262. Where the execu<strong>to</strong>r decl<strong>in</strong>es <strong>to</strong> accept the office.— The appo<strong>in</strong>ted execu<strong>to</strong>rs<br />

may decl<strong>in</strong>e <strong>to</strong> accept the appo<strong>in</strong>tment. In this event, however, if a legacy is left <strong>to</strong> the<br />

execu<strong>to</strong>r <strong>as</strong> compensation for discharg<strong>in</strong>g the functions of execu<strong>to</strong>r, he shall not be entitled<br />

<strong>to</strong> claim the legacy.<br />

263. Time limit <strong>to</strong> decl<strong>in</strong>e appo<strong>in</strong>tment.— The appo<strong>in</strong>ted execu<strong>to</strong>r who is not<br />

will<strong>in</strong>g <strong>to</strong> accept the appo<strong>in</strong>tment, shall, with<strong>in</strong> thirty days from the knowledge of the will,<br />

so <strong>in</strong>form, by registered post, the Special Notary of the place where the <strong>in</strong>heritance opens<br />

with a copy <strong>to</strong> any one of the beneficiaries under the will. In c<strong>as</strong>e of his failure <strong>to</strong> <strong>in</strong>form the<br />

authorities mentioned above, he shall be liable <strong>to</strong> pay damages.<br />

264. When the execu<strong>to</strong>r may resign.— The appo<strong>in</strong>ted execu<strong>to</strong>r who h<strong>as</strong> accepted the<br />

office, may quit the office upon show<strong>in</strong>g just cause such <strong>as</strong> disability due <strong>to</strong> illness, absence<br />

for a long period or <strong>in</strong>compatibility with the discharge of a public office and upon obta<strong>in</strong><strong>in</strong>g<br />

an order of the court competent <strong>in</strong> terms of section 373. Such Order shall be made after<br />

hear<strong>in</strong>g the parties. In c<strong>as</strong>e he quits the office without order of the competent Court, he<br />

shall be liable <strong>to</strong> pay damages.<br />

265. Office of the execu<strong>to</strong>r is gratui<strong>to</strong>us.— The office of the execu<strong>to</strong>r is gratui<strong>to</strong>us,<br />

unless remuneration is provided for by the testa<strong>to</strong>r, <strong>in</strong> the will.<br />

266. Impediments <strong>to</strong> become execu<strong>to</strong>r.— Where there is an impediment which<br />

does not permit the person appo<strong>in</strong>ted <strong>as</strong> execu<strong>to</strong>r <strong>to</strong> <strong>as</strong>sume the office or the execu<strong>to</strong>r is<br />

discharged, the heirs shall carry out the purpose of the will and they shall be subject <strong>to</strong> the<br />

follow<strong>in</strong>g provisions:-<br />

(a) where the hereditary shares are not equal, the office shall vest <strong>in</strong> the heir who is the<br />

most benefited;<br />

(b) where the hereditary shares are equal, the parties shall appo<strong>in</strong>t the execu<strong>to</strong>r from<br />

amongst them, and, <strong>in</strong> c<strong>as</strong>e of disagreement or when one of them is a m<strong>in</strong>or or an<br />

<strong>in</strong>terdict or an absent person, the competent Court shall appo<strong>in</strong>t one amongst them.<br />

267. Powers of the execu<strong>to</strong>r.— The execu<strong>to</strong>r shall have such powers <strong>as</strong> the testa<strong>to</strong>r may<br />

have conferred upon him <strong>in</strong> accordance with law. However, he shall ce<strong>as</strong>e <strong>to</strong> function <strong>as</strong><br />

such upon the appo<strong>in</strong>tment of the head of the family <strong>in</strong> an <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g. He shall<br />

nevertheless be entitled <strong>to</strong> <strong>in</strong>tervene <strong>in</strong> the <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g <strong>to</strong> br<strong>in</strong>g <strong>to</strong> the notice of the<br />

court the directions conta<strong>in</strong>ed <strong>in</strong> the will.<br />

268. General duties of the execu<strong>to</strong>r.— Where the testa<strong>to</strong>r does not specify the duties of<br />

the execu<strong>to</strong>r, they shall be <strong>as</strong> follows:-<br />

(i) <strong>to</strong> make arrangements for the funeral of the testa<strong>to</strong>r and <strong>to</strong> pay the respective<br />

expenses and religious ceremonies <strong>in</strong> accordance with the wishes of the testa<strong>to</strong>r or,<br />

where the will makes no provision <strong>in</strong> this regard, accord<strong>in</strong>g <strong>to</strong> the cus<strong>to</strong>mary usages;
