b. The default wage payment method in foreign crew’s employment agreements must be<br />

direct credit into the <strong>New</strong> <strong>Zealand</strong> bank account detailed above.<br />

c. Foreign crew members who elect to receive wage payments in cash instead of using the<br />

<strong>New</strong> <strong>Zealand</strong> bank account provided, must notify the Employer (and the NZCP if the<br />

employer is a foreign company) of their decision in writing in their own language.<br />

Note: It is solely at the foreign crew member’s discretion to refuse to use this <strong>New</strong> <strong>Zealand</strong><br />

bank account.<br />

d. The employer, the NZCP, manning agents, crew representatives, and any person<br />

associated with them, may not have access to, or Power of Attorney over, any foreign<br />

crew member’s <strong>New</strong> <strong>Zealand</strong> bank account.<br />

e. Where a foreign crew member refuses to use the available <strong>New</strong> <strong>Zealand</strong> bank account,<br />

payment of wages must be made directly to them in cash, in <strong>New</strong> <strong>Zealand</strong>.<br />

f. Where payment is made in cash in a foreign currency, the exchange rate used must be<br />

recorded, and notified to the foreign crew member at the time the payment is made.<br />

g. Foreign crew members must receive a final payslip at least 24 hours before their departure<br />

from <strong>New</strong> <strong>Zealand</strong> so that they have the opportunity to contact and meet with their<br />

authorised representative before departing <strong>New</strong> <strong>Zealand</strong> (see WJ5.50).<br />

WJ5.50 Departure procedure<br />

Effective 17/12/2012<br />

a. Wherever possible, the <strong>New</strong> <strong>Zealand</strong> employer or the <strong>New</strong> <strong>Zealand</strong> Charter Party (NZCP)<br />

must endeavour to have out-going foreign crew transported to their airport of departure.<br />

Where practicable, the employer or NZCP must also seek the assistance of airport officials<br />

in accompanying foreign crew to the boarding gate.<br />

b. The employer must give sufficient notice of at least 24 hours of crew departure to allow<br />

crew members the opportunity to contact and meet with their authorised representative<br />

before departing <strong>New</strong> <strong>Zealand</strong>.<br />

Note: Where foreign crew depart with the vessel, as opposed to via a foreign flight, compliance<br />

with (a) above is not required.<br />

WJ6 Applications for work visas for foreign crew of fishing vessels<br />

Effective 17/12/2012<br />

a. An immigration officer may grant a work visa and entry permission to an individual crew<br />

member with an offer of employment from a <strong>New</strong> <strong>Zealand</strong> employer or a Foreign<br />

Chartered Party (FCP) where either:<br />

i has a current Approval in Principle (AIP); or<br />

ii is seeking to fill a maximum of six crew positions on one vessel for a specified period<br />

up to a maximum of 12 months (non-AIP).<br />

b. Applications for individual work visas must be made before overseas crew members arrive<br />

in <strong>New</strong> <strong>Zealand</strong>.
