7 ANSVAR<br />

7.1 Allmänt<br />

För köp genom Götborgs <strong>Auktionsverk</strong> gäller<br />

allmänna köprättsliga regler innebärande att<br />

inlämnade föremål säljs i befintligt skick varvid<br />

Kunden före försäljningen har erbjudits<br />

möjlighet och uppmanats att undersöka föremålet.<br />

GAV ansvarar inte för naturligt slitage,<br />

skador och defekter såsom skador på tavelglas<br />

och ramar eller för naturliga förändringar i levande<br />

material såsom blekning av papper och<br />

sprickbildningar i trä eller slitage i samband<br />

med visning. GAVs ansvar gentemot Kunden,<br />

oavsett anledningen därtill, för fel är begränsat<br />

till provisionsavdrag eller att till Kunden som<br />

mest återbetala det klubbade beloppet jämte<br />

provision. GAV ansvarar således inte för direkta<br />

eller indirekta skador eller andra kostnader som<br />

Kunden drabbas av.<br />

8 REKLAMATION<br />

Kunden uppmanas efter avhämtning att undersöka<br />

det köpta föremålet och omgående reklamera<br />

fel som upptäcks till GAV. Ansökan om<br />

reklamation skall ske skriftligen till GAV. Vid reklamationstillfället<br />

skall Kunden återlämna det<br />

köpta föremålet samt kopia av kvitto eller annat<br />

giltigt bevis om betalning till GAV. Kunden skall<br />

vidare ange namn, adress, telefonnummer och<br />

betalningssätt. GAVs värderingsmän prövar efter<br />

reklamation om föremålet är felaktigt och<br />

om reklamation skett i rätt tid samt om utbetalning<br />

skall ske till Kunden. För reklamation avseende<br />

uppgift om upphovsman eller ursprung<br />

gäller samma bestämmelser som för övriga reklamationer.<br />

9 FORCE MAJEURE<br />

GAV ansvarar inte för förlust som åsamkas<br />

Kunden om GAV inte kunnat fullgöra viss<br />

förpliktelse enligt Villkoren på grund av krig,<br />

krigsliknande händelser, arbetskonflikt, myndighetsbestämmelser<br />

eller annan olyckshändelse<br />

eller omständighet som GAV inte kunnat<br />

råda över eller förutse.<br />

10 HANTERING AV PERSONUPPGIFTER<br />

(PUL)<br />

Personuppgiftslagen (PUL) syftar till att skydda<br />

privatpersoner mot kränkning av den personliga<br />

integriteten vid behandling av personuppgifter.<br />

GAV informerar nedan om vilka rättigheter som<br />

personuppgiftslagen stadgar samt GAVs hantering<br />

av personuppgifter och för vilka ändamål<br />

dessa används. Personuppgifter som lämnas<br />

i samband med ett uppdrag, försäljning eller<br />

köp eller inom ramen för ett kund-/avtalsförhållande<br />

till GAV, behandlas av GAV för administration<br />

och fullgörelse av GAVs skyldigheter<br />

syftande till auktionsverksamheten och förpliktelser<br />

enligt lag. Personuppgifterna kan komma<br />

att användas för marknads- och kundanalyser,<br />

statistik samt i marknadsföringssyfte. Personuppgifterna<br />

kan komma att kompletteras genom<br />

att uppgifter från privata och offentliga register<br />

tillförs. Den som inte vill att hennes/hans<br />

personuppgifter skall behandlas för ändamål<br />

som rör direktmarknadsföring, kan skriftligen<br />

anmäla detta till GAV och den som önskar få in-<br />

formation om eller rättelse av sina personuppgifter,<br />

vilka behandlas av GAV, kan inkomma<br />

med en skriftlig begäran härom till GAV.<br />

11 TVIST<br />

Eventuella tvister i anledning av dessa allmänna<br />

villkor skall avgöras enligt svensk lag och<br />

med <strong>Göteborgs</strong> Tingsrätt som första instans.<br />

Terms and conditions for purchase<br />

1 GENERAL<br />

The Auction House of Gothenburg (Swe: <strong>Göteborgs</strong><br />

<strong>Auktionsverk</strong>) (“GAV”) annually holds a<br />

large number of public auctions where a client<br />

(“Client”) can purchase items under the following<br />

terms and conditions. GAV arranges traditional<br />

hammer sales as well as online sale. All<br />

items submitted to GAV are sold through commission<br />

on the behalf of various clients.<br />

1.1 Registration of the Client<br />

It is required that the Client is registered in order<br />

to participate in the auctions held by GAV.<br />

By his/her registration the Client acknowledges<br />

acceptance of the terms and<br />

conditions set herein and agrees to comply with<br />

them. First time buyers are required to provide<br />

credit information upon request. If the registered<br />

Client is a company or any other form of<br />

legal entity it is required that the registration is<br />

signed by an authorized signatory. GAV reserves<br />

the right to independently refuse or suspend a<br />

Client, either temporarily or definitely, if that<br />

Client according to GAV has breached these<br />

terms and conditions or fail to provide an acceptable<br />

credit rating.<br />

1.2 Auction catalogue and lot description<br />

Items are photographed and shown in the auction<br />

catalogue which is available at the website<br />

of GAV. The items that are included in the<br />

sale are presented with a catalogue text and<br />

photograph. The purpose of the photograph is<br />

merely to assist potential buyers in identifying<br />

an item. For this reason possible damages or<br />

deficiencies are not always visible in the photograph<br />

or mentioned in the catalogue text.<br />

The absence of such a reference shall in no<br />

way imply that an object is free from any defect<br />

or restoration. Nor does any reference to<br />

particular defects imply the absence of any<br />

other defects. The information contained in<br />

the auction catalogue regarding authorship,<br />

authenticity, age, technique, condition or provenance<br />

or any information regarding the general<br />

condition of the object, any damages or<br />

repairs is thus merely to be seen as a guidance<br />

to the Client. Watches and clocks are not sold<br />

with the objective of functioning as timepieces<br />

but rather as art objects. For that reason GAV<br />

does not assume any liability for the mentioned<br />

items proper functioning in a technical<br />

sense. The technical and mechanical nature or<br />

character of any item is not checked by GAV.<br />

Stated sizes and carat of precious stones or<br />

pearls may differ since they are not removed<br />

from their framework when sized. The Client<br />

may usually request a condition report of an<br />

item before the sale. The request is to be made<br />

to Customer Services by telephone or email in<br />

good time before the sale starts. Please note,<br />

that a supplementary condition report made by<br />

GAV is to be considered merely as a subjective<br />

statement on the condition of an item.<br />

2 THE CLIENTS’S OBLIGATION TO EXAMINE<br />

All items are sold as is. It is the Client’s responsibility<br />

to examine and assess the condition<br />

and quality of items and to verify that all<br />

accessories, if any, are included before the<br />

auction takes place. Any information regarding<br />

an item in the catalogue are to be seen merely<br />

as a guidance to the Client. Public viewings before<br />

each sale offers the possibility to examine<br />

the objects.<br />

3 HAMMER-SALE<br />

3.1 Bidding at the Auction room<br />

Bidding in the auction room shall be done by<br />

a clear voice or a clear sign. The auctioneer<br />

decides which bid will prevail in the event of<br />

two identical bids. The auctioneer will also determine<br />

if the auction is to be resumed in the<br />

event of uncertainty regarding the last declared<br />

bid. The question regarding if a particular bid<br />

is not be accepted is also decided solely by the<br />

auctioneer. GAV reserves the right to refuse any<br />

bid or entrance to the auction room for a legitimate<br />

reason. A binding purchase according<br />

to applicable sales of goods rules is at hand at<br />

the fall of the hammer. A registered bid is at all<br />

times binding.<br />

3.2 Absentee bids<br />

As a convenience of clients who are not present<br />

at the auction in person GAV accepts written<br />

purchase assignments registered via the<br />

website of GAV. GAV bids on the behalf of the<br />

Client up to the highest amount specified in<br />

the purchase assignment. GAV does not assume<br />

responsibility for faults that can arise as<br />

a consequence of ambiguities in the purchase<br />

assignment or for late submitted purchase assignments.<br />

Bidding by means of a purchasing<br />

assignment is done at the Client’s risk and<br />

GAV does not assume any liability for the nonexecution<br />

of the purchase assignment for any<br />

reason what so ever. A registered bid is at all<br />

times binding. A purchase assignment may be<br />

revoked or amended only if an identifiable mistake<br />

was made at the registration of the bid. A<br />

request for revocation must be in writing and<br />

must be customer service of GAV at hand at the<br />

same time that is stated for purchase assignments.<br />

In the event of identical bids, the first<br />

submitted bid prevails over the latter one. The<br />

Client must note that the customer number of<br />

the Client is shown and ranked on the Internet,<br />

before and after the date of auction. It is for the<br />

Client to verify that the purchase assignment<br />

has led to a purchase or not. The results of the<br />

auction are presented at the website of GAV.<br />

3.3 Telephone bids<br />

GAV generally offers the opportunity of participation<br />

in bidding by telephone. As a rule<br />

it is required that an acceptable reference is<br />

made to GAV. Requests for telephone bidding<br />

shall be stated in writing to the customer service<br />

of GAV no later than 16.00 on the day<br />

prior to the date of the auction. The request<br />

shall contain information regarding personal<br />

data of the Client, specification of the concerned<br />

items and finally, a telephonenumber<br />

where the Client can be reached at the time<br />

of the auction. Telephone bidding facilities<br />

are limited to the number of telephone lines<br />

available and requests are accepted on a first<br />

come first serve basis. GAV may decide on the<br />

priority between the bidders who have applied<br />

for telephone bidding. The Client is obliged to<br />

give a minimum bid matching the asking price.<br />

Placing a bid by telephone is provided free of<br />

charge. GAV will use reasonable efforts to contact<br />

the Client but will not accept liability for<br />

failure to do so or for errors and omissions in<br />

connection with telephone bidding.<br />

3.4 Bidding liabilities<br />

GAV is not responsible for damage or losses<br />

incurred due to technical error or problems<br />

with the communication or similar. GAV does<br />

furthermore not assume liability for the event<br />

a bid is not registered, a bid is wrongly registered,<br />

contact has not been established after<br />

the bidding, or if the wrong bidder has been<br />

contacted or if the item has been sold to other<br />

than the highest bidder.<br />

5 FEES AND ESTIMATES<br />

5.1 Commission fee and hammer fee in connection<br />

with a purchase<br />

GAV will add a commission fee of 22,5 per<br />

cent including VAT on each items sales price.<br />

A hammer fee of 50 SEK is added to each lot.<br />

VAT is only paid in regards to the commission<br />

fee and not the amount paid for the item.<br />

5.2 Resale right (Droit de suite)<br />

According to the Swedish Act (1960:729) on<br />

Copyright in literary and artistic works; a resale<br />

right, so called B.U.S.-fee, is rendered for resale<br />

of items protected by copyright. The fee<br />

is set at 5 per cent of the sales price and is<br />

accrued to the artist or his/hers surviving next<br />

of kin until the 70th year after the death of<br />

the artist. Items that are covered by this fee<br />

aremarked with a capital (D) in the auction<br />

catalogue. Changes regarding the resale right<br />

can be notified before the auction service takes<br />

place. The fee for resale right is not levied<br />

regarding sales of less than 1/20 of the price<br />

base amount pursuant to the Swedish National<br />

Insurance act (2010:110).<br />

5.3 Asking price<br />

All submitted items for sale are given a starting<br />

bid. The starting bid is based upon a market<br />

conformed evaluation of the item, conducted<br />

by the experts at GAV and is only meant to function<br />

as guidance for the Client. The hammer<br />

price may vary from the asking price. Bids below<br />

the Seller’s reserve price are not accepted.<br />

6 PAYMENT AND COLLECTION<br />

6.1 Payment<br />

All bids are binding to purchase. Payment<br />

should be made within five days after the date<br />

of the sale. Payment can be made to GAV’s<br />

bank account or at the cashier’s desk by bank<br />

or credit cards. A complimentary card fee will<br />

be charged to any credit card payments as GAV<br />

is acting commissioner. For security reasons<br />

we do not accept cash payments. Always state<br />

your customer ID and full name at payment.<br />

All payments are to be made in Swedish kronor.<br />

Detailed information regarding methods<br />

of payment, account details etc. may be found<br />

at the website www.goteborgsauktionsverk.se.<br />

After the fifth day has passed unpaid and uncollected<br />

lots will be subject to an additional<br />

fee of 50 SEK per day/lot that will be added to<br />

the final price. Furniture and large objects will<br />

be charged with a double fee. In the event of<br />

non-payment GAV reserves the right to annul<br />

the purchase and the Client will be charged a<br />

fee of 20% based on the final price; or sell the<br />

item another Client; or have the item collected<br />

by the Seller.<br />

6.2 Collection<br />

Purchased items are generally available for collection<br />

directly during a hammer sale-sale, if<br />

not otherwise stated. A receipt or other form<br />

of valid proof in regards to payment is required<br />

for collection. Payment in full must be made<br />

to the cashier or to GAV’s bank account and<br />

appear in GAV’s bank account before collection<br />

can be made. Items that are not collected<br />

within five days are kept at GAV on the Client’s<br />

own risk. GAV does not assume liability for the<br />

state of the item after the mentioned time period.<br />

GAV is entitled to sell sold items that have<br />

not been recovered after three months after<br />

due warning. The Client will be liable for any<br />

expenses and any divergence in price.<br />

7 LIABILITY FOR DEFECT<br />

7.1 General<br />

General rules regarding sales of goods are applicable<br />

for purchase of an item at auction. This<br />

means that an item is sold as is and the Client<br />

is given an opportunity and are encouraged<br />

to examine an item before the auction takes<br />

place. GAV does not assume liability for natural<br />

wear, damages and defects upon picture<br />

frames and glass in the frames or for alterations<br />

in living material, such as wood cracks<br />

or impairment and bleaching of paper resulting<br />

from examination, exhibition or usage of an<br />

item.GAV’s liability to the Client for any damage,<br />

regardless of the reason why, is limited<br />

to a decreased premium of purchase or at the<br />

most a repayment of the hammer price. GAV is<br />

not liable for direct or indirect damages or any<br />

other cost that the Client might have.<br />

8 COMPLAINTS<br />

The Client is urged to examine the object at<br />

collection and report any defects without delay.<br />

A complaint shall be submitted in writing to<br />

GAV. The purchased object shall be submitted<br />

with the complaint as well as a copy of the receipt<br />

or any other proof of full payment to GAV.<br />

The Client shall also state full name, contact<br />

details and preferred method of re-payment.<br />

After the complaint is filed GAV’s experts will<br />

verify if there is a fault, if the complaint has<br />

been filed in time and if the Client should be<br />

repaid. For complaints regarding authorship or<br />

origin of an object the rules of general complaints<br />

as stated above are applied.<br />

9 FORCE MAJEURE<br />

Under these terms and conditions GAV do not<br />

assume the liability for losses incurred by the<br />

Client attributable to the non-compliance of<br />

these terms and conditions by GAV due to war,<br />

warlike events or any other accident or circumstance<br />

that could not be predicted or is out of<br />

GAV’s control.<br />

10 PROCESSEING PERSONAL DATA (PUL)<br />

The Personal Data Act (“PUL”) aims to protect<br />

individuals against privacy violations during the<br />

management or processing of personal data.<br />

The information below has the sole purpose<br />

of informing about the rights that are granted<br />

by PUL and GAV’s processing of personal data<br />

and for which purposes they are used by GAV.<br />

Personal data submitted in connection with an<br />

assignment, sales or purchase or within the relationship<br />

between the Client and GAV, is processed<br />

by GAV for administrative purposes and<br />

for the fulfilment of GAV’s duties according to<br />

the business of auctions and its obligations under<br />

the law. The personal data may be used for<br />

market and customer analysis, statistical and<br />

marketing purposes. The personal data may<br />

become supplemented by the addition of data<br />

from private and public records. An individual<br />

who does not want his/hers personal data to be<br />

processed for marketing purposes may notify<br />

GAV in writing. Furthermore, an individual who<br />

wishes to obtain information regarding his/hers<br />

personal data may submit a written request to<br />

GAV.<br />

11 DISPUTES<br />

Any and all disputes arising out of these terms<br />

and conditions shall be governed by Swedish<br />

law and settled by the Swedish courts.<br />

These terms and conditions are valid from<br />

2012-01-01. The terms and conditions are based<br />

on the Swedish version (Swe: Köparvillkor)<br />

and if inconsistent the Swedish version shall<br />

prevail.<br />
