONNECT
THE GLOBAL TABLE TALK EVENT SERIES KICKED OFF IN BRISBANE AND THE GOLD COAST THIS YEAR AS VISIONARIES
IN THE HOSPITALITY INDUSTRY DISCUSSED CONSTRAINTS, CREATIVITY AND THRIVING IN UNCERTAIN TIMES.
QHA REVIEW | 6
Presented by Mr Yum, the Table Talk roaming event
series experienced two panels in Newstead and
Palm Beach where those passionate about the
future of hospitality connected with industry peers for
inspiration, education and innovation while enjoying
delicious food and drink.
Hosted and moderated by Dan Stock, senior
communications manager at Mr Yum, each Table
Talk event brings together three industry visionaries
to share insights, stories and discuss how to best
navigate the uncertainties of 2023.
It was a huge day on 23 January at Maggie May
supper club in Newstead, with the sold-out Brisbane
Table Talk event starring Billykart Kitchen’s Ben
O’Donoghue, Agnes’ head sommelier Lilly Heenan and
QHA’s very own CEO Bernie Hogan.
The day was full of honest, insightful and practical
panel discussion, including the management of supply
shortages, increasing staff education, menu pricing,
reducing energy bills, grants for upgrading kitchen
equipment and key trends in 2023.
When asked about the uncertainty about the year
ahead and the recent negativity of daily hospitality
headlines, Bernie said the industry actually has a really
optimistic view of 2023.
“We’ve got to look forward, and that’s why 2023
I think is actually a really positive year. Inflation will
come off, it already is. They all talk about interest rates
being terrible, but let’s be fair, they haven’t even got to
historical averages – which was about 7%.
“We’re okay. I think 2023 is a positive thing. I get
that it’s all coming off – but its February and that’s
what happens in the hospitality sector. It has always
happened, so it’s not bashing up sales too much,” he
said.
In terms of the rising cost of produce, Ben said, as
a small business owner, the best way to address the
supply shortages is to have a concise, strong menu
that’s focused on local and seasonal produce.
“We buy stuff through French suppliers… and they’ve
gone through sort of Covid supply shortages in
Europe. So there’s no produce being made, there’s no
workers to do it and that’s going through and driving
cost up.
“You just have to be flexible. So what you try to focus
on is really kind of restricting or downsizing the menu,
making it more concise and really focusing on local
Australian produce… you’ll save costs in that way,” he
said.
When discussing managing a wine list during uncertain
times and customer spending habits over Christmas,
Lilly said there is a need in the hospitality industry to
adapt to the constant flux and shift in business.
“Christmas is a great time of year. It’s the time of year
where everyone comes together and puts the money
towards small and medium sized businesses. We take
care of each other. It’s a really fantastic time because
people do spend – there is money there.
“But then we start in January and February, and we
know that it goes into a soft period. So then it’s a
reconsideration of where the money goes, how we
think about the wine list, what does it look like and
how the money goes towards the wine,” she said.
Joining in on the Gold Coast Table Talk event was
Burleigh Brewing’s CEO Peta Fielding, KickOn Group’s
strategic project manager Gerard Coakley and Costa
Taco co-founder Nick Stanley.
The Collective in Palm Beach saw discussions on the
Gold Coast food and beverage scene, staff retention
strategies, cooperation with the craft beer community,
sustainability, embracing new technology and keeping
wastage down in the kitchen.
The event series crossed over to New Zealand and
had two panels in Auckland and Wellington shortly
after the Brisbane and Gold Coast events on 7 and 9
February. Further Table Talk events are planned to take
place across the country, with no shortage of insights
and passion from the many faces of Australia’s bustling
and enthusiastic hospitality industry.

THERE’S A LOT OF CATCHING UP TO DO
ICONIC QUEENSLAND BEER POWER’S WILL FINALLY
FLOW AGAIN ACROSS THE SUNSHINE STATE, 35 YEARS
AFTER A QUEENSLAND PUBLICAN BUILT A BREWERY,
TOOK ON THE INDUSTRY AND HIT THE BIG TIME!
Two years in the planning, the new Power’s Ultra
Smooth Lager is a modern take on a true classic.
Power’s Ultra Smooth Lager is a new smooth and
crisp beer specifically brewed for warm weather,
modern tastes and with a packaging that pays tribute
to the pivotal time in Queensland’s history when
Bernard Power built the Yatala Brewery in 1988 -
and when Power’s sponsored the Broncos in their
inaugural season and beyond – and together, writing
themselves into Queensland folklore.
Carlton & United Breweries’ (CUB) Queensland State
Manager, Ian Giles, said the relaunch of the Power’s
brand marks the return of a Queensland icon that
celebrated our underdog spirit and showed the rest of
Australia there was nothing we couldn’t do.
“Power’s was so popular that it sold out on day
one and never returned to full stock, smashing all
expectations to eventually capture about 20% of the
Queensland beer market.
“People are yearning for simpler times; the pandemic
is almost over, and Queensland is well and truly open
for business. Now is the right time to relaunch the
Power’s brand so a new generation of beer lovers can
enjoy this uniquely Queensland beer,” he said.
Founder Bernard Power said it was great to see the
Power’s brand returning to prominence across the
state and has given the new brew the thumbs up.
“Making a beer that resonates with people is a
challenging thing, and I know everyone involved in this
has been very careful with what has ended up inside
and outside the bottle.
NEWS
“I am absolutely chuffed to see the Power’s
brand returning. When I sold the brewery
to CUB in 1993, we were more focused
on the future of our staff than we were on
the future of the brand. So, to see it return,
and hear what it means to people, has
been a wonderful thing,” he said.
While some Power’s has been brewed
over the past 20 years, it was available in
limited quantities, with the original Power’s
Bitter not brewed in over a decade and not
available on tap since the early 2000s.
Power’s Ultra Smooth is being brewed at
the original Yatala Brewery.
Along with its classic flavour profile, the
new Power’s Ultra Smooth has slight
bitterness, balanced by a light rounded
body, slight malt sweetness, a crisp,
smooth, clean finish and 4% ABV.
A WORLD OF PLAY
QHA REVIEW | 14
BOXED, NOT BOTTLED
The sound of empty spirit bottles being tossed
in the bin is unpleasant enough, even without
the thought of all the glass and packaging
wastage happening behind the bar every day.
Technology company ecoSPIRITS is set to fix
that however, with their new totes and refillable
bottles allowing the hospitality industry to pour
quality spirits while minimizing their operational
costs, carbon footprint and packaging waste.
The world-first idea consists of an innovative
closed-loop distribution system that eliminates
single-use bottles. According to ecoSPIRITS,
the world produces around 40 billion glass
bottles annually, which generates 22 million
tons of carbon emissions. With each bottle
eliminated, the company saves at least 550
grams of emissions.
It’s about time we stop the shattering!
HOTELS VALUE KENO RELATIONSHIP
KENO’S LATEST SURVEY HAS SHOWN HOW SUCCESSFULLY IT REENGAGED WITH ITS HOTEL PARTNERS DURING
2022, FOSTERING RELATIONSHIPS TO EMERGE STRONGER THAN EVER.
QHA REVIEW | 16
Keno’s 2022 customer survey has revealed
Queensland hotels continue to view Keno as an
important part of their business. However, there is also
opportunity to build stronger strategic relationships by
increasing hotels’ understanding of and engagement
with Keno.
The results underlined just how well Keno reestablished
strong relationships and advocacy with
its hotel partners during a year of rebuilding following
Covid.
Its Net Promoter Score (NPS) increased nine points
from +36 in November/December 2021 to +45 in
October/November 2022, returning to pre-Covid levels
and 44% of all venues see Keno as a business or
strategic partner.
Keno energetically brought back the ‘Play’ in 2022. In
particular, Keno’s dedication to building on initiatives its
partners say add value, including In-Venue Promotions
for Local Area Marketing (LAM) and the Keno Training
Platform, during the recovery period helped fortify
relationships and advocacy.
Keno also achieved high ratings of satisfaction
from Queensland venues, with 4.2 out of 5 stars.
Importantly, 89% of venues who participated stated
they trust Keno, 83% love working with Keno and 82%
believe Keno’s products and services enhance their
customers’ experiences.
The majority of Queensland venues agree Keno makes
it easy for them to operate Keno, with 85% rating it at
a benchmark effort level.
Notably, there was a big shift from passives into
promoters, evidencing how effectively Keno has
reengaged with its venue partners over the previous
year.
A key survey highlight was that venues with higher
levels of staff training and participation in LAM are
significantly more likely to be promoters and have
stronger relationships with Keno.
And while there were high ratings of satisfaction
overall, venues who ran an in-venue promotion in the
previous 12 months were significantly more satisfied,
just as they were in the 2021 survey.
“This survey tells us that on the whole, the closer
you work with us and understand our product, the
better your experience and the happier you are with
it,” reveals Paul Malek, Keno’s General Manager of
Licensed Venue Operations.
“The best message the Keno team could hope for
is hearing that the work we’ve been putting into
supporting our Queensland hotel partners, your
customers and your communities, has been fruitful.
“After the two-year Covid hiatus, we were all pleased
to be back. We are absolutely delighted that, in a
tough trading climate, we’ve come out with such a
positive response from our hotel partners, and we are
very appreciative.”
Survey participants affirmed that Keno is an important
part of their venue’s entertainment mix, with 72%
strongly agreeing customers expect Keno as part of
the venue offering.
HEADING
INTO QUEENSLAND FROM INLAND NEW SOUTH
WALES? THE QUEENSLAND HOTEL IS THE FIRST PUB YOU
WILL COME ACROSS AND A PERFECT WARM WELCOME TO
THE SUNSHINE STATE.
Also known as The QL, The Queensland Hotel is
one of the state’s oldest pubs established in 1878
– although it certainly doesn’t look it. Besides its
old and charming timber features, the 145-yearold
venue resembles a modern pub perfect for
an afternoon of darts and a cold drink in the beer
garden.
Vicki and Tony Carter are the licensees, owners
and faces of The QL. Since they took over in late
2020, the venue has received a refreshing glow
up with a focus on community, entertainment
and relaxing outdoor functional spaces. Vicki said
they take great pride running and renovating the
beautiful old pub alongside their team.
“Our hotel has it all – a fully-renovated and petfriendly
beer garden, large outdoor and indoor
dining, a great team of friendly staff, delicious
food, affordable accommodation, 20 gaming
machines and an attached bottle shop.
“Our venue is currently undergoing a complete
renovation makeover. While updating many
features we are also highlighting the beautiful
original features of the building, modernising the
classic ‘pub vibe’ and hoping to bring something
new for our patrons and community to enjoy,”
she said.
The QL has garnered a lot of attention in the
community with its newly renovated backyard –
complete with a bespoke caravan bar and beer garden
that doubles as a picturesque private function area.
This space is now known as the QL Backyard, but it
wasn’t always that way.
When Vicki and Tony first purchased the venue, the
area was nothing more than a smoking area – a few
tables, a tv and a patch of grass. Vicki said now,
functions in the beer garden, the main bar, the red
room and the pit are one of the main things that make
the hotel stand out among the rest.
“This was our number one project once we took over.
We wanted to create a space that was beautiful,
relaxing and reflected our personal styles. The
transformation was a huge one, but we now have an
inviting space where everyone wants to be.
“A majority of our functions are booked in The QL
Backyard, as it has many features including a large TV
screen, two decks, a stunning patio and grassed area
with twinkling lights, free pool and darts, a beer garden
and of course the QL Backyard Bar.
“Everyone wants their function here because we have
extensive food options and so many areas to hire our
guests are spoilt for choice. We cater for all types
of functions, large and small, onsite or offsite. Our
functions team are dedicated to creating an effortless,
perfect event for our guests and we are really proud of
that,” she said.
Situated right on the Queensland and New South
Wales border at a junction of five major highways,
the hotel finds its home in the rural community of
Goondiwindi on the Macintyre River. Vicki said the
town is full of a diverse and supportive people whose
main focus is family, farming and sports.
“It is such a pleasure to operate and own a business
in a community like this one. We enjoy supporting our
local community by being a part of local accords such
as the Goondiwindi Liquor Accord, which successfully
alongside other hoteliers allows us to create a safer
community environment within our industry.
“We also contribute to our community by sponsoring
local sporting clubs such as Goondiwindi Rugby
League Football Club, Ladies Touch Football,
Goondiwindi Golf Club and Border Tarawera Cricket
Club,” she said.
While Vicki and Tony are committed to freshening
up the venue and welcoming new patrons, they also
know their community very well. QL’s bar and lounge,
the pit, has always been a beloved live music spot for
the locals and has never been more popular after its
recent renovation.
Vicki said they would love to hire some new artists for
the pit in 2023, but new entertainment is not the only
thing on the horizon for the hotel.
“There is always something new happening here. We
are looking forward to the busy year ahead with our
renovations continuing and our new website being
launched soon.

Despite the hospitality industry having its
difficulties with staffing shortages and the
regardless of any roadblocks.
“We consider having our doors open and
STRENGTHENING WOMEN’S
ECONOMIC SECURITY
QHA REVIEW | 24
This month we are celebrating Queensland Women’s
Week (5 to 12 March 2023) and this year’s theme is
Empower her voice; Secure her future.
The theme is a celebration of women and girls who
have stood up to be heard and acknowledges the
fundamental right of every woman and girl to equally
participate and be safe in all areas of our society
including the workforce.
Access to secure jobs is essential for Queenslanders,
especially women. We know that economic security is
the cornerstone of achieving gender equality, because
a lack of economic security amplifies every other
barrier that prevents women from achieving equality.
At its most basic level, it ensures access to a stable
income, financial independence and workforce
participation which are vital protective and enabling
factors that contribute to safety, empowerment, secure
housing, and access to better health, education and
training outcomes.
I am proud that Queensland’s hotel sector includes a
strong workforce of women – more than 54 per cent of
our pubs, taverns and bars’ employees are women.
Women are making their mark in the sector, both at
the bar and behind it.
I would like to commend the QHA in helping set the
tone for a culture that acknowledges and celebrates
the skills and qualities women bring to the table.
The QHA’s long-running, annual Women in Hotels
event is a great example of the value it places on the
impressive contributions women make to the industry.
But we know there is still a long way to go. Australian
women earn about $263 less per week than men and
they retire with about 23 per cent less superannuation.
Even in industries where women are overrepresented,
women earn less than men.
That is why the overarching priority of the Queensland
Women’s Strategy 2022-27 is genuine economic
inclusion and successful economic participation for
women and girls.
The Palaszczuk Government is committed to working
with employers to support women into good, secure
jobs. This starts with changing workplace cultures,
creating equal leadership opportunities for women and
men and actively promoting flexible work arrangements
that break down traditional gender roles.
As we look to strengthen women’s economic security
and secure futures for women in the hospitality
industry, there is a range of tangible actions that can
be taken in workplaces to make a real difference,
including:
• recognising the gender pay gap and conducting
regular audits of your business to assess women’s
roles, seniority and pay parity
• understanding that change must come from
the top, and make gender equality part of core
business
• seeking out women for development and
promotion to counter the societal conditioning
that women should be in ‘second place’
• introducing and promoting the uptake of flexible
workplace policies such as paid parental leave for
everyone, including men
• calling out and acting against sex discrimination,
sexist language, sexual harassment and sexist
workplace norms, without causing further harm to
women.
More information about our commitments to achieving
economic security for Queensland women can be
found in the Queensland Women’s Strategy 2022-27.
I look forward to continuing to work with industry to
make sure women’s voices are heard and support
more women to build long term, fulfilling careers in
our hotels.

DISABILITY AWARENESS TRAINING
The Office of Liquor and Gaming Regulation (OLGR)
is committed to working with licensees to keep your
venues enjoyable, healthy and safe for everyone.
More than 4.4 million Australians live with disability.
The disability community is broad and diverse and it is
important to recognise that not all disability is visible to
others, and that people with disability have a right to
access the community on an equal basis.
OLGR is aware of several instances in which people
with disability have been mistakenly identified as being
unduly intoxicated and have been refused entry or
service at Queensland licensed venues.
Responsible service of alcohol (RSA) remains a key
responsibility for licensees and venue staff, however,
it is important to avoid general assumptions about
intoxication based solely on physical or behavioural
attributes.
OLGR’s RSA refresher training encourages venue staff
to consider people with disability when carrying out
their obligations under the Liquor Act 1992 (the Act).
If venue staff observe a physical or behavioural
indicator of potential intoxication in a patron’s
conduct, they should assess if there could be causes
other than intoxication. Having an open and
accessible conversation with a person can help ensure
you are not unlawfully discriminating against a person
with disability but also meeting your obligations under
the Act.
The best way to prepare your staff for these types
of situations is through disability awareness training.
Venue staff, especially those engaging in RSA, should
undertake additional disability awareness training
and seek out additional ways of learning about
the experiences of people with disability through
conversations and open and active listening.
The Australian Government has developed free training
on disability awareness which can be accessed online
at disabilityawareness.com.au/about. I encourage
anyone who interacts with patrons to take advantage
of these training resources.
Licensees looking to implement strategies to raise
disability awareness in their venues are encouraged to
adopt a co-design approach with people with disability.
Further advice and comment can be sought from the
Queenslanders with Disability Network, which provides
an overarching leadership and coordination role across
Queensland Government funded peak bodies.
I would like to acknowledge the QHA for their efforts
in promoting diversity and inclusion in hotels, including
through the new Disability Inclusion and Access Award
category in their annual Awards for Excellence. The
Award recognises those who go above and beyond to
ensure everyone’s experience is exceptional.
The Queensland Government will continue to advance
positive outcomes for people with disability through the
recently released Queensland Disability Plan which can
be found at qld.gov.au/qld-disability-plan. The website
includes information, resources and positive case
studies, which will be updated and added to
over time.
THE QUEENSLAND PUBLICAN WHO
BECAME A HOUSEHOLD NAME.
PROFILE
It’s the David and Goliath story that is still talked
about in reverent tones when people reminisce about
the beer industry back in the eighties. That heady
time when a publican from Queensland took on the
big boys of brewing and hit the big time!
You can just imagine the conversation back in the
day in southern headquarters when this passionate
publican by the name of Bernard Power said he
was building a brewery and making our own beer. It
would have been like that other bunch of Queensland
upstarts, the Brisbane Broncos, who made a play for
the big league and joined the Sydney rugby league
premiership prior to the launch of Power’s.
It’s no accident that the formation of Power’s Brewing
and the launch of the Brisbane Broncos are heavily
intertwined as Bernard privately provided the seed
capital to the fledgling Broncos with the belief that
“their founding chairman, Paul Morgan and his board
were men of absolute integrity and outstanding
Queenslanders with a passionate love of rugby
league”.
Power’s naturally became the Broncos main sponsor,
and both organisations shared similar DNA – they
were both set on shaking up the status quo and they
each did exactly that. Together.
Bernard has always known about the power of
pubs and pints. This old school publican has always
believed that gathering over a beer provides a
powerful touchstone for conversation, connection
and community.
He is still fiercely parochial, loves his sport and,
at 82 years young, still has that spark, drive and
legendary self-belief that his OG brewery staff say,
“could motivate a brick”. He also created a beer that
resulted in one of the most successful launches in
the world.
The Power’s story is firmly enshrined in Queensland
folklore. If you have the privilege to shoot the breeze
over a pint with Bernard, which he still enjoys, he will
downplay his role in the Power’s story and say it was
all about the people behind the scenes.
“IT IS IMPORTANT TO
UNDERSTAND THAT EACH
INDIVIDUAL TEAM MEMBER
CONTRIBUTED, WITHOUT
EXCEPTION, TO THE SUCCESS
OF THE BREWERY, AND
IS TESTAMENT TO JUST
HOW GOOD AUSTRALIANS
ARE WHEN THEY SHARE
CHALLENGES TOGETHER...
Bernard said he simply gathered the best in the
business with a shared vision to do great things.
“The secret to Power’s success was that the
planning, construction and product development
was in the hands of men and women who were and
are acknowledged in the international brewing world
as being without peer.
“It is important to understand that each individual
team member contributed, without exception, to
the success of the brewery, and is testament to
just how good Australians are when they share
challenges together,” he said.
Bernard has an intense loyalty to his team, many
of whom after all these years continue to play an
important role in this now giant state-of-the-art
brewery – the largest in Australia.
Bernard visited the Yatala Brewery recently to be
the first to see the new Power’s brew come off
the line and marvelled that the brewery continues
to “provide an outstanding example of innovation,
commitment to its employees, absolute quality
product and just being a great Australian company”.
Bernard’s encyclopaedic knowledge of the industry
and the beer barons is impressive – his memories
run deep, but they are firmly based around respect
and reverence. However, he still fires up about that
time back in the eighties that Bondy bought XXXX
and changed trading terms which would have sent
many of his contemporaries to the wall.
That’s when you witness the fire that drove Bernard
Power to take a stand and ‘BUILD OUR OWN
BREWERY AND BREW OUR OWN BEER’. The
implication of that statement may have lost power
over time, particularly as the number of breweries
in Australia continues to grow, having doubled
between 2015 and 2019 from 360 to 740, but
that’s Bernard’s legacy – not just the brew or the
brewery, but the brewers that have been able to
follow in his footsteps because of his re-writing of
the industry rule book.
Of course, the brewery is testimony to Bernard’s
vision, as he built it on a block of dirt in the middle
of nowhere – next to the long-gone Bullen’s Lions
Park, with unconfirmed rumours that one member
of staff back in the day enjoyed a few too many
brews post-shift, took a wrong turn, and had to run
for his life.
When it comes to how Bernard thinks about the
new brew, he has given it the thumbs up – which
must have seen the CUB brew team breathe a
sigh of relief behind closed doors. With Power’s
returning back to bars and clubs, he is chuffed the
big guys have brought back the brand, which is as
Queensland as it comes.
INDUSTRY ENGAGEMENT
TRIAL TO IMPROVE LIQUOR AND
GAMING APPLICATION TIMEFRAMES
Following QHA representations on the timeliness of the
application process, the Office of Liquor and Gaming
Regulation (OLGR) is trialing new measures to help
improve the efficiency of the licence transfer process.
The undermentioned new measures have been
implemented with the intention of further decreasing
the processing time for licence transfers and alleviating
industry concerns:
• where no changes are proposed to the business
model, OLGR will approve liquor licence
transfer applications and new gaming machine
applications on condition that a risk assessed
management plan (RAMP) is provided within 60
days of the licence being issued;
• the same conditions will apply with respect to
approved gaming plans. As OLGR has approved
plans on file for all approved gaming premises,
OLGR will impose a licence condition requiring the
gaming plans to be provided within 60 days of the
licence being issued;
• to avoid delays waiting on tenancy documents
(leases, title searches etc), the application form
will be amended to include a declaration that no
one other than the licensee has, or will have, a
direct or indirect interest in the conduct of gaming
should a licence be granted;
• OLGR previously required evidence of settlement
prior to approving an application. However,
as settlement occurs in approximately 60%
of applications prior to the transfer/licence
assessment process being completed, where
evidence of settlement is provided to OLGR
during the assessment process, OLGR will not
require further evidence to finalise the application.
The obligation rests with the applicant to advise
OLGR if/when circumstances change; and
• OLGR has updated its procedures to ensure
staff provide advice to an applicant of any leave
periods and who to contact in their absence.
The best way to ensure your application is processed
efficiently is to make sure you lodge a complete
application with all required supporting documents
in the first instance. The greatest cause of delay in
licence transfers is lodging an incomplete application
or not providing the information requested by OLGR.
Some of the common matters that are missed include:
• incomplete application forms, including material
required for police and creditworthiness checks;
• missing or incorrect signatures; and
• insufficient information about associates or
executive officers of the applicant.
The trial will run for six months, after which OLGR will
review the impact and effectiveness of the changes.
OLGR will also be further reviewing the Form 3 –
Application for a gaming machine licence and will be
seeking feedback from industry on how the application
forms can be improved for users.
EMPLOYMENT RELATIONS with Tana Thorpe
EMPLOYEE LEAVE ENTITLEMENTS
QHA REVIEW | 34
When an employee is absent from work, they may be
entitled to access a type of paid or unpaid leave. The
National Employment Standards (NES) within the Fair
Work Act 2009 (Act) provides employees legislated leave
entitlements. Leave entitlements are also provided by
applicable enterprise agreements or modern awards,
such as the Hospitality Industry (General) Award 2020
(HIGA). As leave is a legislated entitlement, it’s important
that employers understand the different entitlements and
their eligibility criteria. This article provides a high-level
overview of the types of leave that an employee may be
eligible to access.
Annual leave
Permanent employees are entitled to four weeks of paid
annual leave for each year of service. Some of the key
provisions include that:
• annual leave accrues progressively according to the
employee’s ordinary hours of work and carries over
from year to year (the balance doesn’t reset)
• annual leave may be taken at an agreed time between
the employee and their employer. This means, if
an employee has not sought agreement from their
employer prior to being absent from work, they don’t
have an automatic entitlement to access their annual
leave for that period
• an employer must not unreasonably refuse an annual
leave request
• an employee can only be directed to take their annual
leave in specific circumstances, as permitted by
the Act, the applicable modern award or enterprise
agreement
• employees covered by a modern award or enterprise
agreement may be entitled to 17.5% annual leave
loading, depending on their employment type
• on termination of employment, any unused annual
leave (including leave loading where applicable) must
be paid to the employee
An employee who meets the applicable definition of shift
worker is entitled to five weeks annual leave.
Personal/carers leave
Permanent employees are entitled to 10 days of paid
personal (sick) carers leave for each year of service. The
balance accrues progressively according to the employee’s
ordinary hours of work and carries over from year to year.
Permanent employees may access this entitlement:
• when they are not fit for work because of illness or
injury; or
• to provide care or support to a member of the
employee’s immediate family, or household, who
requires care or support because of illness, injury or
unexpected emergency.
The Act defines who can be a member of the employee’s
immediate family or household. Immediate family includes
the employee’s spouse or de facto partner (including
former), child, parent, grandparent, grandchild or sibling,
and a child, parent, grandparent, grandchild or sibling
of a current or former spouse or de facto partner of the
employee. A household member is any person who lives
with the employee.
Casuals do not have an entitlement to paid personal/
carers leave, however they can access two days of
unpaid carers leave per permissible occasion.
Where an employee intends to take personal/carers
leave, the employee must give notice to their employer
as soon as practicable and advise the employer of their
expected leave period. Where reasonable, employers
can direct an employee to provide evidence to support
their leave request. It must be evidence that would satisfy
a reasonable person that the employee is entitled to
the leave, such as a statutory declaration or a medical
certificate. An employee who fails to comply with the
notice or evidence requirements, will not be entitled to
access personal/carers leave for the period.
Employees have a workplace right to access personal/
carers leave. Employers should ensure that they do not
take adverse action against an employee as a result
of them accessing this leave. The QHA’s Employment
Relations (ER) team can provide tailored advice to
members where an employee is accessing personal/
carers leave for regular or prolonged periods.
Compassionate leave
An employee is entitled to two days compassionate leave
for each permissible occasion, which includes:
• to spend time with a member of the employee’s
immediate family or household who has contracted or
developed an illness or injury that poses serious threat
to their life;
• where a member of their immediate family or
household dies;
• where a baby in their immediate family or household
is stillborn;
• where the employee has a miscarriage, or their current
spouse or de facto partner has a miscarriage.
For permanent employees, the leave is paid at the
employee’s base rate of pay for their ordinary hours of
work in the period. For casual employees, compassionate
leave is an unpaid entitlement.
Where an employee intends to take compassionate leave,
the employee must give notice to their employer as soon
as practicable and advise the employer of their expected
leave period. Where reasonable, an employer can direct
an employee to provide evidence to support their leave
request (a death or funeral notice or statutory declaration).
Tana Thorpe EMPLOYMENT RELATIONS
Long Service Leave
Long Service Leave (LSL) is a form of paid leave available
to all employees, including casuals. In Queensland, LSL
entitlements are provided by the Industrial Relations Act
2016 (IR Act). Upon 10 years of continuous service, an
employee is entitled to 8.6667 weeks of paid LSL leave,
and there are further entitlements after 10 years. Employees
with between 7 and 10 years’ continuous service will
be entitled to a proportionate payment of LSL if their
employment ends for one of the reasons prescribed in the
IR Act, which include where:
• the employee’s service is terminated by their death;
• the employee terminates their service because of
their illness, incapacity or because of a domestic or
pressing necessity;
• the employer dismisses the employee because of the
employees illness;
• the employer dismisses the employee for a reason other
than the employee’s conduct, capacity or performance
(such as termination as a result of redundancy); or
• the employer unfairly dismisses the employee.
Employers should be aware that not all types of unpaid
leave count towards continuous service. To assist QHA
members, the QHA’s ER team can complete three LSL
calculations per member per calendar year at no cost.
Parental leave
An employee with 12 months continuous service, will be
eligible to take unpaid parental leave where:
• the employee gives birth or adopts a child under 16
years of age; or
• their spouse or de facto partner gives birth; and
• the employee will have responsibility for the care of the
child.
To be eligible for unpaid parental leave, a casual must have
12 months of regular and systemic continuous service
and a reasonable expectation of continuing regular and
systematic work. Eligible permanent and casual employees
may access up to 12 months unpaid parental leave, and
may request to extend the period for a further 12 months.
When resuming work, an employee is entitled to return to
their pre-parental leave position and can make a flexible
work request to reduce or change their hours of work. In
addition to unpaid parental leave, an employee may apply
to Services Australia for parental leave pay.
There are additional leave types that an employee may be
eligible to access, such as:
• unpaid pre-adoption leave;
• unpaid special maternity leave – where an employee
is not fit for work due to a pregnancy-related illness or
due to their pregnancy ending;
• no safe job leave – where an employee cannot work
their position, and another safe job is not available.
The NES details notice, evidence and eligibility
requirements for employees to access parental leave and
associated leave types. QHA members who have queries
about parental leave requirements are encouraged to
contact the QHA’s ER team.
Family and domestic violence leave
Effective 1 February 2023 (delayed until 1 August 2023
for small business employers), all employees can access
up to ten days paid family and domestic violence leave
each 12-month period. Prior to this, family and domestic
violence leave was an unpaid entitlement of five days.
An employee can access the paid leave to deal with
the impact of the family and domestic violence, where
it is impractical for the employee to do so outside of
the employee’s ordinary hours of work. Actions that
could covered by this leave include attending medical,
legal, police or counselling appointments, attending
legal proceedings, accessing police services and
organising alternative accommodation, care or education
arrangements for children.
Employers are legally required to ensure that the following is
not recorded on an employee’s payslip:
• that an amount paid to an employee is a payment for
paid family and domestic violence leave;
• a period of leave taken by an employee has been
taken as paid family and domestic violence leave;
• an employee’s paid family and domestic violence leave
balance.
The QHA has more information available for members on
the introduction of this paid leave type and the specific
rules that apply.
Community service leave
The NES provides that an employee engaged in an eligible
community service activity is entitled to be absent from
work. The NES specifies an eligible community service
activity includes jury service and voluntary emergency
management activities. Where QHA members have an
employee who may be eligible for such leave, the QHA’s
ER team can provide specific advice about eligibility
criteria, paid or unpaid entitlement and notice and
evidence requirements.
Further assistance
The QHA has template employment contracts and
policies, which detail employee’s leave entitlements,
available for purchase as part of the QHA’s HR Manual.
This article provides a high-level overview of the different
leave types. QHA members seeking further assistance or
wishing to discuss a specific employment relations matter
are encouraged to contact the ER team for a confidential
discussion. Call 07 3221 6999 or email er@qha.org.au.
TRAINING AND SAFETY RTO 30826
with Therese Kelly
THE TEAM, WHAT WE DO AND WHAT WE OFFER.
QHA REVIEW | 36
As most of you would know, I joined the QHA in April
2022. I was the newest addition to the QHA family with
my appointment as the training manager. The last 11
months have seen some changes to our training team,
so I thought I would take this opportunity to introduce
you to our new members, the change to some roles
within the team and a brief overview of what we do.
Pam Hague
Pam joined us in mid-November as a trainer and
assessor. Her main role is delivery of both face-toface
and live online learning across Responsible
Management of Licenced Venues (RMLV), Customer
Liaison Officer (CLO) and Gaming Nominee Training
(GNT). Pam is an experienced and professional
trainer with a demonstrated history of working in the
Hospitality Industry and Vocational Education and
Training (VET) sector. Skilled in coaching, hospitality,
training, assessment, team building, training delivery
and management, she is a strong education
professional and a former flight attendant with strong
communication and customer service experience.
Becky Davidson
Becky joined QHA in December and has taken on
the role of training administration assistant. Becky is
responsible for taking bookings, printing certificates,
assisting the trainers with preparing learning materials
needed for training and dealing with general enquiries.
Becky’s role will develop as her knowledge of the
Registered Training Organisation (RTO) world grows.
Becky moved here from across the ditch to play rugby
in Brisbane. After playing for the mighty Tasman Makos
in New Zealand she was excited to get involved with
Queensland rugby. She completed studies at Lincoln
University with a bachelor’s in Sports and Recreation
Management and had been working in sports
administration. She’s very excited to be involved in
something new with the hospitality industry and get to
know our wonderful members.
Change in role: Susan Sykes
Many of you would be familiar with Susan as another
strong and experienced trainer. Sue has been with
QHA for nearly two years and for most of that time
held the position of training coordinator. She is also
a hospitality trainer with an Advanced Diploma of
Hospitality Business Management.
In September, Sue took on the role of trainer/assessor
and compliance officer. There’s a lot of compliance
involved with delivering accredited and non-accredited
training. Not only is Sue a great trainer, but her
knowledge of the RTO world is fantastic. This, along
with her passion for training, made this a natural
position for her to fill.
What we do
QHA is a RTO (RTO#30826) and delivers industryoriented
training to members and non-members.
QHA Training have a number of accredited and nonaccredited
training as well as government funded
courses available. These include:
Non-accredited courses
• Responsible Management of Licensed Venues
(RMLV) training
• Gaming Nominee Training (GNT)
• Customer Liaison Officer (CLO)
• developing hotel management skills
• hospitality first steps (introduction to hospitality)
• employment relations training program
Accredited Courses
• SITHFAB021 Provide Responsible Service of
Alcohol (RSA)
• SITHGAM022 Provide Responsible Service of
Gambling (RSG)
QHA also has our Hospitality First Steps program
running this year. This program includes five days
of all-inclusive training. The training is focused on
helping participants get all of the essentials skills
and certifications to work a variety of roles within
the hospitality industry. This project is funded by
the Queensland Government through its Growing
Workforce Participation Fund. The QHA’s Training team
offers a range of training sessions, covering current
work health and safety information, obligations and
advice. Training can be provided online, in-house or in
various locations across Queensland.
ACCOMMODATION UPDATE
with Judy Hill
WHAT’S AHEAD IN 2023?
WELCOME TO 2023, THE YEAR OF THE RABBIT – A SYMBOL OF LONGEVITY, PEACE AND PROSPERITY AND THE
YEAR OF ACCESSIBLE TOURISM.
QHA REVIEW | 38
The outlook from the recent Colliers’ report on the
accommodation supply in Australia’s ten major
markets demonstrates they have continued to expand
with the opening of around 3,420 rooms in 2022,
representing a moderation from 2021.
2023 now presents as the peak of the hotel
development cycle. Growth in hotels is being offset
by a reduction in Short Term Rental Accommodation
(STRA) with a 15% reduction in active rentals over the
past year across all markets. This trend is helping to
alleviate any potential impairment from increased hotel
supply and is a positive outcome for hoteliers.
Sustainability considerations are also starting to make
an impact. New government policy has the potential to
further delay construction commencement as owners
and operators tackle purposeful change and focus on
sustainable initiatives.
Chinese tourists, a very sought-after market by all
competitors and one that moves quickly and to scale,
are now able to travel again from last month with
spending by international visitors predicted to surpass
its pre-pandemic levels towards the end of this year
or by early 2024. Spending in 2019 was just shy of
$45 billion and is predicted to rise to almost $49 billion
by 2027 according to Tourism Australia. Given more
than 1.43 million Chinese tourists visited Australia in
2019 and spent $12.4 billion, the ability of Chinese
citizens to go abroad again is something the Australian
tourism industry has been waiting for – even with the
fraught issue of Chinese travellers requiring a negative
Covid-19 test result to enter Australia.
It’s good news for Australian tour operators who have
felt the loss of their biggest foreign source market.
From January to October last year, the first year of
relatively easy travel in and out of Australia since
March 2020, international visitors recovered to more
than 34 per cent, while Australians travelling overseas
recovered to 43 per cent according to Tourism
Research Australia data. That meant about 3.2 million
foreign tourists arrived in Australia, versus more than
Judy Hill
ACCOMMODATION UPDATE
4.3 million Australians heading overseas on shortterm
trips. It might still be a far cry from 2019 when
9.4 million incoming tourists (led by Chinese travellers)
virtually made up for more than 10 million outgoing
Australians.
Deloitte’s Australian tourism sector leader Adele
Labine-Romain hails the inbound figures as a ‘pretty
impressive achievement after almost two years of
closed borders’. This was especially so given Australia
is an expensive long-haul destination for most foreign
tourists – especially those flying from the northern
hemisphere. Australians are among the most frequent
travellers to be found anywhere, and our wanderlust
continues, despite economic headwinds. It’s evident
we plan to keep spending on leisure travel according
to the Deloitte Global State of the Consumer Tracker
as of last October.
“Inflation and the cost of everyday purchases is topof-mind
according to their data, but the intention to
spend on travel is staying firm, and that is across
all travel expenditure price points. We are not easily
dissuaded from our plans to travel,” said Ms
Labin-Romain.
The Accommodation Division meetings for 2023 have
now been set with the first meeting on Tuesday 21
February for the Brisbane General Managers and
Thursday 23 February for the Gold Coast General
Managers. Kurt Thomas, Director Hotels Colliers
will be the presenter at both meetings. Given the
beginning of a new year and 2022 was record
breaking in terms of RevPar led by ADR, it’s ideal to
have a presenter who could talk to this context and
demand factors that may need to be considered in
2023 to continue the drive forward for RevPar.
This year the annual Hotel Market & Economic Outlook
event will take on a somewhat different and shorter
style. It will be a breakfast event with an update
from STR, an economist, an update on the Tourism
Accommodation Australia (TAA) /Accommodation
Australia (AA) amalgamation and two additional
presenters pertinent to the accommodation sector
who will provide insights for the purposes of forecasts
and budgets. These events will be delivered in
Brisbane on Tuesday 18 April, the Gold Coast on
Thursday 20 April and FNQ on Tuesday 15 August.
Another addition in this year’s schedule is the holding
of a boardroom lunch in Brisbane Tuesday 13 June
and the Gold Coast Thursday 22 June with both
events including a keynote presenter. Other than
these, additional bimonthly meetings will continue
in Brisbane, Gold Coast and Far North Queensland
together with two meetings planned this year on the
Sunshine Coast.
Thank you to those who have renewed their 2023
membership. An increase in membership levies is
never ideal as we see to minimise costs to members.
However, in order to sustain our Association and
continue to advocate for the industry at a high level
there was a necessary increase in 2023 renewals.
Whilst as a membership organisation we understand
any increase is never ideal as we wish to always
minimise costs to members our stated goal is to keep
representing and advocating for members at a high
level not just this year but well into the future.
Finally at the time of this article the amalgamation
of TAA with AA is on track to take place on 1 July
2023. This amalgamation will result in the QHA’s
Accommodation Division doubling not only in
membership numbers but also with an end result of
27,500 accommodation rooms.
LIFE IN THE CENTRAL LANE
FROM NIGHTCLUB TO QUEENSLAND’S ONLY PUB EXPERIENCE WITH A TEN-PIN
BOWLING ALLEY, CENTRAL LANE HOTEL PROVES THAT MAYBE THE KEY TO A
THRIVING VENUE IS JUST THINKING A LITTLE OUTSIDE THE BOX.
QHA REVIEW | 41
INSIGHTS
Months down the track of an instrumental
renovation, Central Lane Hotel has grown into its
freshly planted greenery and has since made a
name for itself in the hospitality industry by winning
Regional Hotel of the Year and other awards at the
2022 QHA Awards for Excellence.
The Gladstone hotel’s incredible success and
reputation as a welcoming pub for all can be
attributed to a single decision made by the owner
of Central Lane Hotel, Rick Adams, five years ago.
During renovations in 2020, Rick said he decided
to eliminate the hotel’s strip club upstairs in favour
for more unique, vibrant and accessible pub
experiences.
“We received the pub in 2012 when it was called the
Port Curtis Hotel. We did a name change in addition
to a bit of renovation. Other than that we traded it as
it was for those first five years until 2017.
“It was then that I really started to work on a big
change. I wasn’t sure what I wanted to do, I just
knew that I couldn’t keep trading it as it was, as
I didn’t think there was longevity in the current
business model.
“So that’s when I started to look around and where
the idea for a bowling lanes came from,” he said.
With a full-blown bowling alley and karaoke room,
Central Lane Hotel is definitely not your typical pub
location.
QHA REVIEW | 42
INSIGHTS
While still a hotel with gaming machines, TAB, live sports and a
smart yet casual bar and bistro, the venue also commits to a perfect
balance of fun and relaxation for all ages and personalities. Rick said
at the start, a lot of people disagreed with his decision and asked
why he would surrender the strip club licence and replace it with
lanes and bowling balls.
“The reality of it is, I didn’t see a long-term future in it. So we’ve got a
different model, and I think it’s more sustainable. We’ve got so much
repeat business now, which anyone in hospitality knows is the key,
so we are over the moon about that.
“Now that we also accommodate young patrons and their families
with the bowling lanes, we find people waiting at the door before
traditional opening hours and we are near capacity by 10:30am.
“We had a function the other day for a local accounting firm’s 10-
year anniversary. They invited over 100 people and to celebrate they
did a little bowling tournament. We opened upstairs and provided
food, beverages and prizes. It was very cool and exactly what
Central Lane is all about,” he said.
Rick’s decision led to a major renovation for Central Lane Hotel
which started in October 2020. Constructed by ICM and designed
by BSPN, the renovation improved the overall layout and atmosphere
of the pub – making it the stylish venue it is today and propelling it
into winning the Statewide Best Redeveloped Hotel award at the
2022 QHA Awards for Excellence.
Rick’s personal touches for Central Lane Hotel also included a
Banksy-inspired art piece on the side of the venue and a giant sign
of Castlemaine XXXX’s mascot, Mr Fourex, on the roof of the pub.
Rick said after Covid, they were on a tight budget, but BSPN worked
with them, and as a result they had a nice collaboration.
“The venue really needed a renovation. For example we had the
kitchen upstairs, so every bit of food we cooked we had to be sent
down in a dumbwaiter in a space that only allowed for eight plates.
The insufficiencies of that were enormous – especially when we had
tables of 20.
“So we moved the kitchen downstairs, and now we use the
dumbwaiter to send function food up, which is a lot easier. The
renovation also allowed us to remove external walls, create
a car park and so
much more.
“Former ICM builder
Michael Caughley,
who now works at
Caughley and Co, just
went over and above
as well. He was always
pointing out how things
could be improved, and
he never went home
until the job was done.
He did exceptionally
well,” he said.
With a renovated bar and bistro also came a revitalised
menu, which had garnered a good enough reputation
in the community that Central Lane Hotel took out the
Regional Best Bistro award at the 2022 QHA Awards
for Excellence.
Rick said their food and venue has been well
embraced by the community with eclectic bunches of
people coming through the hotel doors every day.
“We’ve really been building our food business, to the
point where we now have a few signature dishes that
have become very well known within the community.
It’s just simply good food.
“The general feeling when we won those awards was
great – it just blew our minds. It was quite a good year
for us really and a treat to be recognised in that way.
All of the positive feedback is very rewarding.
“We often get really nice praise for our staff. I am big
on staff culture by design. We are a modern venue, but
we really work on those traditional hospitality values,
and that resonates through all of the staff,” he said.
It’s clear that Central Lane Hotel has come a long way
from its beginnings as a late-night venue.
Rick said the venue was made to be a place that
is welcoming to anyone from the entire community
– from nine-year-olds having birthday parties, to a
group of mates having a catch-up with some beers to
grandparents bowling with their grandchildren.
“We are creating a safe pathway for younger patrons
where they are comfortable coming to our venue
because they’ve already been visiting for years.
“Overall, we just thought outside the box. We have a
very up-to-date gaming room and that is a big part of
any modern-day pub, and we have good, traditional
service values,” he said.
Over years of thoughtful decision making, planning
and curating, the pub has managed to handcraft a
welcoming atmosphere for all – complete with their
signature food and drink, amazing service and of
course who could forget the bowling.
“It’s kind of neat, being able to welcome everyone
including the next generation of pub-goers. I think
that’s where we have really set ourselves apart. That’s
what makes us stand out in the industry and that’s
why we are more than just a pub,” Rick said.
SUPERANNUATION
HOSTPLUS WINS FUND OF THE YEAR
Hostplus was proud to be named SuperRatings’ Fund
of the Year for 2023.
SuperRatings is a provider of ratings, research and
consulting for the superannuation industry. They
judge the Fund of the Year award across three key
categories: investment performance, competitive fees
and ongoing focus on member services.
Our long-term investment philosophy, member-first
ethos, innovative product development and the skill
and dedication of our team all helped contribute to this
incredible win.
It was fantastic recognition of our commitment to
improving your staff’s retirement outcomes.
Further recognition from SuperRatings
We were also thrilled to receive the SuperRatings Net
Benefit Award. The net benefit is the investment return
you receive on your savings after all fees and costs
have been taken out.
This award recognises Hostplus as the fund with the
best net benefit outcomes delivered to members over
the short and long term.
In addition, we received the MyChoice Super of the
Year award. This was in acknowledgment of our best
value for money offering for engaged members.
To cap it all off, we also achieved SuperRatings 20
Year Platinum Performance Rating. That’s thanks to
the consistent long-term performance delivered to our
members over 20 years.
Less than 4% of funds have held a platinum rating for
20 years. We’re incredibly proud to have reached this
impressive milestone.
Another year of positive achievements
for Hostplus
The awards capped off another incredible year
for Hostplus.
Our merger with Statewide Super saw an additional
140,000 members, 24,000 employers and $11 billion
transferred into Hostplus. The merger has confirmed
our position as a truly national and multi-sector
industry fund.
We also made a formal commitment to transition
our investment portfolio to net zero emissions by
2050. This move puts Hostplus in line with Australia’s
commitment to the Paris Agreement. We’re aiming to
help protect members’ retirement savings as the world
adapts to a lower-carbon future.
Across the year, we also introduced three new
investment options, improved our Member Online
platform and launched a retirement projection
calculator. You can find out more about these
achievements on our website.
Supporting the industry in 2023
With 2023 just beginning, we’ll continue to support
your business and staff with the high standard of
service you expect from us.
Later this year, we’re working towards a merger
with Maritime Super. This will extend our existing
partnership with the fund, and see our size and scale
LEGAL MATTERS
HOTEL FINANCING 101:
REGISTERING AND RELEASING SECURITIES
There are many ways in which a business owner may
be able to finance the acquisition or refurbishment of
their hotel business. When funds are borrowed, it is
common for the lender to require security, or several
forms of security, to secure the debt against the
borrower. This security may be over the borrower’s
personal assets, business assets, real property or
a combination of these. In this article, we discuss
the most common forms of security which may be
required from hotel owners when obtaining a loan.
Mortgage
A lender may require a mortgage against the borrower
to be recorded with the Queensland Titles Registry
over the business premises until the debt has been
paid in full, where the borrower owns the land. Whilst
the borrower will still be the legal owner of the land,
it is subject to the terms of the mortgage which has
been granted to the lender.
A mortgage will usually include terms that prohibit
the borrower from leasing, sub-dividing or otherwise
changing the use of the land without first obtaining the
lender’s consent. Where a borrower defaults in their
repayments of the debt, under the mortgage the lender
will have the right to take possession of the land and
sell it to recover the outstanding balance of the debt.
Where the hotel premises is leased from a third party,
the lender may require a mortgage over the
registered lease of the hotel premises which would
generally be accompanied by a side deed (or right of
entry agreement). Where the business owner defaults
in their repayments, the mortgage and the deed
(which creates a contractual relationship between
the lender and the landowner), will allow the lender to
enter into possession of the business premises and
deal with the business in accordance with the terms of
the mortgage.
Personal guarantee
Personal guarantees are commonly requested from
directors and shareholders of a company borrowing
money. This form of security allows a lender to pierce
the corporate veil and requires the guarantor to
personally guarantee the payment of debt and other
obligations of the borrower. Where the borrower
defaults in repayments, the lender may call upon the
personal guarantee which requires the guarantor to
remedy such default.
A personal guarantee may be limited to a certain
amount of money or duration. It is important to fully
understand the extent of any personal guarantee, in
particular whether the personal guarantee includes a
‘charging clause’. This ‘charging clause’ usually grants
the lender the right to secure their interest against the
personal assets of the guarantor, including over real
property owned by the guarantor in their name. The
guarantor must also carefully review and receive legal
advice on any guarantee documents accordingly.
Registered security
The lender may also decide to register their security
against the borrower on the Personal Properties
Securities Register (PPSR) if the terms of the loan
provide for this. Depending on the purpose of the loan,
the security interest may be registered against specific
assets of a business or over all assets of a business
(which is commonly the case where a major bank is a
financier for the acquisition of hotel businesses).
By registering their interest, the lender has assured
priority for payment over unsecured creditors of the
borrower in the event the borrower is unable to pay its
debts and is wound up.
Release of securities for sale
In the event of a sale, it is a requirement that the hotel
business (and the land, where applicable) is transferred
to a purchaser unencumbered. If a business has
borrowed money and granted any of the above forms
of security to a lender, it must be able to provide
evidence that releases the security in so far as it relates
to the business and the assets being sold.
In hotel and pub transactions, this will often require
pre-emptive communication with secured lenders to
ensure that the lender releases their secured interest in
time for settlement in so far as it relates to the business
and assets being sold.
If you are considering selling your hotel business and
require assistance on steps to finalise any secured
interests, please contact me.
CITIES LIKE PORTLAND, SAN DIEGO
AND VANCOUVER HAVE BEEN
CREDITED WITH BEING INSTRUMENTAL
IN ELEVATING THE INDEPENDENT
CRAFT BEER MOVEMENT INTO THE
STRATOSPHERE AND THE PRESENT-
DAY POPULARITY THEY ENJOY. TODAY
VANCOUVER IN PARTICULAR, IS
HOME TO SOME 40 MICROBREWERIES
ALONG WITH A NUMBER OF
BREWPUBS AND LOCAL WATERING
HOLES WHO SPECIALISE IN THE BEST
OF THE BEST AMBER NECTAR.
Vancouver, a city surrounded by mountains and sea that provides
awe-inspiring vistas on the grandest scale. It also happens to
be a bustling hotbed of hop-fused alchemy and that’s what had
me doubly excited about visiting Canada’s coastal gem. I must
confess though, “excited” is probably a gross understatement,
“jumping out of my skin” is a more fitting description. I couldn’t
wait to traipse around the city, talking in all its beauty before
finishing the day with some delectable, knock-your-socks-off
IPAs. It was almost too good to imagine. Aside from the famed
Granville Island precinct, which I will talk about in another edition,
the area I was most keen to check out was Gastown in
downtown Vancouver.
Gastown is the original settlement that became the core of the city
of Vancouver. Its name funnily enough originates from a publican.
How many can lay stake to such a claim? As legend has it,
“Gassy” Jack Deighton, a Yorkshire seaman, steamboat captain
and bartender arrived in 1867 to open the area’s first saloon. He
was famous for talking a lot (“or gassing”) and so his saloon soon
became known as Gassy’s town. The name evolved into Gastown
and the area is now regarded as Vancouver’s first neighbourhood.
Gastown quickly became a general centre of trade and
commerce thanks to it being the site of the seaport and the
Hastings Mill sawmill.
There was no shortage of loggers, fishermen and shipping crew
keen to patronise the saloons and local shops. However, in the
60s, the area was earmarked to be demolished to make way
for a major freeway into the city’s downtown. Citizens became
concerned with preserving Gastown's distinctive and historic
architecture. A campaign led by local businesspeople and
property owners thankfully put an end to its destruction and
Gastown lived on.
Today Gastown is a mix of hip contemporary fashion and interior
furnishing boutiques, restaurants, brewpubs, bars, internet
businesses and professional offices, along with art galleries,
music and art studios, film and acting schools. Its heritage listed
buildings and cobblestone streets add to its eclectic appeal.
Its most famous, though nowhere near its oldest landmark is the
steam-powered clock on the corner of Cambie and Water Street.
It was built in 1977 to cover a steam grate, part of Vancouver's
distributed steamheating system. It was a way to harness the
steam and to prevent street people from sleeping on the spot in
cold weather. Apparently the original design was faulty though
and it had to be powered by electricity after a breakdown. The
steam mechanism was then completely restored with the financial
support of local businesses (as it had become a major tourist
attraction) and is now promoted as a heritage feature although it is
of modern invention.
Anyhow, back to those microbreweries and watering holes
specialising in local craft beers. The three I was most keen to
visit were renowned for their beers, unique décor and ambience.
Neither of them failed to disappoint.
QHA REVIEW | 50
Sprawling two floors with 20 rotating taps pouring
fresh steam beer from copper fermenters, this place
is the stuff of dreams for lovers of equisitly crafted
brews. An iconic part of the craft beer community for
more than 25, Steamworks have a myriad of brews
to wet your whistle from traditional styles like Pilsner,
Lager and Pale Ale through to their multi awardwinning
Flagship IPA that I was hankering after - rest
assured, it sent my tastebuds on a heavenly journey
I will not forget anytime soon. Perfectly paired classic
modern day pub fare and three distinct dining areas
sees the venue cater for all tastes and all kinds of
patrons, whether it be couples, business meetings or
large groups.
Adding to the appeal is undeniably the steampunk
décor. It’s not only super cool it is fitting considering
the brewpubs origins. The original steam piping in
the building was found by accident but soon became
the inspiration for their unique proprietary steam
brewing method that has helped the company garner
numerous industry accolades.
The beer, the food, the service and the view over
Vancouver harbour... all receive a huge thumbs up
from me.

THE
LAMPLIGHTER
PUBLIC
HOUSE
Given the name I was initially confused whether
it was a pub or a housing commission building
but this was soon rectified when I entered the
premises, and a super friendly waitress promptly
took our order. You have to hand it to the
Canadians, their service manner and friendly
nature are exemplary.
The Lamplighter is located on the ground
floor of the storied Dominion Hotel (est. 1899).
This beautiful historic brick-lined building is a
Vancouver pub institution famed for its local craft
beer focus paired with handsome cocktails and
a humble yet modern food menu. It’s lively, easygoing
and welcoming and just my scene. What’s
most interesting however is the structural change
the pub underwent as a result of the recent
pandemic.
The Donnelly Group which started 23 years after
its launch in 1999 with a single pub is now a
national business which includes cannabis stores
and a brewery, barber shops, public houses
(of which the Lamplighter is one), nightlife, and
events all under one umbrella.
The company did more than survive the
pandemic, they used the lessons learned over the
past two years and funnelled them into building
new foundations intended to carry it forward
through another 23 years.
The re-founding came with the launch of
Freehouse Collective, a new name to house the
hospitality businesses. The identity is explained as
fusing two ideas together being: the “Free House”
as a nod to pub history when publicans staked
independence from brewery influence, freeing
them to focus on personalised guest experiences,
and “Collective”, to reflect the diverse and
independent hospitality brands.
More than simply a change of name, it is
philosophy that now guides and inspires the
people within the business who are the backbone
of the company as they spark new concepts and
create indelible guest experiences. Company sayings
such as “good hospitality is seen. Great hospitality is
felt”, “we serve people for a living. It’s our passion”
and "be true to yourself and your neighborhood, the
people will follow", are clearly more than just that,
their staff have clearly bought in are living this ethos
and it shows.
Equally impressive is their social responsibility
arm, the Donnelly Fund. It takes this ideal to the
communities in which they do business as a social
enterprise which empowers their people to foster
a culture of giving. This value is the belief that
philanthropy, like hospitality, is about enriching
people’s lives through service and compassion and
so it is over the past 20 years the Donnelly Fund has
worked in the neighbourhoods and communities
where the group does business.
SIX ACRES
Six Acres is a stunning venue with exceptional
service. Quaint, cozy, rustic, warm and inviting, there’s
many superlatives to label this pub with but it is the
exceptional food and drink, which elevates it to another
level. Upon entering you soon understand how Six
Acres has become incredibly popular with locals and
tourists alike. This gastropub doesn’t overcomplicate
its offering, it simply does what it does exceptionally
well. Located in the heart of Gastown right beside the
statue of “Gassy” Jack, it is a must visit when venturing
to Vancouver.
QHA REVIEW | 54
Sweet and sour and oh
so refreshing and tasty.
An imperial strength
sour that is beautifully
complemented by the
mango. My love for sours
keeps growing thanks to
the likes of brews such
as this.
The Farmhouse Ale
is a Saison, which
is essentially a well
carbonated pale ale, and
this one is absolutely,
mind-blowing sensational.
Citrus and floral aroma,
and a taste of white
grapes with hints of
banana and lemon.
Super dry, it is brewed
traditionally with an
unrestrained fermentation
in open top fermenters.
There’s one thing for sure,
what they have created is
a masterpiece.
Lush and creamy with
tastes of pineapple,
coconut and citrus,
this is one ripper of a
DDH Oat Cream Double
IPA. Lower-than-typical
carbonation adds to the
syrupy nature of this
delicious concoction
that is somehow smooth
and tangy all in one. I’ve
always enjoyed a round
of golf but if this classifies
as such I will play every
single weekend no matter
the weather.
A light, easy drinking,
extremely sessionable
IPA with a not-too-heavy
ABV that has a distinct
passionfruit aroma and a
bright fresh-hop flavour.
This version of their Pale
India Ale features Mosaic
as the aroma hop.

than a passionfruit IPA?
I think not and this one
is lush and juicy with
the passionfruit flavour
to the fore and a nice
hint of bitterness. It is
incredibly sessionable and
quite simply a standout.
These guys never fail to
disappoint, not once.
With a name like that it
was so enticing, and it
did not fail to live up yo
expectations. The aroma
is dank and pungent with
wafts of passionfruit.
The mouthfeel and taste
is like combining a pina
colada with a super
strong IPA that’s bursting
at the seams with fresh
pineapple, mango and
passionfruit. This one is
super special. Wow.
Created from small
parcels of premium
Shiraz grapes this is a
supremely elegant, silky
smooth, cool climate
shiraz. The wine delivers
an outstanding depth of
flavour that is bursting
with rich fruits such as
blueberry and mulberry
and supported by
complexing flavours of
sandalwood and spice. It
could have done with a
decade in the cellar but
was too tempting not to
try right away.
This can is like a nostalgic
flavour bomb in your
mouth with a touch of
triple distilled vodka made
from pure alpine spring
water. Although the can
said Peaches & Cream
it definitely brought back
memories of the old-style
creaming soda. Not too
sweet and perfect for
sipping with ice. In short,
it’s delicious.
WINE
XANADU MARGARET RIVER VINEYARD
Xanadu was established by an Irishman who arrived
in Margaret River in 1968 with his wife Eithne and was
inspired by the pioneering spirit of the region. In 1977
Dr John Lagan planted the first of many vines and the
potential of this Margaret River plot was only just being
realised.
A state-of-the-art restaurant and cellar door was
constructed in the early 2000s with extensive use of
local granite and gneissic rock excavated during the
planting of the original vineyard.
From 2005 under the new ownership and clear
direction of the Rathbone wine group, it was at this
time that winemaker Glenn Goodall stepped into the
role of Senior Winemaker after having been with the
team since 1999.
Glenn was to focus on quality and embrace the
distinct characteristics of the Margaret River region
and gently guide the wine from vine to bottle instead
of beating it into submission. With multiple national
awards to his credit – he’s not only doing a great job,
but building a fantastic brand.
End of vintage is a great time to connect with other
wine producers in the region and swap notes whilst
sampling the product of their toils. The Inter winery
ping pong challenge was just one of these occasions.
Let`s just say Glenn was one to watch for future
events. Great right hand smash, probably from all that
cap plunging and stirring of lees!
TASTING NOTES
Paul St John-Wood PUB TALK
XANADU VINEWORK
2020 Cabernet Sauvignon
Deep crimson with a nose of
blackcurrant and mulberries,
entwined with hints of mocha,
black olive and bay leaf. The
generous palate offers a core
of inky berry fruits, cassis
and blood plums. Builds up
to a chocolaty firm finish with
some tobacco leaf notes
delivered on supple tannins.
Perfectly approachable
in its youth, this wine will
comfortably cellar for several
years. 10+
XANADU VINEWORK
2020 Sauvignon Blanc
Semillon
Passionfruit, crunchy melon
and gooseberry – they’re all in
there creating quite an aroma.
The palate is zingy and crisp,
lemon thyme, guava, kaffir
lime and a little spice. The
influence of wild fermentation
in barrel has added complexity
and weight to this otherwise
quintessentially crisp, fruit
driven blend. Great consumed
in its youth, but with careful
cellaring will gather complexity.
XANADU VINEWORK
2020 Chardonnay
This elegant yet powerful
Chardonnay has aromas of fresh
pears, nectarine, and citrus fruits
with underlying hints of jasmine,
oyster shell and oatmeal. The
elegant palate is medium bodied,
displaying white peach and
tangy grapefruit, complimented
by a layer of texture derived
from lees stirring whilst in
barrel. The vibrant fruit and
crisp acid backbone combine
to focus the wine perfectly
to a lingering fruit finish. An
exceptional wine at this price
point.
