334. Presentation of closed will and approval by the Special Notary.— (1) The testa<strong>to</strong>r shall<br />

present the closed will <strong>to</strong> a Special Notary <strong>in</strong> the presence of two witnesses and declare<br />

that the disposition is his l<strong>as</strong>t will.<br />

(2) Thereafter, <strong>in</strong> the presence of the said witnesses, the Special Notary, after hav<strong>in</strong>g a<br />

look at the will but without read<strong>in</strong>g it, shall draw a record of approval. The record shall be<br />

drawn immediately next after the signature on the will and shall be cont<strong>in</strong>ued without<br />

<strong>in</strong>terruption on the same page and on the subsequent pages.<br />

(3) The Special Notary shall draw a record stat<strong>in</strong>g <strong>as</strong> follows:-<br />

(a) whether the will is written and signed by the testa<strong>to</strong>r;<br />

(b) whether it is <strong>in</strong>itialled by the person who h<strong>as</strong> signed it;<br />

(c) the number of the pages of the will;<br />

(d) whether it h<strong>as</strong> or does not have any blot, <strong>in</strong>terl<strong>in</strong>eations, corrections or marg<strong>in</strong>al<br />

notes;<br />

(e) whether the testa<strong>to</strong>r w<strong>as</strong> identified;<br />

(f) whether the testa<strong>to</strong>r w<strong>as</strong> <strong>in</strong> his perfect senses and wholly free from any coercion;<br />

(g) whether the will w<strong>as</strong> presented by the testa<strong>to</strong>r <strong>in</strong> person <strong>in</strong> the manner required by<br />

law.<br />

(4) The record of approval shall be read, dated and signed <strong>in</strong> conformity with the<br />

provisions of the preced<strong>in</strong>g sections 324 and 325.<br />

(5) Thereafter and <strong>in</strong> the presence of the same witnesses the Special Notary shall put the<br />

will <strong>in</strong> a cover and seal it and draw up on the external side of the cover, a note giv<strong>in</strong>g the<br />

name of the testa<strong>to</strong>r whose will is sealed.<br />

335. Record of the approval of the closed will.— The records of approval of closed wills<br />

shall be made <strong>in</strong> the respective book. It shall conta<strong>in</strong> the details of the place, the day,<br />

month and year, when the record of approval w<strong>as</strong> made and the names and addresses of<br />

the testa<strong>to</strong>r and the witnesses.<br />

336. Failure <strong>to</strong> comply with formalities.— (1) A closed will <strong>in</strong> respect whereof the<br />

above mentioned formalities have not been complied with, shall not take effect and the<br />

Special Notary shall be liable <strong>to</strong> pay damages and be subject <strong>to</strong> major penalty by<br />

discipl<strong>in</strong>ary proceed<strong>in</strong>g.<br />

(2) Failure <strong>to</strong> record the number of pages of the will and whether it h<strong>as</strong> any blot,<br />

<strong>in</strong>terl<strong>in</strong>eations, correction or marg<strong>in</strong>al note, shall <strong>in</strong>validate the will, provided that it h<strong>as</strong> <strong>in</strong><br />

fact been <strong>in</strong>itialed and it does not have any blot, <strong>in</strong>terl<strong>in</strong>eations, correction or marg<strong>in</strong>al<br />

note.
