367. Optional Inven<strong>to</strong>ry.— Where the <strong>in</strong>terested parties do not fall <strong>in</strong> any of the<br />
categories mentioned <strong>in</strong> section 366, the parties may <strong>in</strong>stitute <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g <strong>to</strong><br />
partition the <strong>in</strong>heritance, which shall be called <strong>as</strong> optional <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g.<br />
368. Inven<strong>to</strong>ry upon divorce, or separation or annulment of marriage.— (1) After<br />
the divorce or separation of persons or annulment of marriage is decreed, the spouses may<br />
partition their <strong>as</strong>sets by <strong>in</strong>stitut<strong>in</strong>g <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g which shall be miscellaneous<br />
proceed<strong>in</strong>g appended <strong>to</strong> the suit for divorce, separation of persons or annulment.<br />
(2) Separation of <strong>as</strong>sets <strong>in</strong> special c<strong>as</strong>es – debts of spouse, <strong>in</strong>solvency and bankruptcy;<br />
(a) Wherever any spouse seeks separation of common <strong>as</strong>sets or where either spouse is<br />
declared <strong>as</strong> <strong>in</strong>solvent or bankrupt, the procedure specified <strong>in</strong> sub-section (1) shall be<br />
followed with the follow<strong>in</strong>g modification:-<br />
(i) the credi<strong>to</strong>r of the <strong>in</strong>debted spouse or any credi<strong>to</strong>r <strong>in</strong> c<strong>as</strong>e of <strong>in</strong>solvency or<br />
bankruptcy shall have the right <strong>to</strong> prosecute the <strong>in</strong>ven<strong>to</strong>ry;<br />
(ii) debts which are not proved by documentary evidence shall not be approved;<br />
(iii) the other spouse h<strong>as</strong> the right <strong>to</strong> choose the <strong>as</strong>sets which shall constitute his or<br />
her moiety. If such right is exercised, notice thereof shall be given <strong>to</strong> the credi<strong>to</strong>rs who<br />
may object <strong>to</strong> the choice giv<strong>in</strong>g the grounds on which such objections are b<strong>as</strong>ed.<br />
(b) Where the court upholds the objection of the credi<strong>to</strong>rs, the court shall order that a<br />
second valuation of such <strong>as</strong>sets <strong>as</strong> have not been properly valued be done by three<br />
valuers appo<strong>in</strong>ted by the aggrieved spouse, the credi<strong>to</strong>r and the court.<br />
(c) When the second valuation modifies the value of the <strong>as</strong>sets chosen by the<br />
aggrieved spouse, he/she may with<strong>in</strong> 10 days from the conclusion of the appraisal,<br />
withdraw from the choice exercised. Thereupon, the moieties shall be allotted by draw<br />
of lots.<br />
369. Inven<strong>to</strong>ry where a party dies after allotment <strong>in</strong> Inven<strong>to</strong>ry proceed<strong>in</strong>g which were<br />
f<strong>in</strong>ally disposed of.— Where, after the partition is effected <strong>in</strong> any <strong>in</strong>ven<strong>to</strong>ry, any <strong>in</strong>terested<br />
party dies leav<strong>in</strong>g no <strong>as</strong>sets other than those that have been allotted <strong>in</strong> the <strong>in</strong>ven<strong>to</strong>ry, such<br />
<strong>in</strong>heritance shall be partitioned <strong>in</strong> the same <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g that w<strong>as</strong> f<strong>in</strong>ally disposed.<br />
The person <strong>to</strong> whom the office of head of family belongs shall take oath of office and the<br />
procedure set out hereafter shall be applicable.<br />
370. Inven<strong>to</strong>ry upon death of the surviv<strong>in</strong>g spouse.— (1) Where the <strong>in</strong>ven<strong>to</strong>ry of a<br />
predece<strong>as</strong>ed spouse is concluded, the <strong>in</strong>ven<strong>to</strong>ry on the death of the surviv<strong>in</strong>g spouse shall<br />
be cont<strong>in</strong>ued <strong>in</strong> the former <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g.<br />
(2) In the event there are additional <strong>as</strong>sets <strong>in</strong> the proceed<strong>in</strong>g referred <strong>to</strong> <strong>in</strong> sub-section (1),<br />
their serial number shall be <strong>in</strong> cont<strong>in</strong>uation of the l<strong>as</strong>t item <strong>in</strong> the former <strong>in</strong>ven<strong>to</strong>ry<br />
proceed<strong>in</strong>g.
