(c) The head of the family shall be bound <strong>to</strong> defend and protect the estate.<br />

(d) The head of the family shall take such legal steps <strong>as</strong> may be necessary <strong>to</strong> recover<br />

debts payable <strong>to</strong> the <strong>in</strong>heritance when they are likely <strong>to</strong> become time barred, and <strong>in</strong><br />

c<strong>as</strong>e the head of the family files a suit for recovery of a debt, any of the co-heirs may<br />

apply <strong>to</strong> the court that he be made a party <strong>to</strong> the proceed<strong>in</strong>g.<br />

(e) The credi<strong>to</strong>rs of the <strong>in</strong>heritance may sue the head of the family <strong>to</strong> secure a<br />

preventive relief. But, <strong>in</strong> a matter relat<strong>in</strong>g <strong>to</strong> title <strong>to</strong> the properties or <strong>to</strong> recovery of debts.<br />

he shall not be so sued without implead<strong>in</strong>g all the co-heirs.<br />

(f) The head of the family is entitled <strong>to</strong> be reimbursed for the expenses <strong>in</strong>curred by him<br />

on account of the estate, with <strong>in</strong>terest thereon; but he shall not be liable <strong>to</strong> pay <strong>in</strong>terest <strong>in</strong><br />

respect of the amount received by him on account of the estate, except from the time he<br />

is <strong>in</strong> default.<br />

380.Concealment of <strong>as</strong>sets by head of the family.— Assets are deemed <strong>to</strong> be concealed<br />

when the head of the family fraudulently does not <strong>in</strong>clude an <strong>as</strong>set of the <strong>in</strong>heritance <strong>in</strong> the<br />

list of <strong>as</strong>sets or denies that such <strong>as</strong>set is part of the <strong>in</strong>heritance and a compla<strong>in</strong>t is made <strong>to</strong><br />

the court <strong>in</strong> this regard.<br />

381. Consequences of concealment.— (a) Where the head of the family h<strong>as</strong> concealed<br />

<strong>as</strong>sets, he shall forfeit any right he may have <strong>to</strong> the <strong>as</strong>sets concealed <strong>in</strong> favour of the other<br />

heirs.<br />

(b) Where the head of the family h<strong>as</strong> concealed the title deeds necessary <strong>to</strong> know the<br />

nature or the charges of the <strong>as</strong>sets, he shall be liable for damages result<strong>in</strong>g from such<br />

concealment.<br />

382.Consequence of giv<strong>in</strong>g a list of <strong>as</strong>sets b<strong>as</strong>ed on false documents.—Where the head<br />

of the family h<strong>as</strong> <strong>in</strong>cluded <strong>in</strong> the list of <strong>as</strong>sets and liabilities, credits, rights or charges b<strong>as</strong>ed<br />

on sham, false or forged documents, he shall be liable for the damage caused.<br />

383.Duration of office of head of the family.—The head of the family shall cont<strong>in</strong>ue <strong>to</strong><br />

manage the estate till the order of homologation becomes f<strong>in</strong>al.<br />

384. Removal of the head of the family.— (1)The head of family may be removed when<br />

he,-<br />

(i) delays <strong>in</strong> fil<strong>in</strong>g the list of <strong>as</strong>sets and liabilities,<br />

(ii) fails <strong>to</strong> <strong>in</strong>dicate <strong>to</strong> the valuers the <strong>as</strong>sets which are <strong>to</strong> be evaluated,<br />

(iii) does not appear <strong>in</strong> court, when required;<br />

(iv) does not produce the required documents;<br />

(v) does not give declarations or statements which are required from him; or<br />

(vi) does not manage the <strong>as</strong>sets with zeal and prudence.
