ii is eligible to be granted a work visa.<br />

c. Before granting a temporary entry class visa to a partner and dependent children of a<br />

student visa holder, immigration officers must sight evidence that the student visa holder<br />

has been:<br />

i granted a student visa; or<br />

ii is eligible to be granted a student visa.<br />

d. Where a person is applying for a temporary entry class visa on the basis of their partner's<br />

immigration status, the partner who has been approved for the grant of, or is the holder<br />

of, the temporary entry class visa must complete the Form for Partners Supporting<br />

Partnership-based <strong>Temporary</strong> <strong>Entry</strong> Applications (INZ 1146).<br />

E4.10 Definition of 'ordinarily resident' in <strong>New</strong> <strong>Zealand</strong><br />

Effective 07/11/2011<br />

a. For the purpose of sponsorship (see E6), a person is considered to be ‘ordinarily resident’<br />

in <strong>New</strong> <strong>Zealand</strong> where an immigration officer is satisfied that <strong>New</strong> <strong>Zealand</strong> is their primary<br />

place of established residence at the time specified in immigration instructions.<br />

b. Evidence that <strong>New</strong> <strong>Zealand</strong> is a person’s primary place of established residence may<br />

include but is not limited to original or certified copies of:<br />

• correspondence addressed to the person;<br />

• employment records;<br />

• records of benefit payments from the Ministry of Social Development;<br />

• banking records;<br />

• rates demands;<br />

• Inland Revenue records;<br />

• mortgage documents;<br />

• tenancy and utility supply agreements;<br />

• documents showing that the person’s household effects have been moved to <strong>New</strong><br />

<strong>Zealand</strong>.<br />

The presence or absence of any of the documents listed above is not determinative. Each case<br />

will be decided on the basis of all the evidence provided.<br />

E4.15 Where to lodge an application<br />

Effective 29/11/2010<br />

a. Applications should be lodged at the INZ branch, Ministry of Foreign Affairs and Trade<br />

(MFAT) post or certain specified British posts responsible for receiving applications of that<br />

type from the geographical area or country in which the applicant currently lives. A list of<br />

current Receiving Offices is contained in Appendix 2.<br />

b. An application can be lodged at any INZ branch or MFAT post on the current list of<br />

Receiving Offices. However, if the application is not lodged at the appropriate office, the<br />

application may be referred to the appropriate office.<br />

E4.20 Where an application will be processed<br />

a. Applications for temporary entry class visas are processed by INZ offices and certain MFAT<br />

and British posts.
