ARTICLE 69<br />

Mediation<br />

1. If consultations fail <strong>to</strong> produce a mutually agreed solution, the Parties may,<br />

by agreement, seek recourse <strong>to</strong> a media<strong>to</strong>r. Unless the Parties agree otherwise, the<br />

terms of reference for the mediation shall be the matter referred <strong>to</strong> in the request for<br />

consultations.<br />

2. Unless the Parties agree on a media<strong>to</strong>r <strong>with</strong>in 15 days of submission of the<br />

mediation request, the EPA Committee shall select by lot a media<strong>to</strong>r from the pool<br />

of individuals who are on the list referred <strong>to</strong> in Article 85 <strong>an</strong>d are not nationals of<br />

either Party. The selection shall be made <strong>with</strong>in 20 days of submission of the<br />

mediation request <strong>an</strong>d in the presence of a representative of each Party. The<br />

media<strong>to</strong>r shall convene a meeting <strong>with</strong> the Parties no later th<strong>an</strong> 30 days after being<br />

selected. The media<strong>to</strong>r shall receive the submissions of each Party no later th<strong>an</strong> 15<br />

days before the meeting <strong>an</strong>d communicate <strong>an</strong> opinion no later th<strong>an</strong> 45 days after<br />

having been selected.<br />

3. The media<strong>to</strong>r’s opinion may include recommendations on how <strong>to</strong> resolve the<br />

dispute in accord<strong>an</strong>ce <strong>with</strong> the provisions of this <strong>Agreement</strong>. The media<strong>to</strong>r’s<br />

opinion is nonbinding.<br />

4. The Parties may agree <strong>to</strong> amend the time limits referred <strong>to</strong> in paragraph 2.<br />

The media<strong>to</strong>r may also decide <strong>to</strong> amend these time limits at the request of <strong>an</strong>y of<br />

the Parties or on his own initiative, based on the particular difficulties experienced<br />

by the Party concerned or the complexity of the case.<br />

5. The mediation proceedings, <strong>an</strong>d in particular all information disclosed <strong>an</strong>d<br />

positions taken by the Parties during these proceedings, shall remain confidential<br />
