446. Amendment of Partition.— The partition may be amended, even after it h<strong>as</strong> become<br />

f<strong>in</strong>al and no appeal h<strong>as</strong> been preferred, <strong>in</strong> the very same <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g by<br />

agreement of the parties or their representatives, where there is a mistake of facts <strong>in</strong> the list<br />

of <strong>as</strong>sets or <strong>in</strong> the cl<strong>as</strong>sification of the <strong>as</strong>sets or any other error, which vitiates the will of the<br />

parties:<br />

Provided that where <strong>in</strong> the order there are clerical or arithmetical mistakes or any<br />

material errors aris<strong>in</strong>g from accidental slip or omission, they may be corrected at any time<br />

by the court, either of its own motion or on application of any of the parties.<br />

447. Suit for amendment of partition.— A party may file a suit for amendment of the<br />

partition, when subsequent <strong>to</strong> the f<strong>in</strong>al order the party acquires knowledge of a mistake of<br />

fact or cl<strong>as</strong>sification or other error which vitiates the will of the party, and the other parties<br />

are not <strong>in</strong> agreement <strong>to</strong> have the partition amended, amicable.<br />

448. Rescission of partition.—<br />

(A) Suit for rescission:<br />

(1) A suit for rescission of the judicial partition which h<strong>as</strong> become f<strong>in</strong>al, may be filed<br />

where there is preterition or non jo<strong>in</strong>der of any of the co-heirs and if it is found that the other<br />

parties acted fraudulently or malafide, whether the malicious conduct relates <strong>to</strong> the<br />

preterition or <strong>to</strong> the partition.<br />

(B) Application for review:<br />

(2) Rescission of a judicial partition may be obta<strong>in</strong>ed by fil<strong>in</strong>g a review application <strong>in</strong> the<br />

same court <strong>in</strong> the follow<strong>in</strong>g circumstances:-<br />

(a) When it is proved <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>g, result<strong>in</strong>g <strong>in</strong> a conviction which h<strong>as</strong><br />

become f<strong>in</strong>al, that the order which is sought <strong>to</strong> be reviewed w<strong>as</strong> p<strong>as</strong>sed by giv<strong>in</strong>g of<br />

bribe, corruption or <strong>in</strong>fluence;<br />

(b) When a judgement and order of conviction which h<strong>as</strong> become f<strong>in</strong>al is produced<br />

where<strong>in</strong> it w<strong>as</strong> held that the depositions or declarations of the experts, which might have<br />

affected the order that is sought <strong>to</strong> be reviewed, are false.<br />

The period of limitation <strong>to</strong> file a review on both the above grounds is 30 days reckoned<br />

from the date on which the order on the b<strong>as</strong>is of which the review is filed had become f<strong>in</strong>al.<br />

(3) The review application may be filed <strong>in</strong> the very same court which p<strong>as</strong>sed the order,<br />

with<strong>in</strong> 30 days from the date on which the party h<strong>as</strong> secured the document, or acquired<br />

knowledge of the fact which is the b<strong>as</strong>is for the review, on the follow<strong>in</strong>g grounds:-<br />

(a) When a decision is b<strong>as</strong>ed on a false document or judicial act and this issue w<strong>as</strong> not<br />

considered <strong>in</strong> the proceed<strong>in</strong>g when the decision w<strong>as</strong> given;
