Raffaele Garguilo is met<br />

in Luxemburg. Garguilo<br />
werkte eerder onder meer bij<br />
PwC en Ernst & Young New York. Hij<br />
is gespecialiseerd in cross border<br />
investeringen van hedge funds, in<br />
relatie tot het Luxemburgse belastingrecht.<br />
Hij bedient klanten uit<br />
onder meer de Verenigde Staten,<br />
Canada en het Verenigd Koninkrijk.<br />
Jan Maarten Gerretsen is<br />
per 1 juni bij Lexence<br />
gestart. Hij gaat het vastgoedteam<br />

Eerder was Gerretsen<br />

Loeff. Gerretsen heeft<br />
ruim 20 jaar ervaring in<br />
een advies- en procespraktijk die zich<br />
richt op commercieel onroerend goed<br />
en is gespecialiseerd in bouwrecht,<br />
projectontwikkeling, gebiedsontwikkeling<br />
en vastgoedtransacties. Hij treedt<br />
regelmatig op als docent in specialisatieopleidingen.<br />

Multinationals operating abroad may<br />
negatively impact local communities<br />
and/or employees by their own activities<br />
or by activities of suppliers or<br />
other business relations. When seeking<br />
to hold multinationals to<br />
account, impacted people may start a<br />
court case in the home country of<br />
the multinational (‘foreign direct liability<br />
claim’). To prove their case they<br />
will often need information in possession<br />
of the multinational about,<br />
for example, its group structure and<br />
operational structures. They often<br />
face multinationals unwilling to provide<br />
such information. In court, the<br />
success of their claims depends –<br />
among other factors - on national<br />
procedural law of the forum country.<br />
The Dutch system of evidence<br />
gathering in civil procedures is<br />
known to be restrictive. This became<br />
clear in the case before the Hague<br />
district court of four Nigerian farmers<br />
and the Dutch NGO Milieudefensie<br />
against Royal Dutch Shell<br />
(RDS) and its Nigerian subsidiary<br />
Shell Petroleum Development Company<br />
of Nigeria (SPDC). This case<br />
clearly showed the problems with<br />
the relatively restricted disclosure<br />
rules in the Netherlands. From this<br />
case, the question was raised<br />
whether the relatively restricted disclosure<br />
rules can be an obstacle to<br />
the principle of ‘Access to Remedy’, as<br />
formulated in the UN Guiding Principles<br />
on Business and Human Rights<br />
for foreign claimants seeking to hold<br />
multinationals to account. Currently,<br />
Dutch law of evidence, including disclosure,<br />
is under revision. There may<br />
be opportunities to influence this<br />
process. This expert meeting aims at<br />
feeding the debate on how Dutch disclosure<br />
rules could be amended in<br />
order to contribute to the realisation<br />
of ‘Access to Remedy’.<br />

Leiden Law Festival<br />
Van 17 t/m 20 juni vindt de derde<br />
editie van het Leiden Law Festival<br />
plaats. Neem deel aan een juridische<br />
stadswandeling, ga zwemmen voor<br />
het goede doel of volg een workshop.<br />
Als één van de oudste faculteiten van<br />
Universiteit Leiden is het recht verbonden<br />
met Leiden. Binnen de faculteit<br />
vinden deze dagen allerlei inhoudelijke<br />
activiteiten plaats, zoals een<br />
competitie (Moot Court, quiz), debatten,<br />
colleges en een banenmarkt. Het<br />
festival is een mooie mix van evenementen<br />
met als doel het in en rond<br />
de faculteit te laten bruisen. In de<br />
stad zijn er juridische rondleidingen<br />
en Leidse juridische organisaties zullen<br />
ook in deze week actief zijn op de<br />
juridische faculteit. Vrijdag 20 juni<br />
staat in het teken van Wereldvluchtelingendag<br />
en het recht. Om 10.15<br />
geeft prof. mr. Peter Rodrigues een<br />
college in het kader van Wereld<br />
Vluchtelingendag in het Kamerlingh<br />
Onnes Gebouw en om 18.00 uur<br />
zwemmen studenten en medewerkers<br />
in de Oude Vest om collegegel-<br />
