For Manufacturing Defects: After <strong>the</strong> initial 3, 5 or 10 year period (depending upon <strong>the</strong><br />

shingle type), GAF’s contribution will be based on ei<strong>the</strong>r <strong>the</strong> following dollar per square<br />

value or, at GAF’s sole option, on providing replacement shingles, reduced <strong>by</strong> <strong>the</strong> amount<br />

of use received:<br />

Country Mansion: $120/sq. Grand Sequoia: $ 80/sq.<br />

Timberline Ultra: $ 55/sq. Slateline: $ 50/sq<br />

Original Timberline: $ 45/sq. Timberline 25: $ 40/sq.<br />

Marquis Wea<strong>the</strong>rMax: $ 35/sq. Royal Sovereign: $ 30/sq.<br />

Sentinel: $ 25/sq<br />

For Algae Discoloration: After <strong>the</strong> first year, GAF’s maximum contribution will be based<br />

upon <strong>the</strong> above dollar per square value, reduced <strong>by</strong> <strong>the</strong> amount of use received.<br />

For <strong>the</strong> last 5 years after application, GAF warrants its shingles against blow-off or<br />

damage <strong>by</strong> winds up to <strong>the</strong> maximum winds speeds listed below after <strong>the</strong>rmal sealing<br />

should have occurred and did not due to manufacturing defect:<br />

Country Mansion, Grand Sequoia, Slateline, Timberline Ultra, Marquis Wea<strong>the</strong>rMax – 80<br />

mph; Original Timberline – 70 mph; Sentinel, Royal Sovereign, Timberline 25-60<br />

mph.<br />

GAF will reimburse for <strong>the</strong> reasonable costs of replacing blown-off shingles (exclusive of<br />

underlayment, metal work or flashings) and hand sealing any remaining unsealed<br />

shingles. All self-sealing shingles must be subjected to warm sunlight for several days<br />

before full <strong>the</strong>rmal sealing can occur. Shingles installed in fall or winter may not seal until<br />

<strong>the</strong> following spring. Failure to seal or shingles that blow off under <strong>the</strong>se circumstances<br />

result from <strong>the</strong> nature of self-sealing shingles, not a manufacturing defect.<br />

Owner must send a notice of claim in writing, toge<strong>the</strong>r with proof of purchase to establish<br />

original ownership (or proof to transfer if <strong>the</strong> second owner has properly transferred<br />

coverage) and proof of application date, to GAF Materials Corporation Warranty Service<br />

Department, 1361 Alps Road, Wayne, NJ 07470, within 30 days after discovery of alleged<br />

defect. Owner may be required, at its expense, to submit sample shingles for testing and<br />

photographs.<br />

Decisions as to <strong>the</strong> extent of repair, recover or cleaning required, whe<strong>the</strong>r <strong>the</strong> shingles<br />

should be repaired, recovered or cleaned, and <strong>the</strong> reasonable cost of such work, will be<br />

made solely <strong>by</strong> GAF<br />

For <strong>the</strong> first five years for Summit III, Summit, and for <strong>the</strong> first three years for Tough-Glass<br />

Plus, Tough-Glass, Tough-Glass T-Lock, Premium-25, Asphalt-20, Asphalt T-Lock, <strong>the</strong><br />

maximum repair or replacement cost to Georgia-Pacific shall not exceed <strong>the</strong> replacement<br />

cost to <strong>the</strong> owner for <strong>the</strong> shingles, plus replacement application cost , exclusive of metal<br />

work, flashing or o<strong>the</strong>r costs. For <strong>the</strong> balance of <strong>the</strong> warranty, Georgia-Pacific's liability<br />

excludes any cost for tear-off or replacement installation of new shingles and is prorated.<br />

GAF manufacturers and sells <strong>the</strong> shingles. Georgia-Pacific sells shingles only.<br />

C<br />

Georgia-Pacific warrants that its Summit III, Summit, Tough-Glass Plus, Tough-Glass,<br />

Tough-Glass T-Lock, Premium-25, Asphalt-20, Asphalt T-Lock will resist damage <strong>by</strong> wind<br />

gusts up to a maximum of 54 mph for <strong>the</strong> first five years after installation. If, during this<br />

five year period, damage occurs to <strong>the</strong> shingles as a result of wind gusts under 54 mph,<br />

Georgia-Pacific will furnish at no charge, replacement shingles for <strong>the</strong> damaged shingles<br />

only, but no replacement labor. Shingles installed under conditions which temporarily or<br />

permanently preclude activation of <strong>the</strong> sealant must be hand sealed at <strong>the</strong> time of<br />

installation. In <strong>the</strong> event <strong>the</strong> shingles fail to self-seal after proper installation and climatic<br />

exposure, Georgia-Pacific's sole responsibility shall be to pay a reasonable cost to hand<br />

seal <strong>the</strong> affected shingles. In order to activate <strong>the</strong> sealant feature, <strong>the</strong> shingles must be<br />

exposed to warm sunlight for a continued period of time.<br />

Any claim made must be in writing and mailed along with <strong>the</strong> proof of purchase to Atlas<br />

<strong>Roofing</strong> Corporation [sic], Attention: Consumer Services, 2322 Valley road, Meridian, MS<br />

39307-9805 within five days after discovery of <strong>the</strong> alleged defect prior to any repairs being<br />

made.<br />

Within 45 days from receipt of notice, Georgia-Pacific will investigate claim, or at its option,<br />

designate in writing ano<strong>the</strong>r party including <strong>the</strong> owner to procure samples and forward<br />

<strong>the</strong>m to Georgia-Pacific.<br />

C, E. Warranty also states that warranty will be void if information submitted on warranty<br />

information form is erroneous.<br />

14. Inclusion of Consequential Damages <strong>No</strong> <strong>No</strong> <strong>No</strong><br />

15. Assignability<br />

Warranty coverage terminates upon sale of building and warranty may not be transferred<br />

or assigned, directly or indirectly, except for one transfer as follows:<br />

(a) The second owner must notify GAF in writing within 30 days after <strong>the</strong> property<br />

transfer has occurred.<br />

(b) If <strong>the</strong> transfer takes place within <strong>the</strong> first 10 years for Slateline, Grand Sequoia or<br />

Country Mansion or within <strong>the</strong> first 5 years for Royal Sovereign, Marquis Wea<strong>the</strong>rMax,<br />

Timberline 25, Original Timberline, or Timberline Ultra, or within <strong>the</strong> first 3 years for<br />

Sentinel, <strong>the</strong> second owner shall be entitled to all benefits contained in warranty.<br />

(c) If <strong>the</strong> transfer takes place after <strong>the</strong> initial 10, 5 or 3 year period ends, <strong>the</strong> length of<br />

<strong>the</strong> warranty shall be reduced to a two-year period after ownership changes. During this<br />

two-year period, GAF’s reimbursement to <strong>the</strong> second owner will be based on <strong>the</strong> dollar<br />

per square value, reduced <strong>by</strong> <strong>the</strong> amount of use that has been received from date of<br />

installation.<br />

Warranty may be transferred to new buyers of <strong>the</strong> building only when title to <strong>the</strong> real<br />

estate is transferred.<br />

ASPHALT SHINGLE WARRANTIES<br />

<strong>No</strong> Georgia-Pacific indicates that it is self-insured. <strong>No</strong><br />

Warranty is exclusive and replaces all o<strong>the</strong>r warranties, express or implied. Warranty is<br />

exclusive remedy from GAF and represents <strong>the</strong> sole remedy available to any owner of<br />

GAF’s shingles. GAF makes no o<strong>the</strong>r representations or warranty of any kind. Warranty<br />

may not be changed or modified. <strong>No</strong> one, including any representative or employee of<br />

GAF, has authority to assume any additional liability or responsibility for GAF<br />

GAF reserves <strong>the</strong> right to arrange directly for shingles to be repaired, recovered<br />

or cleaned instead of reimbursing owner for such work. GAF reserves <strong>the</strong> right to<br />

discontinue or modify its shingles, including <strong>the</strong> colors available, so any<br />

replacement shingles may not be an exact match. <strong>No</strong>tice of claim to contractor<br />

or dealer is not notice to GAF<br />

<strong>No</strong>; owner should have contractor or deal sign and date warranty certificate to help<br />

establish proof of purchase<br />

Warranty is sole and exclusive remedy. Georgia-Pacific makes no representation or<br />

warranty of any kind, o<strong>the</strong>r than as set forth in <strong>the</strong> limited warranty. Georgia-Pacific's<br />

liability is limited to <strong>the</strong> provisions of <strong>the</strong> warranty, whe<strong>the</strong>r any claim against it is based<br />

upon strict liability, negligence, breach of warranty or any o<strong>the</strong>r <strong>the</strong>ory or cause of action.<br />

<strong>No</strong> person is authorized to alter <strong>the</strong> warranty ei<strong>the</strong>r orally or in writing.<br />

After 5 years, Globe’s maximum liability for <strong>the</strong> cost of repair or replacement of defective<br />

shingles shall be a prorated amount of <strong>the</strong> reasonable replacement material cost only.<br />

Granule <strong>Roofing</strong> System), 16, 19, 20, 23<br />

Globe warrants for <strong>the</strong> initial 5 years that its shingles will resist blow offs due to wind<br />

velocities up to a maximum of 60 mph provided application is in accordance with Globe’s<br />

application instructions and upon <strong>the</strong> occurrence of <strong>the</strong>rmal sealing of <strong>the</strong> shingles. In<br />

order for sealing to occur, shingles must be exposed to sufficient sunlight to generate<br />

enough <strong>the</strong>rmal heat to activate <strong>the</strong> sealing strip. It is not a manufacturing defect if<br />

asphalt shingles installed in fall or winter fail to seal until <strong>the</strong> following summer when<br />

<strong>the</strong>rmal heat is sufficient to cause sealing. Shingles which do not receive direct sunlight or<br />

are not exposed to adequate surface temperatures may never seal.<br />

If blow-off occurs within <strong>the</strong> first 5 years after proper application and <strong>the</strong>rmal heat has<br />

been sufficient for proper sealing, Globe will furnish replacement shingles for those<br />

damaged or missing without charge, but will not be responsible for labor costs pertaining<br />

to removal or replacement of damaged shingles. In <strong>the</strong> event <strong>the</strong> shingles contain selfsealing<br />

strips which fail to activate after proper installation and climatic exposure, Globe<br />

shall have no liability unless it is afforded <strong>the</strong> opportunity to hand seal, at its sole expense,<br />

any nonsealing shingles within <strong>the</strong> first year after application. Any costs in excess of<br />

Globe’s contribution shall be <strong>the</strong> owner’s responsibility.<br />

Written notification to Globe within 30 days of discovery of any alleged shingle<br />

manufacturing defects which result in leaks through <strong>the</strong> shingle or wind damage. Proof of<br />

purchase and application must accompany written notice to Globe Building Materials, Inc.,<br />

Customer Service Department, 2230 Indianapolis Boulevard, Whiting, IN 46394. Owner<br />

is responsible for supplying samples of shingles and photographs showing problem, at<br />

owner’s expense, if requested <strong>by</strong> Globe.<br />

If Globe and <strong>the</strong> owner cannot reach agreement as to matters covered <strong>by</strong> warranty, Globe<br />

and <strong>the</strong> owner agree that such matters shall be settled <strong>by</strong> arbitration in accordance with<br />

<strong>the</strong> Center for Public Resources Rules for <strong>No</strong>n-Administered Arbitration of Business<br />

Disputes <strong>by</strong> one arbitrator, who shall not be appointed <strong>by</strong> ei<strong>the</strong>r party. Pending final<br />

award, arbitrator compensation and expenses shall be advanced equally <strong>by</strong> <strong>the</strong> parties.<br />

The arbitration shall be governed <strong>by</strong> <strong>the</strong> United States Arbitration Act, 9 U.S.C. §§ 1-16. If<br />

<strong>the</strong> United States Arbitration Act is determined not to govern <strong>the</strong> arbitration, <strong>the</strong>n it shall be<br />

governed <strong>by</strong> <strong>the</strong> Illinois Arbitration Act. The place of arbitration shall be Chicago, Illinois,<br />

at such location as <strong>the</strong> arbitrator directs.<br />

<strong>No</strong> representative of Glove, or its dealesr and distributors, are authorized to make nay<br />

change or modification to <strong>the</strong> warrnaty.<br />
