(vii) full names, age, status, professions and address of the witnesses, <strong>in</strong>terpreters<br />

and identifiers and also of the persons who read the documents at the request of the<br />

parties;<br />

(viii) the statement of the party that he does not know <strong>to</strong> sign or cannot sign;<br />

(ix) reference <strong>to</strong> the fact that the Special Notary h<strong>as</strong> read aloud the document <strong>to</strong> the<br />

parties <strong>in</strong> the simultaneous presence of the parties, the witnesses and other persons who<br />

have <strong>in</strong>tervened and of the read<strong>in</strong>g by the <strong>in</strong>terpreter or by any of the parties or any<br />

other person at their request, when compulsory;<br />

(x) the errata memo describ<strong>in</strong>g the corrections, <strong>in</strong>terl<strong>in</strong>eations, alterations, words<br />

struck through or if any er<strong>as</strong>ures before the signatures of parties, witnesses and Special<br />

Notary;<br />

(xi) signatures of the parties at the end of the text when they know or can sign and of<br />

the witnesses and other persons who have <strong>in</strong>tervened;<br />

(xii) signature of the Special Notary which shall be made at the end of the document;<br />

(xiii) the value of the notarial stamp affixed shall be mentioned <strong>in</strong> the <strong>in</strong>strument;<br />

(xiv) the <strong>in</strong>strument shall be recorded <strong>in</strong> the language of the court. Where the party<br />

does not know such language,the page where the <strong>in</strong>strument is written shall be divided<br />

<strong>in</strong><strong>to</strong> two columns and <strong>in</strong> left column the <strong>in</strong>strument shall be recorded <strong>in</strong> the language of<br />

the court and <strong>in</strong> the right <strong>in</strong> the language known <strong>to</strong> the party. The transla<strong>to</strong>r shall<br />

<strong>in</strong>tervene <strong>in</strong> the <strong>in</strong>strument and shall solemnly declare that the translation is true and<br />

correct.<br />

The <strong>in</strong>strument shall be recorded cont<strong>in</strong>uously, without any blank space or blank l<strong>in</strong>e.<br />

(2) The orig<strong>in</strong>als of powers of at<strong>to</strong>rney given by the parties <strong>to</strong> the at<strong>to</strong>rneys for<br />

<strong>in</strong>terven<strong>in</strong>g <strong>in</strong> a Notarial act have <strong>to</strong> be produced before the Special Notary who shall<br />

place them or certified copy thereof on record <strong>in</strong> his office.<br />

325. How <strong>in</strong>struments are <strong>to</strong> be recorded.— (1) All <strong>in</strong>struments and deeds, <strong>in</strong>clud<strong>in</strong>g<br />

Wills, endorsements and approvals shall be drawn by the Special Notary <strong>in</strong> black <strong>in</strong>k and<br />

all words shall be recorded <strong>in</strong> extenso and figures <strong>in</strong> words.<br />

(2) Draw<strong>in</strong>g of the <strong>in</strong>strument and deed shall be <strong>in</strong> the presence of two witnesses who<br />

shall put their usual signatures at the end of such deed or <strong>in</strong>strument.<br />

(3) The identity of parties <strong>in</strong> all <strong>in</strong>struments and deeds <strong>in</strong>clud<strong>in</strong>g the wills, may be done by<br />

any official identity card such voters identity card, PAN card, multi- purpose National<br />

Identity card or may also be done by witnesses or on the personal knowledge of the<br />

Special Notary.<br />

(4) Parties who know <strong>to</strong> write shall put their signatures <strong>as</strong> usual and also shall affix their<br />

left hand thumb impression. If there be no left thumb the impression of right thumb shall be
