Enforcement and transitional
arrangement
It is the intention of the NMA that each flag
State shall prepare documentation that the
ships meet the requirements of the new
Regulations. Additionally, any exemption or
equivalent solution shall be treated by the
individual flag State. The NMA will carry
out port State controls to verify compliance
with the requirements.
Norwegian ships which do not have
international certificates will be provided with
a special certificate for ships operating in the
territorial waters surrounding Svalbard. The
certification process is initiated by the
company submitting a notification of
conversion (KS-0123). According to
Hillersøy, companies that are not subject to
the transitional arrangement and intend to
operate in Svalbard in the coming season
must get started with the certification process
as soon as possible.
“Lots of documents must be prepared
and processed and, in addition, several ships
will probably need to be reconstructed or
modified.”
Ships having operated in the territorial
waters of Svalbard for the last three years,
i.e. in 2017, 2018 and 2019, will be provided
with a five-year transitional arrangement
before having to meet all requirements. This
scheme is meant to help established
companies in these territorial waters and
whose services are based on tourism in
Svalbard.
“The requirements introduced are
extensive, and we need ensure that
established operators are given enough time
to adapt,” says Hillersøy. Approximately 20
ships may be subject to the transitional
arrangement. All other ships must meet the
new requirements before the start of season
2020. Hillersøy encourages the companies to
contact the NMA if they have any questions.
Furthermore, she promises that answers to
