b. People already in <strong>New</strong> <strong>Zealand</strong> may apply for and be granted a visitor visa with a variation<br />

of conditions to allow study on a part-time basis for the balance of their stay up to a<br />

maximum of 9 months from the date of their arrival.<br />

c. If study is the main reason for the applicant being in <strong>New</strong> <strong>Zealand</strong>, immigration officers<br />

must decline any application to undertake part-time courses lasting longer than 9 months,<br />

unless the officers are satisfied that:<br />

i the application has special merit that warrants the application being approved, and<br />

ii the applicant will comply with the conditions of their visa.<br />

d. <strong>Immigration</strong> officers must be satisfied that applicants who wish to undertake part-time<br />

courses lasting up to 9 months after their date of arrival:<br />

i are enrolled in and have paid the fees for such a course; and<br />

ii are able to satisfy the standard visitor requirements (see V2.1).<br />

U7.20.5 Students completing their course of study<br />

a. Despite U7.20 above and U6.1.1, a person who is:<br />

i in their final semester of a course of study in <strong>New</strong> <strong>Zealand</strong>, that is of at least 2<br />

academic years’ duration; or<br />

ii in their final semester of a course of study in <strong>New</strong> <strong>Zealand</strong>, culminating in a <strong>New</strong><br />

<strong>Zealand</strong> qualification that would qualify for points under the Skilled Migrant Category<br />

(see SM14)<br />

may be considered to be a full-time student and may be granted a student visa for the<br />

remaining duration of their course if they can meet student requirements (see U3.1).<br />

b. To be eligible for a student visa under these instructions, applicants must not previously<br />

have been granted a visa under these instructions.<br />

U7.25 <strong>Temporary</strong> exemption from the requirement to live with a legal<br />

guardian in <strong>New</strong> <strong>Zealand</strong><br />

a. Students enrolled in school years 1 to 8, and students aged 13 and under who are enrolled<br />

in any other provider (see U3.30.5), may apply for a variation of conditions to their<br />

student visa to temporarily exempt them from the requirement to live with their legal<br />

guardian in <strong>New</strong> <strong>Zealand</strong> as set out at U3.30(b).<br />

b. A variation of conditions will only be granted where an immigration officer is satisfied that<br />

an emergency exists that requires the legal guardian to temporarily return to their home<br />

country.<br />

c. The applicant must provide evidence that:<br />

i an emergency exists that requires the legal guardian to temporarily return to their<br />

home country; and<br />

ii the education provider has approved the alternative caregiving arrangements,<br />

consistent with its obligations under the Code of Practice for the Pastoral Care of<br />

International Students; and<br />

iii the legal guardian has purchased a return travel ticket.<br />

d. The variation of conditions may be granted for the period of time required, up to a<br />

maximum of four weeks.
