Following this process, the local experts performed the base assessment for the CLIR portion of<br />
the analysis. With the completion of the base assessment, the expatriate team used this<br />
information as well as their own research to discern particular areas of focus prior to arrival in<br />
each country. The expatriate team members <strong>and</strong> their areas of specialization are presented in the<br />

During September 2004, while the assessment team was being conducted in-country, they<br />
interviewed numerous government officials, nongovernmental organizations, multilateral <strong>and</strong><br />
bilateral donor agencies, judges, lawyers, notaries, investors, associations <strong>and</strong> chambers of<br />
numerous industries, trade <strong>and</strong> customs experts, <strong>and</strong> other domestic <strong>and</strong> international<br />
businesspeople to assess the trade <strong>and</strong> commercial legal environment of the each country.<br />
1. Background of the Diagnostic Methodology Used<br />
The <strong>Trade</strong> <strong>and</strong> <strong>Commercial</strong> <strong>Law</strong> <strong>Assessment</strong>s are the latest in a series of assessments applying<br />
USAID’s CLIR methodology, as refined by Booz Allen Hamilton, to gauge the status of CLIR in<br />
developing <strong>and</strong> transitioning countries. Additionally, Booz Allen Hamilton designed a<br />
proprietary metric tool, <strong>Trade</strong>Stream to assess the trade facilitation capabilities of a country.<br />
While the CLIR <strong>and</strong> <strong>Trade</strong>Stream diagnostics are two separate, st<strong>and</strong>-alone tools, they have<br />
both been applied in the TCLA assessments to generate a comprehensive snapshot of the overall<br />
situation <strong>and</strong> context for domestic <strong>and</strong> international business.<br />
Both the CLIR <strong>and</strong> <strong>Trade</strong>Stream methodologies have been subjected to field testing <strong>and</strong> peer<br />
review on a regular basis. Moreover, they have been adapted to the exigencies <strong>and</strong> realities of the<br />
