Al Drye's commentary Freedom
to Differ, in last week’s Courier,
missesthemain pointsraised by
the dismissal of ateacher for
refusing to use apupil's preferred
pronoun (‘he', as the girl in
question wasunderthe
impressionthat sheisaboy).
Ateachermust abidebythe
rules of conduct dictatedby
ministerialand professional
bodies. The Teaching Council of
Aotearoa NewZealand has
written into its code of ethics for
teachers that they mustrefer to
pupilsbypronounsassociated
with their self­nominated gender.
NewZealandlaw recognises the
right of a16­year­old to nominate
his/her gender (no, Iwon't use the
plural ‘they' when it is
grammatically inappropriate)
given parental consent.
Butthe overwhelming majority
of school studentsinNewZealand
are below the age of 16. In this
instance, the girl at the centre of
the fuss was 14.
The teaching council seems to
have overreached itself in
implicitly demandingthe
recognitionofaclaim to gender
changefor below­16s.This is
the issuethat should be under
the legal microscoperather
than theteacher's right to his
beliefs.After all, teachers,like
all professionals, occasionally
must set aside their own beliefs
in order to be abletofulfiltheir
legal obligations as determined
by their employer (especially
when that is the state).
