current proprie<strong>to</strong>r’s name <strong>and</strong> address on the Trade<br />

Marks Register are required <strong>in</strong> order <strong>to</strong> complete the<br />

application form.<br />

Cost <strong>of</strong> fil<strong>in</strong>g a trade mark renewal application<br />

The government-fil<strong>in</strong>g fee is US $35.00. The Certificate<br />

fee is US $25.00. Pr<strong>of</strong>essional fees are dependent<br />

on the <strong>in</strong>stitution.<br />

Removal <strong>of</strong> a registered trademark<br />

A registered trade mark may be struck <strong>of</strong>f the Register<br />

on either <strong>of</strong> the follow<strong>in</strong>g grounds:<br />

• Five (5) years non-use<br />

• Lack <strong>of</strong> bona fide <strong>in</strong>tention <strong>to</strong> use the mark <strong>and</strong><br />

three (3) years non-use.<br />

All fees are payable <strong>in</strong> Tr<strong>in</strong>idad <strong>and</strong> <strong>Tobago</strong> dollars.<br />

Payment may be made by certified cheque <strong>to</strong> “The<br />

Controller, Intellectual Property Office,” or by cash at<br />

any District Revenue Office, with a voucher issued by<br />

the Intellectual Property Office.<br />

License<br />

A licensee <strong>of</strong> a trade mark may be registered as a user<br />

on the Trade Marks Register. In order <strong>to</strong> register the<br />

license agreement, the proprie<strong>to</strong>r <strong>of</strong> the mark <strong>and</strong> the<br />

licensee must apply jo<strong>in</strong>tly <strong>to</strong> register the trade mark<br />

license by complet<strong>in</strong>g the prescribed application<br />

form, pay<strong>in</strong>g the prescribed fee <strong>and</strong> fil<strong>in</strong>g the agreement<br />

at the Intellectual Property Office. The registered<br />

proprie<strong>to</strong>r <strong>of</strong> the mark must also furnish a statu<strong>to</strong>ry<br />

declaration that provides the relevant particulars required<br />

by the Controller.<br />

Patents<br />

Patent refers <strong>to</strong> the title granted <strong>to</strong> protect an <strong>in</strong>vention.<br />

An <strong>in</strong>vention must meet several criteria if it is <strong>to</strong><br />

be eligible for patent protection. It must:<br />

• Be novel (new), noth<strong>in</strong>g like it <strong>in</strong> existence <strong>in</strong> the<br />

world or <strong>in</strong> the literature, <strong>in</strong>clud<strong>in</strong>g other patent<br />

documents.<br />

• Exhibit a sufficient “<strong>in</strong>ventive step” (be non-obvious<br />

<strong>to</strong> someone with average skill <strong>in</strong> the art).<br />

• Industrially applicable, have a technical effect (be<br />

useful).<br />

Patents will not be granted for:<br />

• Ideas, hypotheses, discoveries (<strong>of</strong> th<strong>in</strong>gs already<br />

exist<strong>in</strong>g <strong>in</strong> nature), scientific theories <strong>and</strong> mathematical<br />

methods.<br />

• Rules <strong>of</strong> games, lottery systems, methods for<br />

perform<strong>in</strong>g mental acts, teach<strong>in</strong>g methods <strong>and</strong><br />

organisational procedures.<br />

• Diagnostic, therapeutic <strong>and</strong> surgical methods<br />

used on the human or animal body.<br />

• Literary, dramatic, musical or artistic works or<br />

any aesthetic creation whatsoever.<br />

• The presentation <strong>of</strong> <strong>in</strong>formation.<br />

• Inventions, the exploitation <strong>of</strong> which would be<br />

contrary <strong>to</strong> public order or morality.<br />
