testa<strong>to</strong>r is dead, he shall <strong>in</strong> the applicant’s presence and of two witnesses, open the<br />
cover, and at the applicant’s expense cause the contents thereof <strong>to</strong> be copied <strong>in</strong><strong>to</strong> his<br />
Book No. VI.<br />
(2) When such copy h<strong>as</strong> been made, the Special Notary shall re-deposit the orig<strong>in</strong>al<br />
will.<br />
343. Book of record.— The record mentioned <strong>in</strong> the preced<strong>in</strong>g section shall be written <strong>in</strong><br />
a book, the pages whereof shall be numbered, <strong>in</strong>itialed and at the end signed by the<br />
District Special Notary.<br />
CHAPTER XXV<br />
REGISTRATION OF THE CLOSED WILL<br />
AFTER OPENING<br />
344. Registration of will.— (1) Once the record of the open<strong>in</strong>g of the will is recorded <strong>in</strong><br />
the book, the Special Notary shall cause the will <strong>to</strong> be registered by copy<strong>in</strong>g <strong>in</strong> extenso <strong>in</strong><br />
an appropriate book by mak<strong>in</strong>g a orig<strong>in</strong>al note signed by the same, the Special Notary,<br />
stat<strong>in</strong>g how it w<strong>as</strong> opened and registered and whether any th<strong>in</strong>g suspicious w<strong>as</strong> noticed or<br />
not.<br />
(2) After the will is opened, all its pages shall be <strong>in</strong>itialed by its presenter or by the<br />
<strong>in</strong>terested parties present, by witnesses and by the Special Notary.<br />
(3) The orig<strong>in</strong>al of the will shall, thereafter, be kept <strong>in</strong> the office of the Special Notary <strong>in</strong><br />
safe cus<strong>to</strong>dy <strong>in</strong> charge of the Special Notary who shall be responsible for it.<br />
345. Withdrawal of sealed cover deposited under the preced<strong>in</strong>g section.— If the<br />
testa<strong>to</strong>r who h<strong>as</strong> deposited the sealed cover under the preced<strong>in</strong>g section wishes <strong>to</strong><br />
withdraw it, he may apply either personally or by duly authorized agent, <strong>to</strong> the Special<br />
Notary who holds it <strong>in</strong> deposit and such Special Notary, if satisfied that the applicant is<br />
actually the testa<strong>to</strong>r or his agent, shall deliver the cover accord<strong>in</strong>gly. The will shall be<br />
returned <strong>to</strong> the testa<strong>to</strong>r by follow<strong>in</strong>g the formalities laid down for the deposit of the will. A<br />
record shall be made <strong>in</strong> Book No. VII.<br />
CHAPTER XXVI<br />
INSTRUMENT OF DECLARATION OF HEIRSHIP<br />
346. Declaration of heirship.— (1) After the succession opens, and the law does not require<br />
that manda<strong>to</strong>ry <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>gs be <strong>in</strong>stituted <strong>to</strong> partition the <strong>in</strong>heritance, heirship<br />
may be proved by a deed of declaration of heirship drawn by the Special Notary.<br />
(2) Three persons and at le<strong>as</strong>t one of the <strong>in</strong>terested parties shall have <strong>to</strong> declare on oath<br />
before the Special Notary that the <strong>in</strong>terested party or parties named by them are the only<br />
heir or heirs of the dece<strong>as</strong>ed. If such dece<strong>as</strong>ed person w<strong>as</strong> married, the name of the<br />
spouse shall also be disclosed and whether the spouse is surviv<strong>in</strong>g or h<strong>as</strong> expired. The
