219. Restrictions on disposition of community <strong>as</strong>sets.— A disposition of specific and<br />

determ<strong>in</strong>ed properties by a person who is married under the regime of general community<br />

of <strong>as</strong>sets is null and void, unless:—<br />

(a) the <strong>as</strong>sets disposed of are allotted <strong>to</strong> him <strong>in</strong> a subsequent partition; or<br />

(b) they do not form part of the community; or<br />

(c) the disposition h<strong>as</strong> been made by one of the spouses <strong>in</strong> favour of the other; or<br />

(d) the other spouse h<strong>as</strong> <strong>in</strong> a document drawn by a Special Notary given consent <strong>to</strong><br />

the said disposition<br />

220. Restrictions on dispos<strong>in</strong>g of specific <strong>as</strong>sets of the <strong>in</strong>heritance.— (1) It shall not be<br />

lawful for a co-heir <strong>to</strong> dispose of any specific <strong>as</strong>set of the <strong>in</strong>heritance or right <strong>to</strong> a part of<br />

specific <strong>as</strong>sets, unless such <strong>as</strong>set or right <strong>to</strong> such part, is allotted <strong>to</strong> him <strong>in</strong> a partition<br />

(2) The disposition made <strong>in</strong> contravention of this section shall be null and void.<br />

221. Relative <strong>in</strong>capacity of sick person.— A will made by a sick person <strong>in</strong> favour of the<br />

physician or nurse who attended <strong>to</strong> him dur<strong>in</strong>g his illness or <strong>in</strong> favour of the priest who<br />

<strong>as</strong>sisted him spiritually dur<strong>in</strong>g his illness shall not take effect if the sick person dies of that<br />

illness.<br />

However, (a) a legacy by way of remuneration for the services rendered <strong>to</strong> the sick<br />

person when such person w<strong>as</strong> not paid any remuneration for the services or (b) a<br />

disposition made <strong>in</strong> favour of the descendants, <strong>as</strong>cendants, collaterals till the third degree<br />

or <strong>to</strong> the spouse of the testa<strong>to</strong>r, are valid.<br />

222. Disposition <strong>in</strong> favour of a person who h<strong>as</strong> rendered domestic help or care and<br />

<strong>as</strong>sistance.— A disposition made by a sick and old person, hav<strong>in</strong>g <strong>as</strong>cendants,<br />

descendants, collaterals till the fourth degree or spouse, <strong>in</strong> favour of a person who h<strong>as</strong><br />

rendered domestic help or care and <strong>as</strong>sistance <strong>to</strong> such person shall not exceed one third of<br />

the value of <strong>in</strong>heritance. However, a disposition made <strong>in</strong> favour of <strong>as</strong>cendants and<br />

descendants, collaterals till the fourth degree or the spouse of the testa<strong>to</strong>r is valid.<br />

223. Relative <strong>in</strong>capacity - Disposition <strong>in</strong> favour of guardian or manager of <strong>as</strong>sets.— A<br />

disposition made by a person who is <strong>in</strong>terdicted or under disability <strong>in</strong> favour of his guardian<br />

or manager of his <strong>as</strong>sets, even if the accounts of the management have been already<br />

approved, shall be void.<br />

224. Relative <strong>in</strong>capacity - Disposition by adulterous spouse.— Where the adultery<br />

is proved <strong>in</strong> court, either <strong>in</strong> crim<strong>in</strong>al or civil proceed<strong>in</strong>g, before the death of the testa<strong>to</strong>r, the<br />

adulterous spouse shall be <strong>in</strong>competent <strong>to</strong> make a disposition <strong>in</strong> favour of the partner <strong>in</strong> the<br />

adultery.
