to explore different aspect of the ILO’s strike concept in a systematic framework. It deals with
various issues such as objective, timing, prerequisites, restrictions and prohibitions, minimum service
requirement, sanctions, use of ADR, etc. The author attempts to find out what is the role
of the UN’s specialised agency in the 21st century regarding protection of the right to strike. The
topic gains actuality due to the application of the British Air Line Pilots‘ Association (BALPA)
to the ILO concerning the UK Government’s failure to meet the requirements of Convention 87.
In this case the ILO pointed out that the Laval and Viking judgements of the European Court
of Justice are incompatible with the ILO standards.
