editorials/comment Council vs. Wimberg There is no question that the issue involving Municipal Judge Edward P. Kozmor's status has gotten seriously out of hand — to the point where it is threatening the basic foundation of the fledgling mayor- council form of government here. The issue arose in December, 1978 when the Sentinel-Ledger reported that Kozmor's original appointment in July, 1977 was ruled improper by the state Administrative Office of the Courts since he had been appointed to a full three-year term rather than merely to fill the unexpired term of the late Municipal Judge Augustus S. Goetz. Goetz' term ended May 15, 1978. After several months of stalling, Mayor Chester J. Wimberg finally on March 29, submitted Kozmor's name for council approval despite the fact that he was aware that council unanimously favored the appointment of local attorney Ronald Taht. When council turned down the appointment, Wimberg let it be known that he would allow the situation to remain at the status quo even though he clearly has the moral obligation to work out a compromise with council. According to Wimberg, the only reason he is refusing to compromise is that he feels an obligation to Kozmor since the Linwood attorney felt he had been appointed to a full three-year term. It's strange the mayor didn't feel the same way about the workers who were laid off last fall, despite election time »h?< no Civil Service personnel need fear for their jobs. To break the deadlock, council passed on first reading last week an amendment to the administrative code — the basic'document that set up the ground rules for the operation of the new government — that would allow council to unilaterally appoint the judge if the mayor doesn't work out a compromise. The Sentinel-Ledger feels that Wimberg is clearly wrong from the standpoint of the intent of the law — a point that was also made by both the city solicitor and the Ad- ministrative Office of the Courts. However, it is equally wrong, we believe, to set a precedent where the administrative code can be tam- pered with each and every time council comes upon a stumbling block. In this case, if Wimberg will not bow to common diplomacy, council has the platform to develop political pressure — it doesn't need to resort to legal measures that will both cost the taxpayers money and jeopardize the city's-new working document. The disagreement, if handled properly, is healthy. One of the positive aspects of the new form of government is the built-in checks and balances between council and the administration. It is the hope of the Sentinel- Ledger that council and Wimberg will meet as often as possible to work out a compromise and avoid the necessity of tampering with the administrative code or heading for a courtroom battle. ' ••: nalists rose to the best-seller gut then, I'm not a dancing lists regularly, and movies and television shows began to romanticize the lives of the working press. Most of these developments are healthy. But ("Ah," the perceptive reader is saving, "I knew he'd Rent control laws are needed The sailboat problem The old cliche goes, "Where there's smoke there's fire." But that was certainly not the case at last week's meeting of council. Despite the heat generated'over the introduction of an amendment to the city's controversial sailboat licensing ordinance, the fact remains that the ordinance with its amendment i& more than fair and that abuses do exist which must be remedied. The amendment will increase the fee for catamaran licenses from $75 to $150 and for monohuH boats the fee will be raised from $35 to $75. It also establishes a $5 for operators of the boats who must undergo a proficiency test before they can receive the license. The greatest abuse that exists under the old ordinance is that the original 75 holders of catamaran licenses and 25 holders of monohulL licenses, chosen in a lottery which awarded the licenses and also es- tablished a waiting list, have never given up the licenses despite the fact that several are alleged to have sold their boats. Council is looking at a way to remedy this problem. It should make penalties tough — so tough that if a person is found holding a license for another person to whom he sold his boat, both people should be prevented from ever receiving another license. Allowing these boats on the beach is a privilege that was struggled for by surf sailing enthusiasts for a long tune and it is a privilege that could and should be.revpked quickly when abused. "This," to those of you who haven't guessed by now, is rent and rent is emerging as a hot issue in Cape May and Atlantic County. A vast number of the population in these counties are senior citizens who are year round resident. To many, their only means of support comes from Spctal.Security a«! jpjpton checks. These rent increases are having a definite economic effect on their monthly income, evidenced by the number of complaints area governing bodies are receiving concerning - higher rents. There are many factors for the rent increases; the advent of casino gambling in Atlantic City has many landlords seeing the opportunity for bigger rent revenues due to the influx of people who will be both living and working near the casinos and the anticipated tourist who will need a place to stay. Many people in the Atlantic City area aren't getting rent increases; they're getting evicted by not having their Centers who haven't had an increase in yean, then are suddenly hit with an increase, should first look at the economic side of the lan- dlord's reasons before they scream "gouging." Remember, an apartment complex is ah investment and the owner should expect a Municipalities are looking at the rent control question creasing their rents because they know that the demand is greater than the supply. Many landlords also will only rent on a seasonal basis, obviously because of the summer rental demand, so the person looking for a year round residence will have greater difficulty. But there is a problem with landlords who are increasing rents every few months and some who won't even extend a lease to the tenant. This seems to be the biggest complaint of the tenants, especially the senior citizens. ieiMliU oinnto leases renewed. The unavailability of mor- tgage money in the South Jersey area for many prospective homeowners has many more people staying and looking for better apartments, and these people often are willing to pay a high price. Some landlords are In- starting to look into the rent problem, only became the people are starting to complain. Elections are coming soon and now is the time to let your local officials know your views on high rent and possible gouging. The casino growth will cause many people to look for bousing farther south. To aet some sort of rent policy now is the logical step for each com- munity to look into. lettersyreaders react The Ocean City Sentinel-Ledger Page Two, Section Two Thursday, May 3,1979 Industrialist doesn't trust government Laetrile probe Editor, Sentinel-Ledger: The following is an open letter to the citizens of New Jersey in the hope of clarifying my position on a recent political development concerning Laetrile here in New Jersey. In October of 1978,1 and my company, Cyto Metabolics of Linden, were subpoened by the N.J. State Department of Health to turn over all records of. those patients who had legally received Laetrile through our company, for the alleged purpose of conducting a state-sponsored "safety and efficacy study." Since the New Jersey Department of Health has traditionally been a bitter opponent of Laetrile metabolic therapy, which can be easily verified through its testimony at the Senate hearing on decriminalization July 19, 1977, I was very reluctant to trust the ex- pressed intentions. I viewed this subpoena as Just another attempt by state officials and the PDA to harass doctors, patients, and the distributors of Laetrile, such as myself, although the right to ship, receive, and use Laetrile had been secured in 1977 under Judge Luther Bohannon's federal court order CIV-754S18-B. Although the state of New Jersey and the FDA cannot interfere in the process of legal acquisition of Laetrile. we feared this study would be used as a vehicle to violate the sanctity and privacy of the doctor-patient relationship. As reported in the press in October, the Committee for Freedom of Choice, along with myself, my company, and a group of over 200 patients, filed in federal district court in Newark, a class action suit asking for injunctive relief against the state of New Jersey. Although the Honorable Frederick B. Lacey did not grant our in- junction, we feel a compromise was won. The state Health Department has agreed to make it a voluntary study, to keep the names of patients and doctors con- fidential, to use information gained by this study only for scientific and medical research, and not to use this study as a pretext for more harassment. Because of this compromise, the doctors, patients, and I are now willing to cooperate. We do bdive that Laetrile metabolic therapy has clinical merit, based on our observations over the years. We believe, if the state conducts an ac- curate study, it will come to the same conclusions. In case it doesn't, I will have' available in my office for the press, videotapes of many terminal cancer patients who have had, not only subjective remission, but also objective remission based on scans and x-rays, due to the Laetrile metabolic therapy. Also, after careful review of the state's protocol, we would like to go on record as predicting that the information gained by this costly study will be at best subjective and possibly even worthless. After reviewing the protocols of the proposed National Cancer Institute's clinical trails of Laetrile, we believe that only controlled clinical trials such as these can prove or disprove the merit of "Laetrile therapy," for many reasons too ex- tensive to enumerate here. In conclusion, if the motives of the New Jersey Depart- ment of Health and other agencies participating in this study are honorable, then the doctors, the pateints, and I will cooperate. On the other hand, if it engages in harassment of any parties our committee will re-enter federal court again, asking for complete injunctive relief GregKaye Chairman. Sentinel-Ledger: I am a resident of Ocean City, and have lived here all my life, which is almost 17 years. I have seen the streets in my town go from bad to worse. Now, the city is finally doing something about them. My complaint is that I think the people in charge of repairing the streets picked one heel of a tune to start fixing them. Since Ocean City is a family resort many people come down for their summer vacations as I am sure you know. It's getting warmer the repairs being made but I have to wonder why they picked the most crowded time. of the year to start fixing the streets when there was all of winter, fall, and early spring to start working on the dty. If the people in charge would open their eyes, they would realise that during these listening, seasons there is hardly anyone in town. Sentinel-Ledger: The time has come in Ocean aty for the citizens, mostly the young people, to be left alone by the police force. For example, a young person (17- 19 years of age) may be driving down a street, he may not be breaking any laws mind you, but he may be someone's house for a private party without harassment from the police. Yes, I could see if vandalism or very loud noise occurred, but I cannot go along with interrupting parties where no laws are probably cuu»um
