separate doma<strong>in</strong>s. Consumption does not lie<br />
beyond the sphere of production, but rather is<br />
given with<strong>in</strong> the producer’s field of dom<strong>in</strong>ance;<br />
it is that which can be encircled and <strong>in</strong>scribed<br />
by the producer. Control mechanisms def<strong>in</strong>e<br />
what is allowable with<strong>in</strong> this field and limit an<br />
<strong>in</strong>dividual’s ability to move beyond it. In the follow<strong>in</strong>g<br />
example we see the difficulty of mov<strong>in</strong>g<br />
beyond a position of consumption <strong>in</strong>to one of<br />
production.<br />
In 2003 John Young, a web designer from Westchester, USA, modified<br />
a 1980s Sony Walkman cassette player for use as an iPod protective<br />
case. Young decided to start small-scale commercial production of the<br />
Walkman modification. After conduct<strong>in</strong>g a number of experiments,<br />
Young developed an easy manufactur<strong>in</strong>g technique that he could carry<br />
out <strong>in</strong> his garage with a car jack and a specially designed steel die. In<br />
July of 2004, Young started sell<strong>in</strong>g the iPod cases onl<strong>in</strong>e under the<br />
name RetroPod. Six weeks later Young received a letter from Sony’s<br />
lawyers demand<strong>in</strong>g he stop sell<strong>in</strong>g the modified Walkman products.<br />
An excerpt from the letter follows:<br />
‘Sony recently learned that you are sell<strong>in</strong>g a case for carry<strong>in</strong>g an iPod<br />
personal stereo that is made from a WALKMAN tape player. The product<br />
is be<strong>in</strong>g offered at your website at www.retropod.com.<br />
Your use of cas<strong>in</strong>gs for such a purpose is a clear <strong>in</strong>fr<strong>in</strong>gement of the<br />
SONY and WALKMAN marks because it is deceptive. Consumers<br />
likely will be misled and deceived <strong>in</strong>to believ<strong>in</strong>g that Sony is somehow<br />
connected with the iPod personal stereo when <strong>in</strong> fact it is not. Moreover,<br />
they will be misled <strong>in</strong>to th<strong>in</strong>k<strong>in</strong>g that Sony is backward <strong>in</strong> its<br />
design of products and is go<strong>in</strong>g away from m<strong>in</strong>iaturization, as the size<br />
of the tape player hous<strong>in</strong>g is quite large by today’s standards.<br />
Accord<strong>in</strong>gly, we demand on behalf of Sony that you immediately cease<br />
and desist from sell<strong>in</strong>g, or offer<strong>in</strong>g to sell or distribut<strong>in</strong>g your Retropod<br />
product...’ 9<br />
