shall also liable <strong>to</strong> f<strong>in</strong>e.<br />
363. Th<strong>in</strong>g bona fide done or refused <strong>in</strong> his official capacity by an officer act<strong>in</strong>g under<br />
this Act.— No officer act<strong>in</strong>g under this Act shall be liable <strong>to</strong> any suit or claim or demand by<br />
re<strong>as</strong>on of anyth<strong>in</strong>g <strong>in</strong> good faith done or refused <strong>in</strong> his official capacity.<br />
364. Noth<strong>in</strong>g so done is <strong>in</strong>validated by defect <strong>in</strong> appo<strong>in</strong>tment or procedure of<br />
appo<strong>in</strong>tment of an officer act<strong>in</strong>g under this Act.— Noth<strong>in</strong>g done <strong>in</strong> good faith pursuant <strong>to</strong><br />
this Act by an officer under this Act shall be deemed <strong>in</strong>valid merely by re<strong>as</strong>on of any defect<br />
<strong>in</strong> his appo<strong>in</strong>tment or <strong>in</strong> the procedure of his appo<strong>in</strong>tment.<br />
CHAPTER XXXIII<br />
MISCELLANEOUS<br />
365. Ex-officio powers and acts <strong>to</strong> be done after office hours.—(1) The District Registrars<br />
and Sub-Registrars appo<strong>in</strong>ted under the Registration Act 1908 (16 of 1908), shall ex-officio<br />
exercise the powers and functions of District Special Notaries and Special Notaries under<br />
this Act.<br />
(2) The State Registrar appo<strong>in</strong>ted <strong>in</strong> the Registration Department of the State Government<br />
shall be the ex-officio State Special Notary and shall have power of general<br />
super<strong>in</strong>tendence and control over the Special Notaries and District Special Notaries, unless<br />
the State Government deems it necessary <strong>to</strong> appo<strong>in</strong>t a State Special Notary exclusively for<br />
perform<strong>in</strong>g functions <strong>as</strong> stated <strong>as</strong> above.<br />
(3) No Special Notary shall be bound <strong>to</strong> draw any <strong>in</strong>strument beyond the normal office<br />
hours or on Sundays or on holidays, unless there is an emergency. The Special Notary<br />
shall, where he is required <strong>to</strong> work beyond the normal office hours, be paid by the person<br />
requir<strong>in</strong>g such work, such over time fees <strong>as</strong> may be fixed by the Government, by<br />
notification. The Special Notary shall also be entitled <strong>to</strong> adequate police protection for his<br />
personal security and the security of the Notarial books.<br />

TYPES OF INVENTORY PROCEEDINGS<br />
366. Manda<strong>to</strong>ry Inven<strong>to</strong>ry. — When a person dies leav<strong>in</strong>g a surviv<strong>in</strong>g spouse or an heir,<br />
any one of whom is an <strong>in</strong>terdict, absent person, unknown, or m<strong>in</strong>or, <strong>in</strong>heritance shall be<br />
partitioned, by <strong>in</strong>stitut<strong>in</strong>g <strong>in</strong>ven<strong>to</strong>ry proceed<strong>in</strong>g only, which shall be called manda<strong>to</strong>ry<br />
Inven<strong>to</strong>ry proceed<strong>in</strong>g.
