editorials/comment The Point master pi Somers Point council recently unveiled its new master plan and in doing so began addressing some of the tough issues that will face Atlantic and Cape May County communities as casino gambling continues its, growth in Atlantic Qty. It doesn't take any kind of a crystal ball to realize that the tens of thousands of new people that will be pouring into Atlantic and Cape May counties looking for jobs as more and more casinos open their doors in the coming years will put a lot of pressure on area communities in the areas of housing, service industry growth, traffic congestion and crane prevention. During the development of the master plan in Somers Point, the planning board refused to stick its an portions of the community for single family homes and open space only and restricts multi-family dwellings to those areas already developed for (his purpose. To address the problem of escalating housing costs in a city where the number of available units is restricted, Somers Point council also plans to introduce a rent control law, something that isn't very popular among real estate developers but something that more and more communities will have to consider as the big money of casino gambling begins to filter down into surrounding areas if older people and those others who have lived and worked in South Jersey for years aren't to be forced out. LEVIN t Director New Jersey Division of Consumer Affairs Should you be charged for "preparation" services performed on your new car by an auto dealer who is also paid by the manufacturer for gvprerforming those same •services? The attorney general and the state Division of Con- sumer Affairs do not think that this kind of double- dipping at the expense of the ^consumer should be per- Fmltted. So steps are being taken to curb this practice. A regulation has been proposed that would have the effect of barring a dealer from charging a "predellvery service fee" where the dealer also receives payment or credit for performing the service from a manufacturer or any other source. A period for receiving comments from the public on the regulation ends May 31. Following the end of the comment period, the attorney general is empowered to adopt the regulation. It is the view of the Division of Consumer Affairs that, regardless of the proposed regulation, it is an un- conscionable commercial practice for dealers to charge consumers for "dealer preparation" where the dealers are reimbursed by the manufacturer for such costs. The existing provisions of the Consumer Fraud Act, in the view of the division, proscribe this practice. During this interim period prior to the formal adoption of the regulation, the division has urged all automobile dealers to conduct their sales practices accordingly. The proposed regulation would bar any dealer from charging for "dealer preparation" if the dealer is reimbursed for such costs by "any person or entity other than a retail purchaser of the motor vehicle." The regulation also would require . the following statement be printed in a conspicuous place in ten-point • bold face type on the front of any sales document: "You have a right to a written itemized price for each specific pre-delivery service which is to be performed. HURLEY Alterably Minority Leader In Nobember of 1978, New Jersey voters soundly ^defeated, by nearly 300,000 •Wes, a proposed amendment to the New Jersey Con- stitution to permit wagering on Jai alai games. It now appears the question will be put to the voters once again this November, although in a 4ty somewhat different form. Clearly taking a hint from the recent experience in securing voter approval for legaliifd casino gambling, the supporters of the Jai alai question have drafted it and ttoonfined it to two cities — Camden and Jersey City. When the legalized gambling question was placed on the ballot in 1974* it was all- inclusive; that is, its approval raised the possibility that casinos could be located anywhere in the state. It was defeated rather handily, despite pre-election predic- tions that it would be ap- proved. Two years later, the same question was submitted to the voters, but with the provision that casinos would be per- mitted in Atlantic City only, a qualification which many persons feel contributed to eventual voter approval. Another-'— and perhaps more telling factor in that approval — was the condition written into the legislation that the tax revenue from gambling operations would be used to finance programs to benefit New Jersey s senior citizens and disabled.
