to Differ, in last week’s <strong>Courier</strong>,<br />
missesthemain pointsraised by<br />
the dismissal of ateacher for<br />
refusing to use apupil's preferred<br />
pronoun (‘he', as the girl in<br />
question wasunderthe<br />
impressionthat sheisaboy).<br />
Ateachermust abidebythe<br />
rules of conduct dictatedby<br />
ministerialand professional<br />
bodies. The Teaching Council of<br />
Aotearoa NewZealand has<br />
written into its code of ethics for<br />
teachers that they mustrefer to<br />
pupilsbypronounsassociated<br />
with their selfnominated gender.<br />
NewZealandlaw recognises the<br />
right of a16yearold to nominate<br />
his/her gender (no, Iwon't use the<br />
plural ‘they' when it is<br />
grammatically inappropriate)<br />
given parental consent.<br />
Butthe overwhelming majority<br />
of school studentsinNewZealand<br />
are below the age of 16. In this<br />
instance, the girl at the centre of<br />
the fuss was 14.<br />
The teaching council seems to<br />
have overreached itself in<br />
implicitly demandingthe<br />
recognitionofaclaim to gender<br />
changefor below16s.This is<br />
the issuethat should be under<br />
the legal microscoperather<br />
than theteacher's right to his<br />
beliefs.After all, teachers,like<br />
all professionals, occasionally<br />
must set aside their own beliefs<br />
in order to be abletofulfiltheir<br />
legal obligations as determined<br />
by their employer (especially<br />
when that is the state).<br />
