(ii) <strong>to</strong> cause registration of the closed will, if it is <strong>in</strong> his cus<strong>to</strong>dy, before the competent<br />

authority, with<strong>in</strong> thirty days from the date of the knowledge of the death of the testa<strong>to</strong>r;<br />

(iii) <strong>to</strong> carry out or execute the testamentary dispositions and <strong>to</strong> defend, if necessary,<br />

their validity <strong>in</strong> or outside the court;<br />

(iv) <strong>to</strong> allow the parties <strong>to</strong> take <strong>in</strong>spection of the will, if it is <strong>in</strong> his cus<strong>to</strong>dy, and <strong>to</strong> allow<br />

true copies thereof <strong>to</strong> be taken, when so requested.<br />

269. Duty <strong>to</strong> <strong>in</strong>itiate <strong>in</strong>ven<strong>to</strong>ry.— (1) (a) The execu<strong>to</strong>r shall <strong>in</strong>stitute <strong>in</strong>ven<strong>to</strong>ry<br />

proceed<strong>in</strong>g where there are m<strong>in</strong>ors, <strong>in</strong>terdicted or absent heirs and legatees.<br />

(b) Where the testa<strong>to</strong>r h<strong>as</strong> empowered the execu<strong>to</strong>r <strong>to</strong> utilize the <strong>in</strong>come of a certa<strong>in</strong><br />

part of the estate for the benefit of a charitable or public utility foundation or trust or<br />

<strong>in</strong>stitution, which is <strong>in</strong>tended <strong>to</strong> be created by the will or which does not have a legal<br />

personality, the execu<strong>to</strong>r shall <strong>in</strong>itiate <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g and apply for the sale of<br />

such part of the estate by public auction.<br />

(2) The procedure laid down <strong>in</strong> clause (b) of sub-section (1) shall not be applicable where<br />

the <strong>in</strong>heritance or legacy w<strong>as</strong> left for the aforesaid purpose <strong>to</strong> an <strong>in</strong>stitution with legal<br />

personality or a trust already <strong>in</strong> existence.<br />

270. When the testa<strong>to</strong>r leaves forced heirs.— Where the testa<strong>to</strong>r leaves forced heirs, the<br />

testa<strong>to</strong>r shall not authorize the execu<strong>to</strong>r <strong>to</strong> take charge of the estate. However, the testa<strong>to</strong>r<br />

may direct that the forced heirs shall not take charge thereof, unless <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g<br />

are <strong>in</strong>stituted and the execu<strong>to</strong>r is served.<br />

271. Where the testa<strong>to</strong>r does not leave forced heirs.— (1) Where the testa<strong>to</strong>r leaves<br />

heirs who are not forced heirs, he may authorize the execu<strong>to</strong>r <strong>to</strong> take charge of the estate<br />

but he shall not exempt the execu<strong>to</strong>r from <strong>in</strong>stitut<strong>in</strong>g <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g.<br />

(2) Such heirs may prevent the execu<strong>to</strong>r from tak<strong>in</strong>g charge of the estate by provid<strong>in</strong>g <strong>to</strong><br />

him the necessary amount <strong>to</strong> meet the expenses for the discharge of his functions.<br />

(3) Where there are no funds <strong>in</strong> the estate sufficient <strong>to</strong> meet the expenses of the execu<strong>to</strong>r<br />

and the heirs are not will<strong>in</strong>g or are unable <strong>to</strong> advance the necessary amount, it shall be<br />

lawful for the execu<strong>to</strong>r <strong>to</strong> cause the sale of movables and, if the amount realized is not<br />

sufficient, <strong>to</strong> cause the sale of one or more immovables after hear<strong>in</strong>g the heirs; if any of the<br />

heirs is a m<strong>in</strong>or, absent person or an <strong>in</strong>terdict, the sale of the movables or immovable shall<br />

be done by public auction.<br />

272. Time limit <strong>to</strong> carry out the will.— (1) When no time limit h<strong>as</strong> been fixed <strong>in</strong> the will for<br />

its execution, the execu<strong>to</strong>r shall carry it out with<strong>in</strong> one year from the date on which he<br />

<strong>as</strong>sumes office or from the date on which the litigation, if any, with regard <strong>to</strong> the validity or<br />

nullity of the will, h<strong>as</strong> come <strong>to</strong> an end.
