(2) All copies given under this section shall be signed and sealed by the Special Notary<br />
and shall be admissible <strong>in</strong> evidence <strong>as</strong> proof of the contents of the orig<strong>in</strong>al documents. The<br />
certified copy shall conta<strong>in</strong> an endorsement stat<strong>in</strong>g the number of the will or other<br />
<strong>in</strong>strument <strong>in</strong> the <strong>in</strong>dex.<br />
314. Power of the State Special Notary and District Notary <strong>to</strong> super<strong>in</strong>tend and control<br />
Special Notaries.— (1) Every Special Notary shall perform the duties of his office under the<br />
super<strong>in</strong>tendence and control of the District Special Notary <strong>in</strong> whose District the office of<br />
such Special Notary is situated.<br />
(2) Every District Special Notary shall have authority <strong>to</strong> issue (whether on compla<strong>in</strong>t or<br />
otherwise) any order consistent with this Act, which he considers necessary <strong>in</strong> respect of<br />
any act or omission of any Special Notary subord<strong>in</strong>ate <strong>to</strong> him.<br />
(3) The State Special Notary shall have authority <strong>to</strong> issue, whether on compla<strong>in</strong>t or<br />
otherwise, any order consistent with this Act which he considers necessary <strong>in</strong> respect of<br />
any act or omission of any District Special Notary or any Special Notary subord<strong>in</strong>ate <strong>to</strong><br />
him.<br />
CHAPTER XIX<br />
POWERS OF THE DISTRICT SPECIAL NOTARY AND SPECIAL NOTARY<br />
315. Powers of the Special Notaries.— The Special Notaries shall have powers <strong>to</strong> draw<br />
authentic documents such <strong>as</strong> (a) public wills, (b) record of pr<strong>in</strong>ted open wills, (c)<br />
<strong>in</strong>struments of consent <strong>to</strong> the will by the spouse of the testa<strong>to</strong>r testatrix, <strong>as</strong> the c<strong>as</strong>e may be,<br />
(d) <strong>in</strong>struments of renunciation of <strong>in</strong>heritance, (e) record of approval of the closed wills, (f)<br />
ante nuptial agreements, (g) deeds of declaration of heirship, (h) adoption deeds and (i)<br />
such other acts which the Special Notary is authorized <strong>to</strong> perform by law.<br />
316. Power <strong>to</strong> adm<strong>in</strong>ister oath.— The Special Notary shall have powers also <strong>to</strong><br />
adm<strong>in</strong>ister oath <strong>to</strong> a person, whenever necessary, <strong>in</strong> connection with acts performed by<br />
him.<br />
317. Incompetence <strong>to</strong> act.— The Special Notary shall not act <strong>in</strong> <strong>in</strong>struments and deeds<br />
where he or his spouse is a party or at<strong>to</strong>rney or representative of a party or person hav<strong>in</strong>g<br />
<strong>in</strong>terest <strong>in</strong> the act or transaction; and also where any of the <strong>as</strong>cendant, descendant of the<br />
Special Notary , or brother and relative <strong>in</strong> the same degree or of his spouse is a party,<br />
<strong>in</strong>terested party, at<strong>to</strong>rney or representative of any party or person hav<strong>in</strong>g an <strong>in</strong>terest <strong>in</strong> the<br />
<strong>in</strong>strument or transaction.<br />
318. Duty of the Special Notary.— The Special Notary shall be bound <strong>to</strong> render services,<br />
when requested, which are with<strong>in</strong> his competence.
