26. Acceptance or renunciation by one of the spouses only. — A married person is not<br />

entitled <strong>to</strong> accept or renounce an <strong>in</strong>heritance without written consent of the other spouse.<br />

The consent may be made good by an order of the Court.<br />

27. Acceptance of <strong>in</strong>heritance left <strong>to</strong> a person under disability. — The <strong>in</strong>heritance<br />

left <strong>to</strong> a m<strong>in</strong>or or a person under other disability may be accepted by those who represent<br />

him.<br />

28. Acceptance or renunciation of <strong>in</strong>heritance left <strong>to</strong> a deaf and dumb person.— A deaf<br />

and dumb person, who is not under guardianship and who knows <strong>to</strong> write, may accept or<br />

renounce the <strong>in</strong>heritance, either personally or through a constituted at<strong>to</strong>rney.<br />

29. Form of acceptance.— (1)The acceptance of <strong>in</strong>heritance is express or tacit.<br />

(2) The acceptance is express when <strong>in</strong> any document the heir accepts the title or quality<br />

of heir. The acceptance is tacit, when the heir does some act from which the <strong>in</strong>tention <strong>to</strong><br />

accept h<strong>as</strong> <strong>to</strong> be necessarily <strong>in</strong>ferred or the act done is of such a nature that he could not<br />

have done it otherwise than <strong>as</strong> an heir.<br />

(3) However, acts done solely <strong>to</strong> preserve or <strong>to</strong> provisionally manage or safeguard the<br />

<strong>as</strong>sets of the <strong>in</strong>heritance do not imply it’s acceptance.<br />

30. Gratui<strong>to</strong>us transfer of <strong>in</strong>heritance or share there<strong>in</strong>.— A gratui<strong>to</strong>us transfer of<br />

<strong>in</strong>heritance or share there<strong>in</strong> <strong>in</strong> favour of all the co-heirs <strong>to</strong> whom it would have belonged <strong>in</strong><br />

the absence of the transfer, shall be deemed <strong>to</strong> be renunciation of the <strong>in</strong>heritance.<br />

31. Consequences of Court decision declar<strong>in</strong>g a person <strong>to</strong> be an heir.— A person who<br />

h<strong>as</strong> been declared <strong>to</strong> be an heir by an order or decree of a Court that h<strong>as</strong> become f<strong>in</strong>al or<br />

a person aga<strong>in</strong>st whom a decision h<strong>as</strong> been p<strong>as</strong>sed expressly <strong>in</strong> that quality shall be<br />

deemed <strong>to</strong> be an heir both <strong>in</strong> relation <strong>to</strong> the credi<strong>to</strong>rs or the legatees who had been parties<br />

<strong>to</strong> the c<strong>as</strong>e <strong>as</strong> also <strong>in</strong> relation <strong>to</strong> others.<br />

32. Absence of consensus among heirs <strong>to</strong> accept or renounce <strong>in</strong>heritance.— Where there<br />

is no consensus amongst the heirs <strong>as</strong> <strong>to</strong> whether the <strong>in</strong>heritance should be renounced, some<br />

may accept it and others may renounce it.<br />

33. Transmission of right <strong>to</strong> accept.— Where the heir dies without accept<strong>in</strong>g or<br />

renounc<strong>in</strong>g the <strong>in</strong>heritance, the right <strong>to</strong> accept or renounce shall p<strong>as</strong>s on <strong>to</strong> his heirs.<br />

34. Indivisibility of renunciation.— (1) The heir who h<strong>as</strong> accepted the <strong>in</strong>heritance of the<br />

estate leaver may renounce the <strong>in</strong>heritance which the estate leaver had not accepted at the<br />

time of his death.<br />

(2) Renunciation of the <strong>in</strong>heritance of the estate leaver shall mean renunciation of all<br />

<strong>in</strong>heritances which would have otherwise devolved on the estate leaver.
